AN ORDINANCE TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A CONTRACT BETWEEN THE CITY OF JEFFERSON AND THE STATE HIGHWAY COMMISSION OF MISSOURI PROVIDING FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF A SCHOOL CROSSING SIGNAL ON ROUTE 50 AT KANSAS STREET. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. That the Mayor and Clerk are hereby authorized to execute on behalf of the City of Jefferson a contract with the State Highway Commission of Missouri providing for the installation, operation, and maintenance of a school crossing signal on Route 50 at Kansas Street, a copy of which contract is attached hereto and made a part hereof as is fully set out herein. SECTION 2. That all ordinances or parts of ordinances here- tofore enacted which are in conflict herewith are hereby repealed. SECTION 3 . This ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: � Approved: - --�— esi nfi of the Vuncil Ma Appro as to Fo Ci At orney Attest: City C1 rk r� ew 12-18-70 CONTRACT FOR SCHOOL CROSSING SIGNAL AT AN VXTSTT,1G SIGNALIZED INTERSECTION (In Municipalities) `� r This agreement, made and entered into on this 7th day of 19 __19 , by and between the State Highway Commission of Missouri, hereina ex called "Commission", and the city of JeffP3:S on , a municipal corporation hereinafter called "City", and the School District, acting through its Board of Directors, hereinafter called "District" WITNESSETH: 1. Commission shall modify the existing traffic control signal by installing school crossing pedestrian control indications on Route 50 at Kansas Street in the County of Cola 2. The signal shall be of standard construction, meeting State Highway Department standards. 3. The cost of the signal installation, operation, and maintenance shall be borne by Commission. 4. City agrees to operate the signal in accordance with the schedule hereinafter set out, subject to changes as may be approved by Commission. S. The supervision and operation of the pedestrian time periods of the signal and the crossing of the school students shall be during the hours set out in paragraph 6 and shall be accomplished by a competent adult crossing guard acting for City. 6. The schedule of operation of the pedestrian signal shall be: Morning On 7: 50 A.M. Off 8 ! 3n A.M. Noon On 11 : 30 A.M. Off .12 . 10 P.M. Afternoon On 3 : 30 P.M. Off 4.00 P.M. 7. At the end of each pedestrian time period as set out in paragraph 6 above, the pedestrian On-Off switch shall be locked in the Off position and the key to the switch cabinet shall be placed in the custody of the individual so authorized to possess same. When the pedestrian switch is in the Off position, the signal shall revert to normal vehicular signal operation as determine` by Commission. In the event that Commission determines that the signal is not needed for temporary periods of time, the signal faces shall be hooded by Commission. ® 8. District shall direct a notice of the crossing schedule to all parents of school students using the crossing, with the request that they instruct their children to comply fully with the directions given by the adult crossing guard in charge of supervising the scheduled crossings. 9. The crossing guard operating the pedestrian signal will be required to use every possible effort to avoid inconveniencing vehicular traffic more than necessary but shall exercise every precaution to avoid endangering the pupils while crossing the highway. 10. Commission cannot guarantee safe roadway crossing for pedestrians and this agreement is entered into and the crossing signal installed for the purpose of giving the adult crossing guard the proper traffic control devices to assist in supervising the crossing for maximum protection to the school pupils. The crossing schedule set out above is based on a.survey of the school crossing to meet reasonable _ 2 needs and it will be the responsibility of District to see that the school students use the crossing accordingly. 11. If the City or District fails to comply with the provision of this agreement regarding the use of signal, Commission may remove the pedestrian crossing signal. 'In the event that Commission should determine that the pedestrian crossing signal is no longer justified, Commission may remove same.
