AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AUTHORIZING
AND DIRECTING THE MAYOR OF THE CITY AND THE CITY CLERK OF
SAID CITY TO EXECUTE, ON BEHALF OF THE CITY, AN AMENDMENT
TO A LEASE ON CERTAIN PROPERTY AT THE JEFFERSON CITY MEMORIAL
AIRPORT LEASED TO RICHARD P. TREMAIN AND RUBY TREMAIN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
i MISSOURI AS FOLLOWS:
Section 1. A certain lease authorized by Ordinance No. 9178
passed by the City Council of the City of Jefferson on September 1, 1978,
is hereby amended and the Mayor and the City Clerk of Jefferson, Missouri,
are hereby authorized and directed for and in the name of the City, to
execute an amendment to a lease with Richard P. Tremain and Ruby Tremain,

relating to certain described property at the City of Jefferson Memorial
Airport dated the 1st day of September 19 78

AMENDMENT TO RESTAURANT LEASE
The restaurant lease entered into on September 1, 1978 between
Jefferson City, Missouri, a municipal corporation, and Richard P. Tremain
and Ruby Tremain is hereby amended as follows:
3 WHEREAS, the restaurant lease with Richard P. Tremain and Ruby
Tremain does not appear to contain the sufficient nondiscrimination provision
Part 21 of the Regulations of the Office of the Secretary of Transportation,
adopted pursuant to Title VI of the Civil Rights Act of 19164 requiring that
is each lease, agreement or other arrangement in which a right or privilege
is granted to any person, firm or corporation to offer any product or
service on an airport developed or improved with federal funds must include
°., an assurance that the tenant, contractor and or concessionaires will comply
with the nondiscrimination requirement of this part.
WHEREAS, a final rule implementing Section 30 of the Airport and
Airway Development Act of 1970, as amended, published in the Federal
Y P
Register (45 Fed. Reg. 10184) covering some of the civil rights responsibilities
of recipients of federal airport grants; requiring that a standard provision be
included in the existing agreements.
NOW THEREFORE,
1. Paragraph four (4), subparagraph (1) of said lease entered into
between the parties September 1, 1978, is amended to read:
"The lessee will not, on the grounds of race, color or
national origin, discriminate or permit discrimination

32., against any person or group of persons in any manner
n prohibited by Part 21 of the Regulations of the Office of
the Secretary of Transportation. The lessor reserves
the right to take such action as the United States Govern-
ment may direct to enforce this covenant. "
(1) "The lessee assures that it will undertake an affirma-
tive action program as required by 14 CFR Part 152,
Subpart E, to ensure that no person shall, on the
grounds of race, creed, color, national origin, or
sex, be excluded from participating in any employ-
`' ' meet activities covered in 14 CFR Part 152, Subpart E.
The lessee assures that no person shall be excluded
on these grounds from participating in, or receiving
nA `. the services or benefits of any program or activity
covered by this subpart. The lessee assures that it
will require that its covered suborganizations provide
assurances to the lessee that they similarly will
undertake affirmative action programs and that they
will require assurances from their suborganizations,
as required by 14 CPR Part 152, Subpart E, to the
same effect. "

2. It is agreed between the parties that all provisions of the lease
entered into between the parties on September 1, 1978, shall remain in
full force and effect with the exception of the changes hereinbefore set
forth.
IN WITNESS WHEREOF, the parties have hereunto set their hands
