AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY TO ENTER INTO A WRITTEN JOINT FARE AGREEMENT BETWEEN THE CITY OF JEFFERSON, MISSOURI, AND COLUMBIA, MISSOURI. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: f SECTION 1. The Mayor and Clerk of the City are hereby authorized and directed, for and in the name of the City, to enter into a joint fare agreement between the City of Jefferson, Missouri, and Columbia, Missouri. Passed Approved ��y P sidenl of the Co it Ma ATTEST: City C1 r •F Y 7 e • JEFFERSON CITY - COLUMBIA C39� JOINT FARE AGREEMENT THIS AGREEMENT, made and entered into by and between the Cities f Jefferson City and Columbia, Missouri , municipal corporations , hereinafter "Jefferson City" and "Columbia") : WITNESSETH: WHEREAS , said cities are empowered by ordinance duly enacted by the respective City Council of each City to enter into this agreement . NOW, THEREFORE, in consideration of the mutual promises herein set forth, it is agreed between the parties as follows : 1 . Services and Purpose : The purpose of this agreement is to provide for the provision of transportation services between the respective communities on a schedule convenient to and designed for daily commuters . 1 A. Such services shall parallel those formerly provided by the Missouri Department of Transportation through those portions of the "MoGo" program serving the two communities . B. The timing and scheduling of trips , fare schedules and ransfer arrangements for commenter services shall initially be ose set forth on the attached Exhibit "A" . Such schedules and arrangements are subject to change by either City upon fourteen (14) days written notice, provided however, that no fare increase or de- crease shall exceed 33 1/3% of the scheduled rate in any six (6) month period. C. Transfers shall be honored by each City's transportation system (hereinafter "CATS" and "JEFTRAN") subject to available space. D. All transfers , fares , and scheduling shall be levied and governed by any applicable provision of state or federal law subject to exemptions applicable to municipal corporations . 2 . Equipment : Columbia shall provide those buses and drivers necessary to provide commuter service between the cities . Both cities agree to make available, through a system of transfers , the respective JEFTRAN and CATS transportation systems to commuters utilizing the service. A. Equipment utilized shall remain the sole property of the Albr-y providing said equipment, and title shall in no manner be impaired, .,ligated or colored by its use under this agreement . B. All maintenance, costs , fuel expenses , and employee costs of whatever kind associated with a particular vehicle or employee shall be the sole responsibility of the city holding title to said vehicle or employing said individual. 3. License: Jefferson City hereby grants permission to the City of Co um a to operate commuter buses under the provisions of this agreement upon the streets , highways and thoroughfares of Jefferson City as set forth in Exhibit 'A", in a like manner as if said buses were a part of JEFTRAN. i 4. Fares : All commuter fares shall be the sole property of Columbia a�sed upon and in consideration of Columbia' s provision of the equipment, employees , maintenance and expenses associated with commuter service. 5 . Promotion of the Service: Each city promises to promote the services Hereln detailed as a part of its promotion of its normal transportation system. 7. Cancellation: This agreement may be cancelled by either party upon thirty ) days written notice delivered to the City Clerk of the respective city. Liability and Indemnification : It is expressly stated by e cities that this agreement shall in no wise be considered a joint erprise or venture and that all liability of any type or kind arising om or out of the services herein detailed shall be and remain the sole responsibility of that city serving as the carrier at the date the liability or claim arises. Each city shall be and remain responsible for claims arising from the use and maintenance of its equipment , ridership on its respective transportation system, and the acts of its employees and agrees to hold the other party harmless and save it from loss from any claim, liability or damage arising from the use and maintenance of the equipment or acts of agents , employees or assignees of that city.
