INTRODUCED BY COUNCILMEN: i ORDINANCE NO. 4S I AN ORDINANCE BY WHICH THE CITY OF JEFFERSON , MISSOURI , CONTRACTS I WITH THE CITIES OF ARGYLE, CEDAR CITY, FREEBURG, LINN, HOLTS � SUMMIT, ASHLAND, CALIFORNIA, MOKANE, NEW BLOOMFIELD, RUSSELLVILLE, META, EUGENE, ST. THOMAS , TAOS , WESTPHALIA, ELDON, CENTRALIA, MEXI 0, COLUMBIA, FULTON, MOBERLY, BOONVILLE, DEPARTMENTS OF COLE COUNTY, 11CENTERTOWN, APACHE FLATS , FIRE PROTECTION DISTRICTS OF BOONE COUNT) , 11ISSOURI DEPARTMENT OF CONSERVATION, AND MISSOURI NATIONAL GUARD, HALL IN THE STATE OF MISSOURI , SUBJECT TO THE ACCEPTANCE PROVISION I THEREIN FOR THE OPERATION AND INTERCHANGE OF SERVICES OF THE RES- PECTIVE FIRE DEPARTMENTS IN CASE OF A MAJOR CONFLAGRATION OR DIS- ASTER. BE IT OP.DAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS, TO WIT: SECTION 1 : Subject to the acceptance provision contained in Section 3 hereof, the City of Jefferson, Missouri, contracts with 11the cities of Argyle, Cedar City, Freeburg, Linn, Holts Summit , Ashland, Taos, Westphalia, Eldon, Centralia, Mexico, California, Mokane, New Bloomfield, Russellville, Meta, Eugene, St. Thomas, Columbia, Fulton, Moberly, Boonville, Departments of Cole County, 5 Centertown, Apache Flats, Fire Protection Districts of Boone Count 3 , Missouri Department of Conservation, and Missouri National Guard fall in the State of Missouri, to create a pool of fire fighting equipment and personnel from the respective fire departments of i the contracting parties and to set up with said parties a plan of imutual assistance in case of a major conflagration or a major dis- aster should occur; said contract to be by authority of the Con- stitution of Missouri, Article VI , Section 16 , and of Section 70.210 to 70. 320, both inclusive, and 71. 370 to 71. 390 of R.S.Mo. 1978, and Chapter 321 R.S.Mo. 1978 and to be in words and figures as follows: CONTRACT THIS AGREEDTNT, made by and between the cities of Argyle, Cedar City, Freeburg, Linn, Holts Summit , Ashland, California, Mokane, New Bloomfield, Russellville, Eugene, Meta, St. Thomas , j Taos, Westphalia, Eldon, Centralia, Mexico, Columbia, Fulton, Moberly, Boonville, Departments of Cole County, Centertown, Apache Flats, Fire Protection Districts of Boone County, Missouri Depart- ment of Conservation, and Missouri National Guard, all in the Stat of Missouri, by ordinance duly enacted by said cities, and by proper authority of other organizations, witnesseth that -- In consideration of the mutual benefits and objectives here- inafter stated and the services to be performed for one another by the said respective parties, as stated herein, it is agreed between parties arties as follows: i A joint fire department committee consisting of one member from each of said parties, which member shall be the chief of the fire department of the city whom he represents and as appointed by non-city members, shall be created, and said committee is directed to make survey of the fire departments of all of said cities and organizations to arrange a pool of such fire fighting equipment and personnel as could safely be spared by such of said departments for responding to a call from any of said parties for assistance in case a major conflagration or disaster should occur. Said joint committed shall set up a plan of mutual assistance among said parties and shall correlate their fire fighting facilities for the purpose of mutual safety. In the event of a call for assistance from any of said parties, the fire departments of all of the other parties of said group shall be alerted to respond to such call if needed and they shall remain on such alert until the emergency shall have ended. The fire equipment and personnel contributed by each of said parties to said pool for such mutual assistance shall be stationed 11within the jurisdiction of the party contributing such equipment and personnel, and the chief of the fire department of each of sai party and persons in charge of other organizations shall be the judge of whether any part of his equipment and personnel can safely be spared under the circumstances existing at the time of such call for assistance. Said joint committee shall prescribe such rules and regulations as necessary and incidental to the efficient operation of said f I plan of mutual assistance and shall set up minimum requirements and standards of maintenance of fire equipment and personnel of I each of the contracting parties, and if any party of said group shall fail to maintain its fire equipment and personnel up to the minimum requirements and standards fixed by said joint committee, said committee shall give notice to said party, in writing, to bring said equipment and personnel up to said requirements and standards, and if such party should not bring said equipment and personnel up to said requirements and standards within six months I after the date of said notice, the joint committee may eliminate such party from the pool and plan of mutual assistance until such requirements and standards shall have been met. In case of loss, damage or injury to the fire equipment or personnel of any of the contracting parties while responding to ! the call for assistance to any other party pursuant to this agree- Imeat, such loss, damage, or injury shall be borne by the party owning and operating such equipment and employing such personnel. This contract may be terminated by any party or parties by Igiving sixty (60) days written notice to the other party or partie . SECTION 2 ; The chief of the fire department of the City of Jefferson, Missouri, hereby is appointed a member of the joint fire department committee provided for in the foregoing contract land he is authorized and directed to carry out the terms of said contract. He is authorized, further, to send such fire fighting equipment and personnel of the City of Jefferson, as in his judgment , can safely be spared from the City of Jefferson, at the Itime and under the circumstances, to go to the assistance of any of said parties in case a major conflagration or disaster should occur, and another member should call for assistance by the fire department of the City of Jefferson. SECTION 3; This ordinance shall be in effect from the time of its passage, and the contract authorized herein shall be in I effect as soon as an ordinance similar to this ordinance, and I tr9: making a like contract with the City of Jefferson, Missouri , shall have been duly enacted by each of the other cities of the aforesaid group of cities, and contracts signed by other organi- zations. SECTION 4: Upon passage of this ordinance, the City Clerk of the City of Jefferson, Missouri, shall mail a duly certified copy of this ordinance to the clerk of each of said cities of Argyle, Cedar City, Freeburg, Linn, Holts Summit, Ashland, California, Mokane, New Bloomfield, Eugene, Russellville, Meta, St. Thomas, Taos, Westphalia, Eldon, Centralia, Mexico, Columbia, Fulton, Moberly, Boonville, Department of Cole County, Centertown, Apache Flats, Fire Protection Districts of Boone County, Missouri Department of Conservation and Missouri National Guard.
