REGULAR MEETING
DATE: February 26, 1985 AT: Village Hall

Chairman Simons called the meeting to order at 7:50 p.m. Roll call
was taken.
The minutes of the meeting on February 12, 1985 were approved as read.
The agenda of February 26, 1985 was presented and closed with Case No.
131-1985V removed from the agenda to the Zoning Board of Appeals-.
ANNOUNCEMENTS:
Chairman Simmons stated that there will be two meetings in March. He
also said that a part time planner has been hired.
UNFINISHED BUSINESS:
Case #118-3883FP: Graham petition for final plat approval. There is
nothing to report at this time and will be continued until next meeting.
Pheasant Chase Subdivision: There is nothing to report at this time and
will be continued until next meeting.
Zoning Ordinance: There is nothing to report at this time and will be
continued until next meeting.
NEW BUSINESS:
Case #132-128852: Attorney Gil Niznik was present along with John Bays,
owner of the property. Architect, Cliff Bender was also present. John
Bays requested rezoning from B-1 to B-3 to inable this property the same
zoning qualifications as the plaza shopping center. The builder presented
the plans for the site with architecture being similar or the same as the
present plaza buildings. Concern was expressed as to the access to the
back of the property for deliveries. Petitioner stated that deliveries
will be made on a roadway to the north and west of the proposed expansion.
The roadway will be on petitioners property. Gil Niznik stated that this
would create new jobs, generate sales tax revenue and that this would be
compatable with business currently in the plaza. The following objectors
were present: Mr. and Mrs. Jack Lohmar, Mrs. Phyllis Puntney, Pat Davis
and Barney McCormick. They felt that it would reduce their property value,
cause odor, noise, trash and rodent problems. Mr. Lohmar stated that the
property was previously rezoned Res. A to B-1 to allow a medical clinic.

This B-1 zoning would be a buffer zone between the B-3 plaza shopping
center and the surrounding residential area. Chairman Simmons expressed
concern because B-3 zoning is considered central business area zoning
and requires no front, rear or side yard set back. This could allow a
building to be built on the lot line.
P. Bonelli made a motion to recommend to the Village Board that this
property be rezoned from B-1 to B-3. J. Anderson seconded the motion.
Vote by roll call: J. Anderson, yes; H. Bayer, yes, Arlo Simmons, no;
Donald Pearson, no; P... Bonelli, yes.
On motion meeting was adjourned at 9:30 P.m.

Location and Description: The property is located at 106 N. Division
St.
Action Requested: John Bays, owner of the property is requesting re-
zoning of the property from B-1 to B-3 so the plaza
shopping center could be expanded in a contiguous
manner to the north..

Recommendation: By a vote of 3-2, the Plan Commission recommends to the
