Regular Meeting
DATE: November 18, 1986 AT: Village Hall
Commissioners Present: Chairman Simmons, H. Bayer, J. Anderson,
R. Neely, W. Schempf, J. Sobkoviak.
Ex-Officio Present: D. Gullicksen, R. Russ, M. Gehrke,
J. Bostjancic.
Also Present: Attorney J. Harvey
Chairman Simmons called the meeting to order at 8:16 p.m.
Roll call was taken. D. Anderson, J. Eichelberger, Janet Anderson,
D. Almon, A. Arbo, and J. Wilson were absent.
There being no additions or corrections to the minutes of the
October 7, 1986 meeting, Chairman Simmons declared the minutes
approved as presented.
Chairman Simmons acknowledged receipt of a letter from Dr. John Bates.
It is on specifically non-conforming use and we will get back to
Dr. Bates with the exact status of his request.
Old Business:
Case No. 150-819862 - Leonard Kubinski, 2523 N. Van Dyke Road
requesting rezoning from R-A to B-4 to allow kennels.
Mr. Kubinski was present and briefly restated his petition that he
has a prospective purchaser who wishes to train seeing-eye dogs and
board dogs. He stated the Village Board referred him back to the
Plan Commission to find zoning to fit his request. .
Chairman Simmons stated that right now all the divisions in our
zoning ordinance do not allow kennels, consequently, we would have
to make a recommendation that our zoning ordinance be amended to
allow kennels in one specific class from a zoning standpoint.- Then
there would have to be a public hearing. If granted we would then
make a recommendation to the Village Board to grant that zoning to
your piece of property.
Attorney J. Harvey stated the Village Board concurred with the
Plan Commission's recommendation not to rezone this property to B-4,
but referred it back to the Plan Commission to see if there are any
present or future uses that might allow kennels, not just this piece
of property, but the Village as a whole. Mr. Kubinski's petition was
not clear as to what the use was going to be. The closest thing in
our B-4 covers an animal hospital; kennels are not allowed under
this classification. The main discussion tonight is: should we have
a proposed ordinance allowing kennels in a certain area or
reclassifying a certain section of the zoning ordinance.

Mr. Kubinski asked why wasn't he told at previous meetings that
no kennels are allowed, that this is his fifth meeting.
There was a long discussion on various districts to cover kennels:
agricultural, industrial, and various business districts.
Chairman Simmons stated we have to make a decision whether or not
to allow kennels and in what district, then recommend to the
Village Board. If the Village Board agrees, they then remand it
back to the Plan Commission for a public hearing.
J. Anderson stated he agrees kennels do not belong in B-4. That the
Village Board indicated we should work something out, in general.
Can't see why we can't make a recommendation that there be a specific
special use granted wherever it's going to be for kennels alone.
If the kennel does not make it, then it would revert back to the
original zoning.
Chairman Simmons stated you should allow special use for kennels
in certain districts only. You do not want to allow it in all
districts.
H. Bayer stated he prefers the agricultural category.
Attorney J. Harvey stated that in looking at other ordinances he
has seen kennels in industrial as a special use or in agricultural
as a special use, but large agricultural tracts.
Chairman Simmons stated that if we allow kennels in a special use
it should be well-defined, and if we allow kennels in an industrial
district it should be noted that most of our industrial zoning is
close to residential zoning.
J. Bostjancic commented he feels we should not allow kennels in town,
that no matter where you put kennels in town you do have residential
development.
Mr. Kubinski reminded the Board that his property has industry on
the south and west, apartment zoning on the north, and a retention
pond on the east.
J. Anderson moved to recommend that kennels be authorized in the
Village by special use only, and that only in Industrial Districts.
Seconded by R. Neely. Vote by roll call.
J. Anderson, yes; R. Neely, yes; H. Bayer, no; J. Sobkoviak, yes;
W. Schempf, no; A. Simmons, yes. Motion carried.

Request:- A variance to 3 feet on side lot to construct a
1-car garage attached to house.
Discussion:
The public hearing was held before the Zoning Board
of Appeals on Tuesday October 21, 1986. The legal
notice appeared in The Enterprise newspaper on
October 1, 1986, according to state statutes.
The Village Board referred this case back to the
Plan Commission for Findings of Fact.
Petitioner stated the garage he proposes to add on
to his house is 13 feet by..34 feet. It would be next
to the existing 112-car I garage already there. He also
stated that he cannot build anymore at the rear of
the house nor can he enlarge his garage in the rear
due to the septic field.
Petitioner stated his property is currently zoned
I-1 and questioned what regulations are we
following: I-1 or Residential. The Board stated
that from a legal standpoint they must follow the
I-1 zoning regulation.
There was some discussion regarding Petitioner's
previous variance granted in November of 1979.
Findings of Fact:
1. That the property in question is zoned I-1 and that
I-1 zoning requires a sideyard of 50 feet.

2. That the property in question is and has been used for
residential purposes and was the subject of a variance
granted by the Village Board on November 19, 1979, as
Ordinance No. 965 which permitted a one-car garage
addition to be attached to the front of an existing
storage shed with a sideyard of 3 feet. A copy of the
Report of the Zoning Board of Appeals Findings of
October 23, 1979, is attached as part of this record
as Exhibit A.
3. That hardship is alleged in that the Petitioner's septic
field located at the rear of the property prevented him
from building the proposed addition in the rear, and that
the location of the garage as proposed was the only
practical method for adding an addition on his present
property.
4. That as Industrial property, the variance would constitute
a 94% variance from the I-1 requirements, and a 70%
variance from the residential sideyard requirements.
5. That no objections were received, nor were any objectors
present at the hearing.
6. That according to the Petitioner's plans, the nearest
structure is the neighbor's garage which would be 15 feet
away from the proposed addition.
7. That the neighborhood in question is residential in
character, and the variation in question would not alter
the character of the neighborhood.
Recommendation: By a vote of 3-3 the Zoning Board of Appeals
recommends to the Village Board of Trustees
that the 3-foot sideyard variance be granted
to allow the construction of a 1-car garage
attached to house.

Mr. Kubinski was present and briefly restated
his request and that the Village Board referred
him back to the Plan Commission to find zoning
to fit his request.
The Board stated the main discussion here is to
see if there is any majority of opinion to change
any portion of the zoning ordinance as it stands
now to allow kennels in the Village of Plainfield.
Should we allow kennels in a certain district or
reclassify a certain district of the zoning
ordinance. There was discussion on various districts
to cover kennels: agricultural, industrial, various
business districts.
It was suggested the Plan Commission might recommend
that there be a specific special use granted for
whatever district it's going to be in and if the
kennels fail it would revert back to the original
zoning. Also, if we allow kennels in a special use
it should be well-defined. Also pointed out was that
if the Board wants to allow kennels in an industrial
district, that most of our industrial zoning is close
to residential zoning.
Petitioner reminded Board that his property has
industry on the south and west, multi-family on the
north and a retention pond to the east.
Recommendation:
By a vote of 4-2 the Plan Commission recommends to
the Village Board of Trustees that kennels be
authorized in the Village by special use only, and
that only in industrial districts.
