AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI VACATING AND DIS-
CONTINUING AS PUBLIC RIGHT-OF-WAY A PART OF MILLER STREET AND
HARRISON STREET RIGHT-OF-WAY AND ALSO BEING ADJACENT TO THE
NORTHERLY LINE OF INLOT NO. 664 RESERVING TO THE CITY AN EASEMENT
IN THE RIGHT-OF-WAY VACATED FOR SANITARY SEWER, SURFACE WATER
DRAINAGE AND PUBLIC UTILITY PURPOSES AND AUTHORIZING AND DIRECT-
ING THE MAYOR AND CLERK OF THE CITY TO EXECUTE ALL INSTRUMENTS
REQUIRED TO CONFIRM IN THE ABUTTING PROPERTY OWNERS AND RIGHT OF
REVERSION IN THE VACATED AREA.
WHEREAS, it has been shown to the City Council of the City
of Jefferson, Missouri , that owners of land adjacent to and abut-
ting upon a portion of Miller Street and Harrison Street have
petitioned the City Council to vacate a part of the right-of-way
of Miller Street and Harrison Street as a public thoroughfare and
WHEREAS, it has further been shown that it would not incon-
venience the public or the citizens of the City to discontinue as
a right-of-way for a public thoroughfare and vacate a part of
Miller Street and Harrison Street as described in Section 1 of
this ordinance, subject to a reservation in the City of an ease-
ment in that portion of Miller Street and Harrison Street vacated
for the maintenance , repair, location and relocation of all
sanitary sewer, surface water sewer, or public utility facilities
now existing or hereafter to be constructed within said right-of-
way, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF JEFFERSON, MISSOURI , AS FOLLOWS :
Section 1. The City Council of the City of Jefferson,
Missouri , hereby declares it necessary, reasonable and proper to
discontinue as a right-of-way for a public thoroughfare and for-
ever vacated the following described portion of Miller Street and
Harrison Street in the said City , subject to the reservation in
the City of the easement mentioned in Section 2 of this ordinance.
A tract of land being a part of Miller Street and Harrison
Street right-ofnway and also being adjacent to the north-
erly line of Inlot No . 664, in the City of Jefferson,
County of Cole, Missouri , being more particularly described
as follows :
Beginning at a point on the southwesterly right-of-way
line of Routes 50 & 63, said point also being the
northeast corner of Inlot No . 659 ; thence in an east-
erly direction along said right-of-way way line to a point
opposite Routes , 50 $ 63 centerline Station 14+70 ; said
point being 56. 00 feet South of and at right angles to
Routes :.50 & 63 centerline; thence in a southeasterly
direction parallel to the centerline of Routes 50 $
63, a distance of 31 , 87 feet, said point being 56 .00
i� feet South of and at right angles to Routes 50 & 63
!� centerline Station 15+01. 87; thence in a southeasterly
i direction along a curve to the right, said curve having
a radius of 55 .00 feet, to a point intersecting the
southerly right-of-way line of Miller Street; thence
in a northwesterly direction along the southerly right-
of-way line of Miller Street and the extension of that
line to the point of beginning.
Section 2. The City of Jefferson, Missouri , does hereby
xpressly reserve to itself, its successors and licensees , and
11 public utility companies within the City, an easement in,
under, over and upon that portion of the right-of-way of Miller
Street and Harrison Street, as described in Section 1 of this
rdinance, for purposes of repairing, maintaining , servicing ,
ocating and relocating all sanitary sewer, surface water drain-
ge and public utility facilities now existing or hereafter to be
onstructed within said area.
Section 3. The statutory right of reversion in the owners of
he abutting property is hereby confirmed, subject to the easement
xpressly reserved in Section 2 of this ordinance, as is provided
y the laws of the State of Missouri, and the Mayor and the Clerk
f the City are hereby authorized and directed to execute all
'nstruments required to confirm the reversionary rights of the
wners of property abutting on the area vacated, as described in
ection 1 of this ordinance , in the right-of-way vacated.
Section 4. This ordinance shall take effect and be in force
rom and after its passage and approval.
