ORD NANCE NO. � AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CLERK OF THE CITY OF JEFFERSON, TO EXECUTE A CONTRACT WITH PROST BUILDERS, INC. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City, to execute a written contract with the Prost Builders, Inc. , for the demolition and removal of existing buildings located at 401 Monroe Street, excluding the original stone jail, for the sum ® of $12,800.00. 7"'U,c , Section 2. This ordinance shall take effect and be in force from and after -its passage and approval. - 1-7- 7 PASSED APPROVED c r 6PreTdent of t Council Mayor ATTEST: lerk II DEMOLITION AND REMOVAL OF EXISTING BUILDINGS AT 401 MONROE STREET, EXCLUDING THE ORIGINAL STONE JAIL FOR JEFFERSON CITY, MISSOURI C O N T R A C T A G R E E M E N T THIS AGREEMENT, made and entered into this day of September , 1979 , by and between PROST BUILDERS, INC. , Party of the First Part, and hereinafter called the Contractor, and the City of Jefferson, Missouri, acting through its Mayor, thereunto duly authorized to do so, Party of the Second Part and hereinafter called the City. WITNESSETH: THAT WHEREAS, the City has caused to be prepared, in accordance with law, specifications and other contract documents for the work herein described has approved and adopted said documents and' has caused to be published for and in connection with the DEMOLITION AND REMOVAL OF EXISTING BUILDINGS LOCATED AT 401 MONROE STREET, EXCLUDING THE ORIGINAL STONE JAIL, JEFFERSON CITY, MISSOURI , in accordance with the terms of this contract; and City of Jefferson. WHEREAS, the said Contractor, in response to such advertisement, has submitted to the City in the manner and at the time specified, a sealed proposal in accordance with the terms of said advertisement; and WHEREAS, the City in the manner prescribed by law, has publicly opened, read aloud, examined and canvassed the proposals submitted in response to the published invitation therefor, and as a result of such canvass has determined and declared the aforesaid Contractor to be the lowest and best bidder for the said work, and has duly awarded to the said Contractor a contract therefor, for the sum and sums named in the . Contractor' s proposal, a copy thereof being attached to and made a part of this Contract. NOW, THEREFORE, in consideration of the sums to be paid to the con- tractor and of the mutual agreements therein contained, the Contractor and the City have agreed and hereby agree, the Contractor for itself, himself or themselves, or its, his or their successors and assigns, or its, his or their executors and administrators, and the City for itself and its successors, as follows: w . a TO PROVIDE for the LUMP SUM of $12 ,800. 00, those services as required for the successful completion of the DEMOLITION AND REMOVAL OF EXIST- ING BUILDINGS LOCATED AT 401 MONROE STREET, EXCLUDING THE ORIGINAL STONE JAIL, Jefferson City, Missouri. The Contractor agrees to commence work within ten (10) days follow- ing the date of a written order from the City to the Contractor to proceed with the work to be performed under the provisions of this contract, or on a subsequent date designated and authorized by the City in said order, and the Contractor agrees to complete said work within the required thirty (30) days. It is hereby mutually agreed that when this change order has been signed by the contracting parties, the following described changes in the work required by the contract shall be executed by the contractor without changing the terms of the contract except as herein stipulated and agreed. According to the contract this service was to be relocated on a pole at the southeast corner of East McCarty Street and Monroe Street. Problems with the traffic signals in the Central Business District prompted the Street Department to change the service and increase its amperage before the contract was executed. The City through the Department of Planning and Code Enforce- ment and the Contractor have agreed to a deduction in the original contract in accordance to the change order to which this is attached.
