ORDINANCE NO.�� AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT ' WITH THE COUNTY OF COLE FOR THE COUNTY, BY USE OF ELECTRONIC DATA PROCESSING EQUIPMENT, TO PREPARE AND COLLECT TAX BILLS FOR THE CITY FOR AN AGREED COMPENSATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS: Section 1. The Mayor and Clerk of the City are hereby authorized and directed, . for and in the name of the City, to execute and enter into an Agreement with the County of Cole for ,f said County, by use of electronic data processing equipment , to prepare and collect tax bills for the City for an agreed compensation. s ' Section 2. (-Rfesigent of the C ncil Mayor s,1 Attest : , Ci y erk 1 AGREEMENT THIS AGREEMENT, made and entered into this`day o , ® 1980, by and between the City of Jefferson, Missouri, a m icipal corporation, hereinafter called the "City" , and the County of Cole County, Missouri, hereinafter called the "County" , and Stanley C. Diemler, County Clerk, and William "Skip" Rich, County Collector. WITNESSETH: WHEREAS, The City and County are empowered, under Article VI , Section 16, of the Missouri Constitution and Section 70.220, RSMo, to enter into certain cooperative agreements; and , ! WHEREAS, it is deemed by the parties hereto to be mutually advanta- geous to all parties for the County, by use of electronic data r i processing equipment, to prepare and collect tax bills for the City for an agreed compensation; and WHEREAS, the Collector of Cole County, Missouri, has expressed a willingness to cooperate and provide the mechanics for the collection of City real and personal property taxes and merchants' and manufacturers' taxes as accrue in the County, NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, the parties agree as follows: I The County, by and through the County Clerk and the County Collector, hereby agrees to send out, on behalf of the City, tax bills relating to all real and personal property located within that portion of the City boundaries which lie within Cole County, Missouri , and all the merchants' and manufacturers' taxes on business located within that portion of the boundaries of the City which lie within Cole County, Missouri. II The County, by and through the County Collector, hereby agrees to collect, on behalf of the City, all monies due and owing the City for taxable property within that portion of the boundaries of the City which lie within Cole County, Missouri. ? ✓ Page 2 III ® City agrees to provide all assistance, documentation, and other information as may be needed by County and the County Collector to carry out the purposes of this contract. IV City will furnish to County its annual tax levy for the tax year no later than September 20, of each calendar year during which this agreement remains in force. V The County agrees that the City shall have access , at all reasonable times, and under the supervision of the County Collector, to all data accumulated under the data processing system, including but not limited to the following, which shall be provided annually or. r:. as otherwise requested in City in printed form: `r (A) Alphabetical Listing for All Real Estate, .±' Personal Property and Merchants' and ti Sr. Manufacturers' Tax Rolls (B) A Delinquent Listing File upon Request. The County agrees to remit to the City the receipts due the City at the same time the County deposits with the Treasurer its own receipts; provided that there shall be a remittance to the City at least once per month at which time the County shall provide a breakdown of taxes collected in a form to be agreed upon. . � VII The County agrees to notify City .of any tax sales involving property within the City. VIII The County agrees that the County shall have the responsibility for collection of all delinquent real property taxes for the last three (3) years, said responsibility to apply only to delinquencies which occurred beginning with taxes due for calendar year 1979 and that such collections, including necessary tax sales, shall be conducted in accordance with applicable law. Page 3 IX The City agrees that the County may withhold a sum equal to one percent (1%) of the taxes collected by the County on behalf of the City as compensation for the services herein provided by the County. Thus County will remit to City ninety-nine percent (99°x) of all taxes, collected on behalf of the City. Said money shall be remitted by the County to the City on the same basis and in the same manner as other tax monies are remitted by the County to the various taxing bodies within the County. .: X This contract may be modified by a written instrument executed by both parties. XI j,,;•; The parties hereto mutually agree that the term of this agreement is for one year, beginning March 1, 1980 and ending February 28, 1981, provided, however, that either party may terminate this agreement within one hundred twenty (120) days by serving upon all other parties to the agreement written notice of its intention to terminate this agreement. The parties hereto mutually agree that •3• this contract will be automatically renewed subject to modifications on March 1, 1981, and will continue to renew on March 1 of each subsequent year unless either party serves written notice of ® termination no less than one hundred twenty (120) days prior to the renewal date.
