ROLL CALL: Present: Commissioners Kachel, Renzi, O’Rourke , Sanders , Peck ; ex officio Commissioner Fremarek; Chairman Sobkoviak ; and a representative from the Plainfield Fire Protection District. Absent: Commissioner Bonuchi, Park District; School District ; Library District; and Police Department Also Present: Michael Garrigan – Village Planner Village of Plainfield, Sara Javoronok – Plann er I Village of Plainfield, and Carol Millan – Secretary Village of Plainfield MINUTES: The minutes from the November 18, 2008 Zoning Board of Appeals Meeting w ere accepted as presented. NEW BUSINESS CASE: 1434 -103008.V 12813 GRANDE POPLAR CIRCLE Request: Building Setback Line Variance (Public Hearing) Location: 12813 Grande Poplar Circle Applicant: Gerald & Marianne Foresman TIME:7:06 p.m. Planner Javoronok summarized the staff report. She stated the applicant is requesting a variance to construct a three -seasons room, 14.8’ x 14.2 , to encroach upon the rear setback. The encroachment would be approximately 5 .48’ into the required 30’ setback. Th e house is located in Grande Park Neighborhood 9. Planner Javoronok summarized the findings of fact and stated that 3 of the 4 findings are favorable and 1 finding, finding. (c ) is neutral. Staff recommends approval of the requested variance into the rea r setback. Village of Plainfield Zoning Board of Appeals Minutes December 2, 2008 Page 2 of 3 Chairman Sobkoviak swore in the petition, Gerald Foresman, the homeowner. He asked for the variance due to his large family. The three seasons room would be an enjoyment area for his family. Chairman Sobkoviak stated the Commission is re quired by law to apply four challenges as read by staff . These are the only things that can be used to judge the appropriateness of the variance that is requested. He added that this is a second request this year for a variance for a three -seasons room . H e felt there would probably be more in the future. They are a nice amenity to be added to a house. He further stated the applicant is requesting a small variance. It doesn’t appear that this would significantly impact the site lines of adjacent homes. The nearest adjacent property is 120’, which kind of removes the possibility of encroaching on safety issues with respect to fire jumping from one property to another. Commissioner Renzi felt there are 2 favorable findings and 2 n eutral findings. He c oncurred with Chairman Sobkoviak that this is a reasonable request. Commissioner Fremarek seconded the comments of Commission er Renzi and felt that Finding (b) is more neutr al than favorable. He felt the variance was reasonable. He would look at the fin dings as 2 favorable and 2 neutral also . Commissioner O’Rourke asked if there was a neighbor to the south. Petitioner Foresman stated there was. Petitioner Foresman st ated he took the plans for the three - seasons room to everyone concerned. No one had any problems. Chairman Sobkoviak asked if the neighbors had been notified by certified mail. Petitioner Foresman stated they had been notified by certified mail. Commissioner O’Rourke was concerned that the neighbor to the south’s view might be obstruct ed. Petitioner Foresman stated he and his neighbor both checked out that his neighbor could still have a view of the park. Petitioner Foresman stated the three -seasons room is all glass windows. Commissioner Kachel stated he has a concern wh en there are commercially -built rather than stick -built three -seasons rooms, but he felt staff will be looking at that carefully. Overall, he did not have a problem with the variance. Chairman Sobkoviak asked if there was anyone in the audience who cared to ask a qu estion or make a comment regarding this case. There was no response. At 7:20 p.m. Commissioner O’Rourke made a motion that the Zoning Board of Appeals recommend approval of the requested variance to permit an encroachment of approximately 5.48 feet into the rear setback requirement for a three -season room for the property located at 12813 S. Grande Poplar Circle, subject to the following stipulations: 1. Compliance with the requirements of the Village Engineer, 2. Compliance with the requirements of the O swego Fire Protection District. Commissioner Kachel seconded the motion. Chairman Sobkoviak called for a vote by roll call. Aye: Renzi, O’Rourke, Sanders, Peck, Kachel, Chairman Sobkoviak Nay: 0 Village of Plainfield Zoning Board of Appeals Minutes December 2, 2008 Page 3 of 3 The motion is carried 6:0 Commissioner Sanders asked the petitioner if insulation is offered or electrical for baseboard heat on the bottom of these three -season rooms. Petitioner Foresman stated they only requested that it be a three -seasons room. It could be converted into a four -seasons room by cutting out a hole in the wall for the air c onditioner or by running heat along the floor. It is being built by Better Living. They were recommended.
