AN ORDINANCE OF THE CITY OF JEFFERSON MISSOURI , REPEALING CHAPTER 6, RELATING TO THE KEEPING OF DOGS, CATS AND OTHER DOMESTIC ANIMALS AND ENACTING A NEW CHAPTER 6 RELATING TO THE SAME SUBJECT MATTER. 'i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS: SECTION 1. Chapter 6 of the Code of the City of Jefferson, x 1978, is hereby repealed and a new Chapter 6 is enacted to read as follows: 4" <f ARTICLE 1. IN GENERAL ' SECTION 1. For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed r to them by this section: Animal. Any animal, domesticated or undomesticated. At Large. Any animal shall be "at large" when off the proper- ty of the owner and unleashed. Cat. Any member of the feline (genus felis) family over six months of age. Director. That person appointed or acting as Director of Planning and Code Enforcement , or his agents or employees. Dom. Any member of the canine (genus Canis) family over six months of age. Euthanize. To put to death in a humane way. s Exposed to Rabies. Any animal, whether vaccinated for rabies or not, which has had any physical contact with a rabid animal shall be deemed to have been "exposed to rabies. " Impound. To take into custody any animal, for the purpose of confinement. Kitten. Any member of the feline (genus felis) family under six months of age. Livestock. Any horse, cow, pig, hog, sheep or goat . r. Owner. Any person, partnership or corporation owning, keeping F or harboring an animal. Pup. Any member of the canine (genus Canis) family under six months of age. Tag. Any object , regardless of shape or size , bearing a reg- istration number and year, and the words "registered and vaccinated for rabies, " issued by a practicing licensed veterinarian. Vaccination-Registration. The vaccination for rabies and _r-`- issuance of an appropriate certificate, by a practicing licensed veterinarian. -1- SECTION 2. Running at Large It shall be unlawful for any owner in charge of any animal i or fowl to allow the same to run at large. 'y SECTION 3. Prohibiting Animals to Excrete on Sidewalks It shall be unlawful for any owner in charge of any animal yT to permit their animal to excrete on sidewalks, driveways, right- of-way, or other private property; the owner or person in charge of the animal is at all times responsible to clean and remove excretion from property not owned or controlled by such person. SECTION 4. Keeping Undomesticated Animals It shall be unlawful for any person to keep undomesticated animals within the city limits without the approval of the Directo . SECTION 5. Cleanliness of Pens, Coops, Etc. It shall be unlawful to keep any animal or fowl in any struc- ture, pen, coop or yard that is not maintained in a clean and sanitary condition at all times, devoid of all rodents and vermin and free from offensive, disagreeable or obnoxious smells or odors tending to injure, annoy or inconvenience any inhabitant of the neighborhood. SECTION 6. Keeping Near Dwellings. It shall be unlawful for any person to keep any undomesticated animal or fowl in an outdoor enclosure or pasture, the exterior 41, boundary of which is within one hundred (1001 ) feet of the dwel- ling house of another without the written permission of the owner or occupant of such dwelling house. SECTION 7. Minimum Area of Enclosure or Pastures. No person shall keep more than one livestock animal in an outdoor enclosure or pasture, unless such enclosure or pasture { shall have an area of one-half acre for each livestock animal; provided, that this area requirement shall not apply to the keeping of a suckling offspring of such animal. The provisions of this section shall not apply to any lawfully operated stockyard, slaughterhouse, university or college or -2- I ' l veterinary hospital. S. SECTION 8. Confinement of Fowl V. It shall be unlawful for any person owning, harboring or keeping chickens, ducks, turkeys, geese, or other fowl to fail `. to keep such fowl within a yard or other place surrounded by wire netting or other fence sufficient to prevent their escape. SECTION 9. Hatcheries. Any person within the city, engaged in the business of hatching baby fowl by the use of incubators, who permits any odor to escape from such incubators that is offensive or annoying to persons residing within the vicinity of the place of business shall be deemed actively maintaining a nuisance and guilty of a misdemeanor. SECTION 10. Hog Pens. It shall be unlawful for any person to keep or use within the corporate limits any pen, stall, place or enclosure in which hogs or swine shall be kept , except for the purpose of immediate trans- portation or immediate use for the market; provided, that subject to its right to revoke the same at any time, the Animal Control Advisor Commission of the city may Y y y grant permission to maintain y or have such pens, stalls or enclosures in thinly or sparsely settled localities of the city, and where they will not be of- fensive or annoying to persons living in such vicinity. ;,� ,•: SECTION 11. City Shelter. The Director shall, with the advice of the Animal Control Advisory Commission, City Council and Mayor, establish a city •t shelter, under