AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD IN
THE CITY OF RICHLAND HILLS, TEXAS TO SUBMIT TO THE
VOTERS A PROPOSITION TO INCREASE THE SALES AND USE TAX
FOR THE BENEFIT OF THE TYPE B ECONOMIC DEVELOPMENT
CORPORATION FROM THE RATE OF ONE-EIGHTH PERCENT (1/8%)
TO THREE-EIGHTHS PERCENT (3/8%); AND A PROPOSITION TO
INCREASE THE LOCAL SALES AND USE TAX FROM THE RATE OF
ONE PERCENT (1%) TO ONE AND ONE QUARTER PERCENT (1 '/a%);
MAHING PROVISION FOR THE CONDUCT OF SUCH ELECTION;
RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH
ELECTION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by
the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local
Government Code; and
WHEREAS, on November 8, 2016 the citizens of Richland Hills voted to terminate
membership in the Fort Worth Transportation Authority (The "T"); and
WHEREAS, the one half cent sales tax collected for the benefit of The T within the
corporate limits of Richland Hills will terminate by operation of law prior to the May 6, 2017
unified election date; and
WHEREAS, the City Council of the City of Richland Hills hereby finds and determines
that an election should be held under the provisions of Chapter 321 of the Texas Election Code
to allocate the available one half percent sales and use tax within the City of Richland Hills to the
Type B Economic Development Corporation and the General Fund as set forth in the Caption;
and
WHEREAS, the City will hold the special election in conjunction with the May 6, 2017
general election; and
WHEREAS, in accordance with the requirements of Chapter 321, as amended, of the
Texas Tax Code, the combined tax rate of all local sales and use taxes imposed by the City and
other political subdivisions having territory in the City will not exceed two (2) percent; and
WHEREAS, the City Council hereby finds and determines that it is in the best interest of
the citizens of the City to hold this election on the date set forth below pursuant to a contract
with Tarrant County for joint election services.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Special Election Called
An election to be held on the 6`h day of May, 2017, a uniform election day, is hereby
called for the purpose of submitting the following propositions to the qualified voters of the City:
Proposition No. 1
^ FOR
^ AGAINST The adoption of a local sale and use tax in the City of Richland Hills at the
rate of one and one quarter percent (1 1/4%).
Proposition No. 2
^ FOR
^ AGAINST The adoption of a sales and use tax for the benefit of the Richland Hills
Type B Economic Development Corporation for projects previously
approved by the qualified voters of the City of Richland Hills and to
include public park purposes, community facilities, related maintenance
and cost of operation of publically owned projects, and the promotion of
new and expanded business enterprises at the rate of three-eighths percent
(3/8%).
Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to execute the contract (the "Contract") with
Tarrant County for joint election services. In the event of a conflict between this Ordinance and
the Contract, the Contract shall control.
Section 3. Polling Place.
The polling place for the Special Election shall be as follows:

Other polling places maybe established as provided in the Contract. The polls shall be
open from 7:00 a.m. to 7:00 p.m. on May 6, 2017, in accordance with and pursuant to the
requirements of the Texas Election Code.
The City shall constitute a single election precinct for said election.
Section 4. Ballots and Election Method.
Combined ballots may be utilized containing all of the offices and propositions to be
voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote
for any office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance shall be conducted exclusively on Tarrant County's eSlate electronic voting system.
On Election Day, voters shall have a choice between voting on the eSlate electronic voting
system or by a paper ballot that is scanned at the polling place using Tarrant County's eScan
voting system. All expenditures necessary for the conduct of the election, the purchase of
materials therefore, and the employment of all election officials are hereby authorized, and shall
be conducted in accordance with the Contract and the Code. The order in which the names of
the candidates are to be printed on the ballot shall be determined by a drawing by the City
Secretary pursuant to state law. Notice of the time and place for such drawing shall be given in
accordance with the Code.
Section 5. Early Voting.
a. Early voting by personal appearance. Stephen Vickers, Tarrant County Chief Deputy
Elections Administrator, is hereby appointed as the Early Voting Clerk for the election, as so
indicated in the Contract. Early voting by personal appearance shall commence April 24, 2017
and shall continue until May 2, 2017. The main early voting site shall be at the Richland Hills
Public Library, 6724 Rena Drive, Richland Hills, Texas. Specific days, times and locations shall
be designated by the Elections Administrator and included in the Contract and shall be in
compliance with state law. On at least two weekdays during the early voting period, the location
for early voting shall be open for at least twelve (12) hours as mandated by state law.
b. Early voting by mail. Applications for a ballot by mail maybe submitted throughout the
calendar year, beginning January 1 and must be received by Tarrant County Elections no later
than the close of business April 25, 2017. All voted ballots that are returned on or before
Election Day will be counted. Voted ballots mailed from outside the United States may be
counted if clearly postmarked on or before Election Day and received by the Elections
Administrator not later than the fifth day after Election Day. Completed applications may be
submitted by mail, contract or common carrier, fax or (Effective September 1, 2015, you may
submit by email a completed, signed with the voter's original signature and scanned application
to the Early Voting Clerk.):

