N ORDINANCE OF THE CITY OF JEFFERSON , MISSOURI , REPEALING SECTION
5-23 OF THE CODE Or THE CITY OF JEFFERSON , 1978, AND ENACTING A
NEW SECTION 5-23, RELATING TO THE HOURS OF OPENING AND CLOSING OF
IQUOR LICENSED PREMISES, AND ENACTING A NEW SECTION, TO BE KNOWN
S SECTION 5-35, RELATING TO LIMITED PERMITS TO SELL NONINTOXICATING
[BEER.
E IT ORDAINED BY THE CITY COUNCIL OF TILE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS:
Section 1. Section 5-23 of the Code of the City of
Jefferson, 1978, is hereby repealed and a new Section 5-23 enacted
in lieu thereof, relating to the hours of opening and closing of
liquor licensed premises, which will read as follows :
Section 5-23. Time fixed for opening and closing
remises--closed place defined penalty-exceptions.
(A) No person having a license under this law, nor any
employee of such person , shall sell , give away or
otherwise dispose of , or suffer -the same to be done upon
or about his premises, any intoxicating liquor in any
quantity between the hours of 1 : 30 a.m. and 6: 00 a.m.
on weekdays and between the hours of 1 : 30 a.m. Sunday
and 6:00 a.m. Monday, or after 1: 30 a.m. upon the day
of any general or primary election in this state at
which candidates for public office are elected or
nominated. If the person has a license to sell intoxi-
cating liquor by the drink, his premises shall be and
remain a closed place as defined in this Section
after 1 : 30 a.m. upon the day of any general or primary
election in this state at which candidates for public
office are to be elected or nominated and between the
hours of 1 : 30 a.m. and 6: 00 a.m. on weekdays and between
the hours of 1 : 30 a.m. Sunday and 6 :00 a.m. Monday;
except that the sale of intoxicating liquor may be
resumed and the premises reopened on any general or
primary election day after the expiration of thirty
minutes next following the hour or time fixed by law
for the closing of the polls at any such election.
Where such licenses authorizing the sale of intoxicating
liquor by the drink are held by clubs or hotels, this
Section shall apply only to the room or rooms in which
intoxicating liquor is dispensed; and where such
licenses are held by restaurants whose business is
conducted in one room only and substantial quantities
of food and merchandise other than intoxicating
liquors are dispensed, then the licensee shall keep
securely locked during the hours and on the days
specified in this Section all refrigerators, cabinets,
cases, boxes and taps from which intoxicating liquor
is dispensed. A "closed place" is defined to mean a
place where all doors are locked and where no patrons
are in the place or about the premises. Nothing in this
Section shall be construed to prohibit the sale or
delivery of any intoxicating liquor during any of the
hours or on any of the days specified in this Section by
a wholesaler licensed under the provisions of Section
311. 180 RSMo to a person licensed to sell the
intoxicating liquor at retail.

II When December thirty-first falls on Sunday, any I

person having a license to sell intoxicating liquor
by the drink may be open for business and sell
intoxicating liquor by the drink under the provisions
of his license on that day after 1 :00 p.m. and until
the time which would be lawful on another day of
the week, notwithstanding any provisions of this
Ordinance or any other provision of law to the contrary.
Section 2. Section 5 of the Code of the City of Jefferson
is further amended by adding a new Section which shall be known as
Section 5-35, and which will read as follows:
Section 5-35. Limited permit to sell nonintoxicating beer,
who may obtain--time limited.
f Notwithstanding the other provisions of this chapter,
a permit for the sale of nonintoxicating beer for
consumption on premises where sold may be issued to
I �+ any church, school, civic, service, fraternal, veteran,
political or charitable club or organization for, the
sale of nonintoxicating beer at a picnic, bazaar, fair,
similar gathering. Said permit shall be issued only
for the day or days named therein and it shall not
authorize the sale of nonintoxicating beer for more
than seven days by any said organization as described
above in any fiscal year. For each such permit issued,
the licensee shall pay to the License Inspector the
sum of ten dollars. No provision of law or rule or
regulation shall prevent any wholesaler or distributor
i from providing customary storage, cooling or dispensing
equipment for use by the holder of the license at
such picnic, bazaar, fair, or similar gathering.
` Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.
