AN ORDINANCE TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A
WRITTEN AGREEMENT BETWEEN THE CITY OF JEFFERSON AND THE STATE
HIGHWAY COMMISSION OF MISSOURI PROVIDING FOR THE INSTALLATION
OF RAILROAD CROSSING ADVANCE WARNING DEVICES .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS :
SECTION 1. That the Mayor and Clerk, are hereby authorized
to execute on behalf of the City of Jefferson a written agreement
with the State Highway Commission of Missouri providing for the
k installation of railroad crossing advance warning devices .
SECTION 2. A copy of said agreement is attached hereto.
SECTION 3. This ordinance shall be in full force and
effect from and after the date of its passage and approval.

WARNING DEVICES AGREEMENT
This Agreement made and entered into by and between the State
Wighway Commission of Missouri, hereinafter called "Commission", and the
CITY OF JEFFERSON CITY, MISSOURI , hereinafter called "Agency',
WITNESSETH:
The United'States Government has appropriated funds under Section
203 of the Highway Safety Act of 1973 and 1976 for the upgrading of advance
warning devices at railroad grade crossings, said funds having been assigned
to Commission for administration and distribution from the Highway Trust
Fund.
The advance warning devices contemplated under the aforementioned
grant and referred to in this agreement are advance warning signs and pave-

Went markings. Any reference in this agreement to "advance warning devices"
shall pertain to only these two types of devices.
Certain grade crossings in the Agency qualify for advance warning
devices under the requirements and conditions of aforementioned Highway
Safety Act.
Agency desires that certain railroad crossing advance warning
devices be installed and constructed on either side of these grade crossings
in accordance with the Manual on Uniform Traffic Control Devices and criteria
developed in accordance therewith.
The location,. type, and cost of the advance warning devices to
�e installed as per this agreement are shown on Exhibit A, attached hereto
and incorporated herein.

In consideration of the mutual covenants and promises contained
herein to be faithfully kept and performed by the parties hereto and each of
them, it is agreed as follows:
1. Agency shall have sole responsibility for installation and
construction of the advance warning devices, but shall install and construct
said advance warning devices in the manner approved by Commission's District
Engineer. Said approval shall be given if the advance warning devices con-
form to the following specifications, to wit:
A. The advance warning sign shall be reflectorized with an engineer
grade or better sheeting consisting of glass spheres embedded beneath a flex-
ible, transparent plastic on either an aluminum or steel panel of satisfactory
structural rigidity. The sign post shall be on a 4" x 4" nominal dimension or
equivalent wood post or equivalent steel post of a good commercial grade and
treating.
B. The pavement marking shall be done with a good commercial quality
paint and adequately reflectorized with reflective glass beads of an acceptable
commercial quality.
2. After construction and installation, all obligations of Com-
mission under this agreement shall thereupon cease and terminate. Agency shall
keep, control and maintain the roads including the advance warning devices the
same as and for all purposes, a part of the Agency's road system at its own
cost and expense and at no cost and expense whatsoever to Commission.
3. Agency shall indemnify and sale harmless Commission from damages
or claims for damages growing out of or in connection with the herein contem-
plated Railroad Crossing Advance Warning Devices Agreement. Commission is to
assume no liability for the completion or maintenance of the hergin contemplated
improvements.

4. The cost of one Advance Warning Sign for a crossing is to be
Fifty Dollars ($50.00). The cost of one Pavement Marking for a crossing is
to be Sixty-Seven and 50/100 Dollars ($67.50). The total cost of the advance
warning devices to be installed and constructed by Agency is listed on Exhibit A,
attached hereto and incorporated herein. The costs recited in this paragraph
and in the attached Exhibit A shall include the cost of all materials and all
installation costs.
5. The cost of the improvement contemplated herein will be borne
by the United States Government and by Agency.
6. After installation and construction of the advance warning devices
listed on Exhibit A, in accordance with the specifications in the Manual on
Uniform Traffic Control Devices and the specifications of Commission as referred
to in Paragraph 1, Agency will certify that the installations are complete by
signing a copy of Exhibit A and returning this copy to Commission's District
Engineer. Conmission will reimburse Agency for 90% of the total cost of
installing the advance warning devices after the Federal government has reim-
bursed the Commission pursuant to the terms and conditions of Section 203 of
the Highway Safety Act of 1973 and 1976.
7. Commission and the Federal Highway Administration shall have the
right to make a final inspection of the installation and construction of the
advance warning devices for compliance with the specifications of the Uniform
Manual on Traffic Control Devices and the specifications of Commission.
8. Agency agrees it will not discriminate against any employee or
applicant because of race, color, religion, sex, or national origin. Agency
further agrees it will abide by all State and Federal Civil Rights laws, rules,
® and regulations including, but not limited to, Title VI of the Civil Rights Act
of 1964 and the provisions of 49 CFR Part 21 and 23 CFR 710.405(b).

9. This Agreement is made and er.7�_red into subject to the approval of the
Federal Highway Administration.