c. Early voting ballot board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the
Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 6. Notice.
Notice of said election shall be given as required by the Texas Election Code.
Section 7. Election Officials.
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as permitted by law. The presiding judge shall appoint
elections clerks as maybe necessary for the proper conduct of the election. The election judge, or
the alternate election judge in the absence of the election judge, and the election clerks shall
constitute the early voting ballot board. The election judge, and alternate election judge, and
election clerks shall be qualified voters of the city.
Section 8. Governing Law.
The election shall be held in accordance with the Constitution of the State of Texas and
the Texas Election Code, and all resident qualified voters of the City shall be eligible to vote at
the election.
Section 9. Necessary Actions.
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, the City Charter, and the City Code in carrying out and conducting the election, whether
nor not expressly authorized by this Order.
Section 10. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 11. Notice and Publication
This Ordinance shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the Special
Election. A copy of the Ordinance shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 12. Effective Date.
This order shall be effective upon its adoption.

POR CUANTO, la Ciudad de Richland Hills es una cudad autonoma que actua bajo su
estatuto adoptado por el electorado conforme al Articulo XI, Seccion 5, de la Constitucion de Texas, y
al capitulo 9 del Codigo de Gobierno Local, y
POR CUANTO, el 8 de noviembre de 2016, los ciudadanos de Richland Hills votaron a
favor de dejar de participar en Fort Worth Transportation Authority ("The T"); y
POR CUANTO, el impuesto a las yentas de un medio por ciento recaudado pars el
beneficio de "The T" dentro del ambito corporativo de Richland Hills finalizara en virtud de la
ley antes de la fecha de eleccion unificada del 6 de mayo de 2017; y
POR CUANTO, el Concejo Municipal de la Ciudad de Richland Hills, por la presente,
considera y determina que debe llevarse a cabo una eleccion, de conformidad con las
disposiciones previstas en el capitulo 321 del Codigo Electoral de Texas, para asignar el
impuesto sobre las yentas y el use de un medio por ciento disponible dentro de la Ciudad de
Richland Hills a la corporacion de desarrollo economico de tipo B y al fondo general, conforme
a to dipuesto en el subtitulo; y
POR CUANTO, la Ciudad llevara a cabo la Eleccion Especial junto con la eleccion
general del 6 de mayo de 2017; y
POR CUANTO, de conformidad con los requerimientos del capitulo 321, y sus
enmiendas, del Codigo Tributario de Texas, la tasa impositiva combinada correspondiente a
todas las yentas y usos locales impuesta por la Ciudad y demas subdivisiones politicas ubicadas
en la Ciudad no superara el dos (2) por ciento; y
POR CUANTO, el Concejo Municipal, por la presente, considera y determina que llevar
a cabo esta eleccion en la fecha propuesta abajo, conforme a un contrato con el Condado de
Tarrant de servicios de eleccion conjunta, es en beneficio de los ciudadanos de la Ciudad.
POR TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE RICHLAND
HILLS, TEXAS, ORDENA:
Seccion 1. Convocatoria para Eleccion Especial
Por la presente, se convoca a una eleccion a realizarse el 6 de mayo de 2017, una fecha de
eleccion unificada, para someter a los electores calificados de la Ciudad las siguientes
propuestas:

^ EN CONTRA DE La adopcion de un impuesto sobre las yentas y el use en beneficio de
la corporation de desarrollo economico de tipo B de Richland Hills
para los proyectos previamente aprobados por los electores calificados
de la Ciudad de Richland Hills y para incluir proyectos de parques
publicos, instalaciones para la comunidad, el mantenimiento
relacionado y costo de operation de proyectos de dominio publico, y la
promotion de emprendimientos nuevos y de expansion a una tasa de
tres octavos por ciento (3/8 %).
Seccion 2. Contrato de administration de eleccion conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a celebrar el Contrato (el
"Contrato") con el Condado de Tarrant para los servicios de eleccion conjunta. En caso de
conflicto entre la presente Ordenanza y el Contrato, este ultimo prevalecera.
Seccion 3. Centro electoral.
El Centro electoral para la Eleccion Especial sera el siguiente:

