HomeMy Public PortalAboutORD09371 t 0 BILL NO ` INTRODUCED BY COUNCIT MAN ORDINANCE NO. � AN ORDINANCE OF THE CITY OF JEFFERSON MISSOURI, AUTHORIZING AND DIRECTING THE MAYOR AND CLERK, ON BEULF OF SAID CITY, TO EXECUTE AN AGREEMENT BETWEEN THE OFFICE OF ADMINISTRATION, STATE OF MISSOURI, AND CITY OF JEFFERSON, FOR THE FURNISHING OF CERTAIN SERVICES FOR A FIXED PRICE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk of the City of Jefferson are hereby authorized amd directed, for and in the name of the City, to execute an Agreement between the Office of Administration of the State of Missouri, and the City of Jefferson, for the furnishing of certain services by the City for certain remuneration. Section 2. A copy of said Agreement is hereto attached and by reference made a part hereof. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. WITNESSETH: WHEREAS, the seat of government is herein defined as all real property owned or leased by the State of Missouri within the City, including but not limited to, the Capitol Complex, which includes the State "Capitol, Jefferson Building, the Supreme Court Building, the Broadway Building, the Electronic Data Processing Building, the Health Labora- tory Building, the Highway Department Building, the Environmental Control Center (Chiller Plant) and the Governor's Mansion, including all state owned property adjacent thereto; and r WHEREAS, the Office of Administation has charge and control of the facilities at the seat of government; WHEREAS, the City has previously provided various public services for ?he State of Missouri herein by Agreement dated October 9, 1973 entitled "Maintenance Agreement"; WHEREAS, the Office of Administration and the City desire to adopt a new agreement relating to the services to be provided by the City and to the manner of payment for said services; NOW THEREFORE, it is mutually agreed by the Office of Administration and the City that the above referenced "Maintenance Agreement" is hereby rescinded and the following provisions adopted as the Agreement -of the parties in lieu thereof.. ARTICLE 1 - SERVICES i 1. The City shall perform street repairs, street sweeping, priority snow removal, cindering and stripping services for the streets adjacent to the Capitol Complex as well as for the parking lot located south of the State Capitol South Steps and for the Circular Drive of the State Capitol. The City shall not be required to provide these services for the accesses to the Circular Parking Garage located at the State Capitol. 2. The City shall provide priority snow removal r. for property owned or leased by the State at the City Airport. 3. The City shall provide traffic and crowd control services for parades, inaugurals, and other public gatherings at the seat of government, and the City shall respond to requests by the State for security services. 4. The City shall furnish fire protection and rescue services at the seat of government as well as for the State prison farms located outside the CityJ eA /4'. 5. City shall provide health, fire safety and code enforce- ment assistance as requested by the State for property owned or leased by the State at the seat of government. ?; 6. The City shall furnish the assistance of its fire department as requested by the State in case of traffic accidents within an approximate 20-mile radius of the State Capitol. 7. The City shall endeavor to perform the above referenced services on a top priority basis. ARTICLE II - COMPENSATION The Office of Administration, in consideration of the furnishing by the City of the services described in Article I, shall pay to the City a lump sum of Eleven Thousand Dollars ($119000.00) on or before the 15th of February, 1980. - 2 - F. d ARTICLE III - EXTENT OF AGREEMENT 1. This Agreement shall commence on the 1st of January, 1980 and shall continue for a six-month period ending June 30, 1980. This Agreement may be renewed for a one-year period commencing July 1, 1980 and ending June 30, 1981 for the sum of Twenty-Five Thousand Dollars ($25,000.00). Thereafter, this Agreement may be renewed by written Amendment on such terms and conditions as are agreed upon between the parties; provided, however, that this Agreement shall terminate in the event the parties fail to agree upon renegotiated terms prior to September 30th r of the year preceding the renewal term. 2. This Agreement may be terminated upon the giving of ninety (90) days written notice by either party. In the event of termination, the prorata share of compensation paid under this Agreement which represents payment for the remaining period of service shall be returned to the Office of Administration upon termination by either party. It is agreed and understood that the provisions of this Agreement shall be subject to the general appropriation by the Missouri Legisla- ture for the payment of the compensation stated herein.
