ROLL CALL: Present: Commissioners Kachel, Renzi, Bonuchi , Sanders , Peck ; ex officio Commissioner Fremarek; Chairman Sobkoviak ; and a representative from the Plainfield Fire Protection District. Absent: Commissioner O’Rourke ; Park District; School District ; Library District; and Police Department Also Present: Michael Garrigan – Village Planner Village of Plainfield, Mike Schwarz - Planner I I Village of Plainfield, Sara Javoronok – Plann er I Village of Plainfield, Carol Millan – Secretary Village of Plainfield , and Neal Eickholtz – Baxter and Woodm an MINUTES: The minutes from the August 5, 2008 Zoning Board of Appeals Meeting were accepted as presented. NEW BUSINESS CASE: 1431 -101308.V.FP LOTS 97 & 98 KINGS BRIDGE ESTATES Request: Variance (Public Hearing) Final Plat Locatio n: 127 th Street, we st of Route 30 Applicant: Madonna Development TIME: 7:05 p.m. Village Planner Garrigan summarized the staff report. He stated this is a public hearing and all notices have been published and posted per State Statute and Village Ordina nce. The applicant wishes to consolidate Lots 97 and 98 in the Kings Bridge Estates in order to construct a 12,679 square foot single -family home. The applicant is requesting one variance to allow them to encroach into the rear setback 5.67’, and a var iance to allow them to have about 43.6% of the site as impervious. The ordinance calls for 40%. They are also seeking Final Plat of Consolidation for Lots 97 Village of Plainfield Zoning Board of Appeals Minutes November 18, 2008 Page 2 of 3 and 98 . Village Planner Garrigan summarized the 4 findings of fact for a variance and stated 3 of the 4 are favorable, with finding “c” being neutral. The applicant has incorporated architectural elements which are sensitive to the existing single -family homes. Staff makes a favorable recommendation with respect to the findings of fact required for a variance and for the Plat of Consolidation or Final Plat with two stipulations. Village Planner Garrigan concluded his report. Chairman Sobkoviak asked what was to the rear of the property. Village Planner Garrigan deferred that question to the a pplicant. Chairman Sobkoviak asked Village Engineer Eickholtz if there were any problems with the 3.5% reduction in the impervious area. Village Engineer Eickholtz stated there should be no concerns related to that. Everything should be fine. Chairma n Sobkoviak swore in the petitioner, Guy O’Donnell. He gave a detail of the lay of the lot. He stated both lots are like an island. As far as the impervious area, it would not affect any other lots in the subdivision. The whole front area of the lot is the street and the three sides are either open area or retention area. He showed the elevations. He stated the architecture exceeds what is already in the subdivision. He gave the details of the architecture. The lots are adjacent to the center focal point of the subdivision, which is the clock tower. Chairman Sobkoviak asked if it was a key lot. Village Planner Garrigan stated it was. Chairman Sobkoviak stated there will be certain requirements for landscaping, etc. Village Planner Garrigan stat ed that was the case. Chairman Sobkoviak reminded the Commissioners that they should look at the amount of relief that is requested before making a decision. There was a discussion between Commissioner Renzi and Village Planner Garrigan about finding (b) being a favorable finding. Commissioner Renzi felt it could be a self -imposed circumstance. Village Planner Garrigan stated it could be a borderline finding. At first he considered a redesign of the retention pond instead of the applicant asking for th e variance, but then decided against that and suggested that the applicant request the variance. He stated it was a close call. Commissioner Renzi asked the base size of the other homes in the subdivision. Petitioner O’Donnell stated they build 3,000 to 4,000 sq. ft homes . Commissioner Renzi thought if he was pulling into the subdivision, he would probably think it was a clubhouse. Village Planner Garrigan stated that was why the architectural features were highlighted because if the architecture was not handled properly, a house like this could very easily overwhelm the neighborhood and then staff would have some concerns. The same architect did this home and many of the homes in the development , and tried to be very sensitive to the design and the massing of this structure so that it could blend in with the current single -family neighborhood. Commissioner Kachel asked if it was a two -family home. Petitioner O’Donnell stated it is a 4 bedroom home . Commissioner Kachel also expressed concerns since it has an indoor pool that there is proper HVAC, etc. Petitioner O’Donnell stated it will have a desert air system in it. Commissioner Kachel was satisfied. Village Planner Garrigan stated these are neo -traditional homes, which are rear -loaded. Chairman Sobkoviak pointed out there is an alley behind these neo -traditional homes. At 7:30 p.m. Commissioner Kachel made a motion that the Zoning Board of Appeals recommend approval of the two requested variances for Lots 97 and 98 in the Kings Bridge Estate development. Commissioner Bonuchi seconded the motion. Chairman Sobkoviak called for a vote by roll call. Aye: Renzi, Bonuchi, Sanders, Peck, Kachel, Chairm an Sobkoviak Nay: 0 The motion is carried 6:0 At 7:31 p.m. Commissioner Sanders made a motion that the Plan Commission recommend approval of the Final Plat or Plat of Consolidation for Lots 97 and 98 in the Kings Bridge Estate development subject to the following stipulations: 1. Compliance with the requirements of the Village Engineer, 2. Compliance with the requirements of the Plainfield Fire Protection District. Commissioner Kachel seconded the motion. Chairman Sobkoviak called for a vote by roll cal l.
