This Interlocal Agreement is hereunto entered in this 26th day of
May , 2005, by and between the City of Richmond, Indiana (hereinafter
"City") and Wayne County, Indiana (hereinafter "County")
WITNES SETH:
WHEREAS, City owns real estate in areas subject to the jurisdiction of the
Wayne County Building Commission ("Commission"); and
WHEREAS, County owns real estate in areas subject to the jurisdiction of the
City of Richmond Department of Permits & Inspections ("Department"); and
WHEREAS, City and County each employ inspectors with knowledge of
applicable state and local building codes; and
WHEREAS, in the interests of efficiency and fiscal conservatism, City and
County desire to utilize their own respective building inspectors to inspect their own
buildings for applicable building code compliance.
NOW, THEREFORE, in consideration of the terms and conditions contained
herein, City and County do hereby agree as follows:
1. City shall permit County to utilize County building inspectors to inspect
County -owned buildings that would otherwise be under the jurisdiction of the
Department to ascertain compliance with applicable building codes.
2. County shall permit City to utilize City building inspectors to inspect City -
owned buildings that would otherwise be under the jurisdiction of the Commission to
ascertain compliance with applicable building codes.

3. City shall not compel County to comply with any applicable building
code, as interpreted by a City building inspector, if a County building inspector has
determined, in writing, that the County -owned building complies with such applicable
building code.
4. County shall not compel City to comply with any applicable building
code, as interpreted by a County building inspector, if a City building inspector has
determined in writing that the City -owned building complies with such applicable
building code.
5. County agrees to, and shall, indemnify and hold City, its directors, agents,
servants and employees, harmless from any and all liability, loss or damage County may
suffer as a result of claims, demands, costs or judgments against the City arising out of
the City not inspecting County -owned buildings pursuant to this Interlocal Agreement.
6. City agrees to, and shall, indemnify and hold County, its directors, agents,
servants and employees, harmless from any and all liability, loss or damage City may
suffer as a result of claims, demands, costs or judgments against County arising out of
County not inspecting City -owned buildings pursuant to this Interlocal Agreement.
IN WITNESS WHEREOF, City and County execute this Interlocal Agreement as
of the date first set forth above, although signatures may be affixed on different dates.