the supervision and direction of the Director, s, for the reception and humane care of sick, injured, diseased or t'. impounded animals, and establish rules and regulations there- ; for. SECTION 12. Impoundment - Generally. All animals and fowl found running at large in the city are ' hereby declared to be a public nuisance and shall forthwith be -3- taken up by the Director and placed by him in some secure shelter, to be provided by the city for that purpose. i SECTION 13. Notification of Owner. When any animal or fowl shall be taken up as provided in Section 12, it shall be the duty of the Director to make diligent inquiry for the owner thereof and, when such owner shall be found, Ito notify him, of the taking up and the impoundment of such animal ) or fowl. SECTION 14. Redemption of Impounded Animals; Disposition of Unredeemed Animals. (a) The owner of any impounded animal, or any other person with the authority of the owner, may redeem such animal within a period of seventy-two (72) hours after impoundment by paying to the Director, ten ($10.00) dollars for each twenty-four (24) hours of impoundment, or fraction thereof, for the expense of keeping, feeding and sheltering such animal during the term of impoundment . (b) Any impounded dog or cat which does not bear proof of rabies vaccination shall be released to the owner after the payment of the required fee for vaccinating, insuring that the animal will be vaccinated for rabies. (c) Any dog, pup, cat, or , kitten that is impounded and not redeemed within seventy-two (72) hours after notice thereof is given to the owner or, in the event the owner cannot be determined, any animal that is not redeemed within seventy two ( 72) hours after impoundment , may be euthanized by the Director or released to an person upon y p p payment of the ac- crued fees provided for. and the execution of an affidavit that all necessary steps will be taken to comply with the provision of this chapter within twenty-four hours. rt� SECTION 15. Refusal to deliver animals to Director. �•l ' = Ank It shall be unlawful for any person to refuse to deliver his animal to the Director, when requested to do so under the pro- '`: visions of this chapter. SECTION 16. Removing animals from custody of the Director. It shall be unlawful for an y person to remove from the custody 3., of the Director, by force, deceit or otherwise, any animal which has been trapped, captured or impounded by the Director. SECTION 17. Poisoning Animals. It shall be unlawful for any person to feed or place so as to constitute a direct or obvious hazard to man or animal, or to offer or tempt any animal with, liquid, meat , or any food product which shall: (a) cause prostration, convulsion, pain or suffering _4q 1 as a prelude to death; (b) cause death; or (c) be proven to be toxic or lethal in the amount present to any man or domestic animal by competent medical or veterinary authority. SECTION 16. Dead Animals or Fowl. It shall be unlawful for the owner of any dead animal or fowl to permit such animal or fowl to create a nuisance or health hazard by remaining undisposed of in excess of twenty-four (24) hours. SECTION 19. Loading, Transferring, etc. , Livestock. It shall be unlawful for any person to unload or transfer livestock from one vehicle to another in any public place, street or thoroughfare or on any private premises, or for any person to park or stand any vehicle for such purpose on any street or S! thoroughfare or on any unenclosed private premises within the city for longer than one (1) hour; provided, that nothing in this section shall prohibit loading, unloading or transferring livestock at any established and maintained stockyard, slaughter- house or stable barn, or in any enclosed building. SECTION 20. Breeding Livestock. It shall be unlawful for any person to permit the breeding of ` livestock within the city, unless the same is in an enclosed shed rtq or stable and entirely out of public view or hearing. SECTION 21. Allowing Animals to Remain Without Sufficient Food, Water or Shelter. s It shall be unlawful for the owner or person in charge of any animal to permit such animal to remain without sufficient food, water or shelter. No person shall beat , cruelly ill treat , torment, overload, overwork, or otherwise abuse any animal, or A cause to permit any dog fight, cockfight , bullfight or other combat between animals or between animals and humans. ARTICLE II. DOGS, CATS, PUPS, AND KITTENS GENERALLY SECTION 1. Vaccination of Dogs and Cats; Required, Term of Validity; Certificate. (a) It shall be unlawful for any person to own, keep, harbor or permit a dog or cat within the city, unless a certificate of rabies vaccination is secured by a practicing licensed -5- ri i. veterinarian and the dog or cat bears a registered tag of current rabies vaccination. (b) The rabies vaccination shall be valid for a period of one ( 1) year from the date of vaccination. (c) The certificate of vaccination shall be made in tripli- cate, indicating the name and address of the owner, the name, sex, color and breed of the animal and the date of vaccination The original