AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK OF THE CITY TO EXECUTE A
WRITTEN CONTRACT WITH FRANK F. SCHEPKER, ROBERT F. SCHEPKER, JOHN
B. SCHEPKER, AND ALICE A. WEKENBORG FOR RIGHT-OF-WAY FOR CONSTRUC
TION OF THE EXTENSION OF STADIUM BOULEVARD CENTRAL.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS:
SECTION 1 . The mayor and Clerk of the City are hereby
authorized and directed, for and in the name of the City, to
execute a written contract with Frank F. Schepker, Robert F.
Schepker, John B. Schepker and Alice A, Wekenborg for right-of-way
® for construction of the Extension of Stadium Boulevard Central .
SECTION 2 . Said Contract shall read in words and figures as
follows :

SECTION 3. This ordinance shall take effect and be in force
from and after its passage and approval .

CONTRACT
THIS CONTRACT, made and entered into this day of
1980 , by and between George Hartsfield, Preside t
of th City Council of the City of Jefferson, Missouri, a municipal
corporation of the third class of the State of Missouri , Party of
the First Part, and who acts for and on behalf of the City of
Jefferson, and Frank F. Schepker, Robert F. Schepker, John B.
Schepker, and Alice A. Wekenborg, Party of the Second Part,
WITNESSETH:
That for and in consideration of mutual promises and cove- 1
nants herein contained, the Party of the Second Part does agree to
prepare and execute a Warranty Deed for certain portions of the.
Northwest Quarter of Section 14, Township 44N, Range 12W, a des-
cription of which is attached hereto, to be used as street right-

of-way and the necessary surface water drainage easements for the
construction of the extension of Stadium Boulevard Central for the
sum of Eleven Thousand Six Hundred Dollars ($11 ,600. 00) .
In connection with and as part of the consideration the
Party of the First Part does agree as follows :
1) To complete the business of the proposed roadway from
Frog Hollow Road to Satinwood Drive, with said road to
be built to existing standards of the City of Jefferso
at no cost to property owner.
2)- To final grade, fertilize, seed, and mulch all dis
turbed areas , which are not paved and insure the pro-
tection within reason of all trees in the right-of-way.
3) To allow for two (2) 60 foot right-of-way access points ,
their location to be mutually agreed upon by both
parties and to allow a maximum of one private drive
access point per 200 linear foot of front property.
4) To provide sanitary sewer crossings to be located to
naturally serve the property as agreed to by both
parties.
5) To provide one (1) sewer stub across the Frog Hollow
Branch to serve the Robert Schepker property (approxi-
mately 97. 0 linear feet, 8" line to be completed by
January 1, 1982) .

6) On the portion of right-of-way obtained along Frog
Hollow Road, the City of Jefferson shall waive any
assessment to the property owners for Curb and Cutters
(Approximately 650 linear feet from existing City Limits
to Frog Hollow Branch) .
The Party of the Second Part agrees to allow the Party of
the First Part a temporary grading easement of an even width of
thirty (30) feet upon the land emmediately adjacent to each side
and extending the full length of the strip of land described for
permanent street right-of-way; said temporary grading easement
shall expire and terminate upon completion of construction of.
said street.
IN WITNESS WHEREOF, the parties have hereunto set their
