INTRODUCED BY COUNCILMAN i6ed N 7' ORDINANCE NO. 9,-.f AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , SETTING FORTH THE PROVISIONS RELATING TO CONDUCT, SAFETY, VACATION LEAVE, SICK LEAVE, EMERGENCY LEAVE, HOLIDAY LEAVE, ACCUMULATED LEAVE, AND RETIREMENT OF ALL CITY EMPLOYEES, AND FURTHER PROVIDING FOR RECORD KEEPING, AND THE ADOPTION OF RULES AND REGULATIONS BY DEPARTMENT HEADS, AND REPEALING ORDINANCE NO. 8914 AND ANY OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, the City Council of the City of Jefferson believes the public impression of City Government depends, to a large extent on the conduct of City Employees, and WHEREAS, the City Council of the City of Jefferson has determined that provisions relating to vacation leave, sick leave, emergency leave, holiday leave, accumulated leave and retirement , should be uniform for all City Employees, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS : Section 1. Conduct. (a) All City Employees shall perform their duties in an leffective, efficient and courteous manner, so as to create-. a favorable impression of City Government. (b) Each City Employee shall strictly observe working hours and promptly contact the Head of his Department in the event of circumstances which necessitate any variation from assigned hours. AME - - (c) - see below Section 2. Safe. (a) All City Employees engaged in occupations which may give rise to hazardous conditions shall strictly observe all ( safety regulations. (b) Department Heads may prescribe rules and regulation linvolving hazardous work, and are charged with personal responsi- � bility to see that employees in their respective Departments follow necessary safety regulations and other measures prescribed for the protection of the employee and the public. Section 3. Vacation Leave. City Employees shall be granted vacation leave based on continuous service, as hereinafter defined as follows: Section 1 (c) . Any City Employee who, in the course of his employment, is required to operate city vehicles and/or equipment, whose driver's license is suspended or revoked by the Missouri Director of Revenue may be automatically terminated from employment by the City, (a) At the end of the probationary period of six (6) • months' service an employee shall be entitled to five (5) working ( days vacation, and similar vacation shall accrue at the rate of ten ( 10) working days per year for the first five ( 5) years of employment. (b) In addition to the ten ( 10) days prescribed in the preceding paragraph, the employee shall be entitled to accrue one (1) additional day of vacation at the beginning of the sixth year, ( and one ( 1) additional day for each year thereafter until the vacation shall be fifteen 15 working days at the end of the tenth 1year. (c) After completion of fifteen (15) years service the employee shall be entitled to accrue twenty (20) working days vacation. (d) Vacation leave may not be accumulated in excess of thirty (30) days and Department Heads are urged to require the employees to take vacation leave as earned. (e) Employees of the Fire Department will be granted similar vacation leave, with the appropriate adjustment to be made by the Head of the Department so that vacation leave is uniform for all employees. (f) Vacation leave will normally be taken in one period, but variations and scheduling of vacations will be at the discretion of the Department Head, giving consideration, so far as Ali possible, to the employee' s desires. (g) The vacation time allotted under this Section shall be for continuous service for the City without interruption, except that the City Council may grant a leave of absence, for good cause, to any employee, for a period of not to exceed one (1) year, and resumption of duty after such leave will. be considered continuous service. The period of leave of absence, however, shall not be counted as working time for the benefits herein granted. Section d. Sick Leave. All City Employees shall be granted sick leave as follows: , ( a) Sick leave shall be accumulative by employees at the rate of one and one-half days per month and may be accumulated for a period not exceeding ninety (90) working days. In the event an illness shall extend beyond the period of accumulated sick -2- leave, a leave of absence may be granted by the City Council for n additional period. (b) Sick leave shall be granted to an employee when the latter is unable to perform his duties as a result of personal illness or injury. (c) The Head of the Department may grant hourly sick leave for necessary medical, dental or optical examination or treatment , for the time required for same. (d) An employee absent and requesting sick leave for four (4) consecutive working days or more may be required, as a condi�- tion to the granting of such leave, to furnish a physician' s certificate indicating that the illness was disabling, and the nature of same. (e) Sick leave shall represent working days and shall not be reduced by authorized holidays or weekends, or days off for those on forty-hour week. (f) The Chief of Fire Department shall, by regulation, adjust sick leave granted to Firemen, so that all employees receiv sick leave on an equal basis. Section 5. Emergency Leave. All City Employees shall be granted emergency leave as follows: i (a) In the event of death, serious injury, serious or contagious illness, in an employee's immediate family, the employee may be granted emergency leave by the Head of his Department, not to exceed a total of six (_6) working days in each year. (b) Such emergency leave, when granted by the Head of the Department, shall be leave with pay and in addition to the vacation and sick leave hereinabove granted. Not more than three (3) consecutive days shall be granted at any one time, within the limits of the six (6) days prescribed above for each year. (c) The immediate family of an employee is defined as wife, husband, child, or grandchild, brother, sister, parents, or grandparents. Heads of the Department are authorized to grant leave for the funeral of other relatives or close friends of the employees for one-half ( ) day or longer, if deemed necessary by such Department Head. -3- Section Q. Holiday Leave. (a) All City Employees shall be granted Holiday Leave on the following days: New Year' s Day Truman' s Birthday Memorial Day Independence Day Labor Day Veteran' s Day Thanksgiving Day Christmas Day. (b) If one of the above Holidays falls on Saturday, the receding Friday shall be the day of leave. If such Holiday falls on Sunday, Monday shall be the day of leave. (c) Each employee shall be granted Holiday leave on his irthday to be taken as time off from work within two (2) weeks on Dither side of his birthday. Holiday Pay is not allowed as a ® substitute for this day off. Section 7. ' 'Accumul'ated `leave., (a). Any City Employee retiring ht reagpn of age or disability, or voluntary resignation, shall be. eriti.tled to payment or his accumulated vacation leave, at the same rate a5 hf:s Xinal alary. (b). Any- City Employee whose services are terminated by 'he City, for willful neglect of dupy,, the commission of a felony, r for other reasons providing substantial grounds for discharge, hall not be entitled to payment of Vacation Leave as- herein pro= ided. In the event such- 'discharge shall result in damage .to City am property, through negligence or willful act of employee, appropriate eduction may be ,-made in payment of his- final check, Section 8. Uriautli'ori�eid 'Absence. Absence from.work. without easonable notice to the Supervisor shall be' considered Just cause or discharge. In the event the absence is caused by injury or ther emergency, without opportunity for notification, the' Depart, ent Head shall exercise his discretion in determining allowable eave. Section 9. 'Reti'rement. All City Employees shall retire as ollows, except as otherwise provided for by Ordinance; (a) Retirement age shall be sixty-five- 0651. years-, but in employee's service may be extended on a year,toSyear basis At he request of the Department Head involved, with the concurrence of the Mayor and City Council. -4- (b) The employment of Department Heads may be extended by the Mayor and City Council. (c) Employees or Officials appointed for a specific term shall serve such term. (d) If an employee be permanently and totally disabled, as reflected by a physician's report , retirement shall be granted with such disability pay as may be afforded by any laws then in effect. Section 10. Records. Each Department Head shall keep an accurate record of all leave provided herein in the permanent records of his Department. Section 11. Rules and Regulations. Each Department Head may formulate further Rules and Regulations consistent herewith, relating to conduct and appearance of employees, the care of vehicles and equipment, and with respect to such other guidelines ias he may consider proper. Copies of such rules and regulations shall be submitted to the City Clerk at the time of issuance and a copy of such rules shall be kept prominently posted in the Depart- ment adopting the same.