certificate shall be delivered to the owner at the time of the vaccination of the animal. A copy of the certificate shall be delivered to the Director at the end of each month. The third copy of the certificate shall be main- tained, in alphabetical order, by the issuing party. SECTION 2. Same - Display of Tag; Replacement Tag or Certificate. (a) Each dog or cat shall have attached, by means of a secure collar or harness, a current, serially numbered, nontransfer- able rabies tag. (b) A replacement tag may be obtained by presenting the certificate of vaccination and payment of the required fee to the issuing party. SECTION 3. Removing Collar from Dog or Cat. Any person who, without proper authority, shall remove the collar from the neck of any dog or cat which has been registered under the provisions of this chapter shall be deemed guilty of a misdemeanor. SECTION 4. Running at Large. It shall be unlawful for the owner of any dog, pup, cat or kitten to let such animal run at large. SECTION 5. Confinement of Female Dogs or Cats During Period { of Salacity. It shall be unlawful for the owner or the person in charge of any female dog or cat to fail to keep such dog or cat confined on the remises of the owner during the y of the dog p g period of salacity or cat. SECTION 6. Vicious Dogs, Pups, Cats or Kittens. . It shall be unlawful for any person to own, keep, harbor or allow to be in or upon his p premises any dog, pup, cat or kitten of a cross, dangerous, vicious or ferocious disposition to bite or attack persons. Upon conviction of any person for a violation of this section, the municipal Judge may, in addition to the usual Judgement, order the Director or forthwith take up and put to -g_ death such dog, pup, cat or kitten. SECTION 7. Barking or Howling Dogs, Pups, Cats or Kittens. It shall be unlawful for any person to own, keep or harbor any dog, pup, cat or kitten which, by loud, continual or frequent p barking or howling, disturbs any neighborhood. r ARTICLE III . RABIES CONTROL. t SECTION 1. Animal Bite or Puncture Procedure. The owner of any animal which bites any person, or punctures the skin thereof, whether the animal is vaccinated or not , shall be required to place the animal in a hospital maintained by a practicing licensed veterinarian, for a period of ten ( 10) days following the evening of the day of the bite, for clinical ob- servation. All expenses thereof shall be borne by the owner of the animal. If such animal develops symptoms of rabies, it shall be allowe to die, or if death shall occur while such animal is confined, for any reason, the head of such animal shall be removed by the veterinarian and submitted to any qualified official laboratory. If at the end of such ten (10) day period the animal is alive and healthy, it may be released to its owner; provided, that all other conditions of this chapter are fulfilled. SECTION 2. Suspected Rabid Animals. The owner of any animal which exhibits clinical symptoms of . E; rabies shall be required to have the animal confined under the supervision of a practicing licensed veterinarian in the city for a period of ten (10) days for clinical observation. All expenses ",„ under this procedure shall be borne by the owner of the animal. �x a SECTION 3. Animals Exposed to Rabies. r� The owner of any animal which has been exposed to rabies .1 shall accept one of the following alternatives ; (a) Strict isolation in an animal hospital for ten days. (b) If no previous vaccination has been given within a period of three (3) years with MLV (flury strain) vaccine or within one (1) year using a vaccine of nervous tissue origin, admini- stration of post-exposure treatment and confinement in a kennel for three (3) months. -7- (c) If the animal has been vaccinated previously within one (1) year with nerve tissue or kelev strain vaccine, or within three (3) years with flury vaccine, re-vaccination or restraint by a leash or confinement at home for thirty days. (d) Have such animal destroyed. :4 SECTION 4. Quarantine. Whenever the Mayor shall deem it necessary because of the pre- valence of rabies among the animal population of the city, county or state, strict quarantine may be placed on all animals in the city. Upon such proclaimation by the Mayor, all animals shall be confined on the owner' s premises. Any animal found otherwise shall be impounded or destroyed by the Director. SECTION 5. Right of Entry of Director. The Director shall have the right of entry to any property or premises within the city for the purpose of determining if the :s provisions of this chapter are being complied with. {: SECTION 6. Fines. Violation of any of the provisions of Article I , II , or III of Chapter 6, shall be deemed a misdemeanor, and any person con- victed thereof shall be fined not less than ten ($10. 00) dollars or more than five hundred ($500.00) dollars, or shall be sentenced to a term of confinement of not less than ' one (1) and not more than ninety n y 90( ) days y jail, or shall be both fined and sen- tenced. Each day that the condition exists in violation of these provisions constitutes a separate offense. SECTION 2.