elecciones se llevaran a Cabo desde las 7:00 a.m. hasta las 7:00 p.m., el 6 de mayo de 2017, de
conformidad con los requisitos establecidos en el Codigo Electoral de Texas.
La Ciudad constituira un solo distrito electoral para dicha eleccion.
Seccion 4. Boletas y metodo de eleccion.
Se pueden utilizar Boletas combinadas que contengan todos los cargos y propuestas que
se votaran en cads centro electoral, siempre que ningun elector reciba Boletas o el permiso de
votacion de un cargo o propuesta para los cuales no sea elegible para votar. La votacion
anticipada en persona se realizara exclusivamente a traves del sistema de votacion electronics
eSlate del Condado de Tarrant. El dia de la eleccion, los electores podran votar a traves del
sistema de votacion electronics eSlate o con una boleta electoral que se escanea en el centro
electoral a traves del sistema de votacion eScan del Condado de Tarrant. Por la presente, se
autorizan todos los gastos necesarios para la realization de la eleccion, la compra de los
materiales a tal efecto y la contratacion de todos los funcionarios electorales; dichos gastos se
realizaran conforme al Contrato y al Codigo. El Orden en que se imprimiran los nombres de los
candidatos en la boleta se determinara a traves de un sorteo que realizara la Secretaria de la
Ciudad conforme a la legislation del estado. El horario y la fecha del sorteo se notificaran de
acuerdo con to dispuesto en el Codigo.
Seccion 5. Votacion anticipada.
a. Votacion anticipada en persona. Por la presente, se designs a Stephen Vickers, Jefe
Adjunto del Administrador Electoral del Condado de Tarrant, Secretario de Votacion Anticipada
para la eleccion, segun to indicado en el Contrato. La votacion anticipada en persona comenzara
el 24 de abril de 2017 y finalizara el 2 de mayo de 2017. El principal centro electoral de
votacion anticipada estara en Richland Hills Public Library, 6724 Rena Drive, Richland Hills,
Texas. El Administrador Electoral determinara las ubicaciones, los dias y los horarios
especificos, que se incluiran en el Contrato y que cumpliran con to dispuesto en la legislation del
estado. Mientras dure el periodo de votacion anticipada, el centro electoral de votacion
anticipada estara abierto, como minimo, dote (12) horas durante al menos dos dias de la semana,

c. Junta para la Votacion Anticipada. Por medio de la presente, se crea una Junta para la

para la Votacion Anticipada a fin de que procese los resultados de la votacion anticipada de la
eleccion.
Seccion 6. Aviso.
El aviso de dicha eleccion se realizara Begun to dispuesto por el Codigo Electoral de
Texas.
Seccion 7. Funcionarios electorales.
El Administrador Electoral del Condado de Tarrant designara al juez electoral, al juez
electoral suplente y a la junta para la votacion, segun to permitido por la ley. El juez responsable
nombrara a los secretarios electorales, Begun sea necesario, para el correcto desarrollo de la
eleccion. El juez electoral o, en su ausencia, el juez electoral suplente y los secretarios electorales
constituiran la Junta para la Votacion Anticipada. El juez electoral, el juez electoral suplente y
los secretarios electorales seran electores calificados de la ciudad.
Seccion 8. Legislacion aplicable.
La eleccion se realizara en conformidad con la Constitucion del Estado de Texas y el
Codigo Electoral de Texas, y todos los residentes de la ciudad que Sean electores calificados
seran elegibles para votar en la eleccion.
Seccion 9. Medidas necesarias.
Se autoriza y ordena al Alcalde y a la Secretaria de la Ciudad, en consulta con la
Procuradora de la Ciudad, a tomar todas las medidas necesarias para cumplir con las
disposiciones del Codigo Electoral de Texas, la Carta Organica Municipal y el Codigo Municipal
para llevar a Cabo la eleccion, independientemente de que esten o no expresamente autorizados
por esta Orden.
Seccion 10. Clausula de divisibilidad.
Por la presente, se declara que el Concejo Municipal tiene la intencion de que las
secciones, los parrafos, las oraciones, las clausulas y las frases de esta Orden Sean divisibles, y
que si alguna sentencia o decreto validos de un tribunal con jurisdiccion competente declarara la
nulidad o inconstitucionalidad de alguna frase, clausula, oration, parrafo o section, dicha nulidad
o inconstitucionalidad no afectaran a ninguna de las frases, clausulas, oraciones, parrafos y
secciones restantes de esta Orden, dado que estos hubieran sido promulgados por el Concejo
Municipal sin la incorporation en esta Orden de ninguna de dichas frases, clausulas, oraciones,
parrafos o secciones nubs o inconstitucionales.
Section 11. Aviso y publication.
Esta Ordenanza constituira la Orden de Election (segun to dispuesto por la Section 3.001
del Codigo) y el Aviso de Election (segun to dispuesto por la Section 4.001 del Codigo) para la
Election Especial. Al menos veintiun (21) dias antes de la election, se publicara una copia de la
Ordenanza en la tabla de anuncios que se utiliza para la publication de los avisos de las
reuniones del Concejo Municipal. El aviso se publicara en el periodico, de acuerdo con to
dispuesto por la legislation del estado.
Section 12. Fecha de entrada en vigencia.
Esta Orden entrara en vigencia a partir del momento de su adoption.
