AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING THE CODE OF THE CITY OF JEFFERSON, 1978, BY REPEALING SECTION 5-13 RELATING TO CONSENT OF ADJOINING PROPERTY OWNERS, BY REPEALING SECTION 5-14 RELATING TO RESIDENCE REQUIREMENTS, BY REPEALING SECTION 5-15 RELATING TO BOARD OF LIQUOR CONTROL TO APPROVE AP- PLICATION AND ENACTING NEW SECTIONS 5-13, 5-14, AND 5-15 RELATING TO THE SAME IN LIEU THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS : Section 1. The Code of the City of Jefferson is hereby amended by repealing Section 5-13 and enacting a new Section ® 5-13 in lieu thereof to read as follows : Section 5-13. Consent of adjoining property owners required: No license, as required by this division of the Code, for the sale of intoxicating liquor for consumption on the premises where sold, shall be issued until the applicant therefor shall file with the License Inspector a statement waiving any objection to the establishment of the business for which such license is sought. In a C-3 Central Commercial zoned district the statement shall be signed by a majority of the property owners owning real property within a two hundred (2001 ) foot distance of the property lines of the property on which the liquor business is to be located. In all other zones of the City, the statement shall be signed by a majority of the property owners owning real �® property within a four hundred (4001 ) foot distance of the property lines of the property on which the liquor business is to be located. Such requirements of a signed statement may be waived when the same type of license applied for has been issued or is in effect for the same premises within the preceeding three months. Section 2. The Code of the City of Jefferson is hereby amended by repealing Section 5-14 and enacting a new Section 5-14 in lieu thereof to read as follows : Section 5-14. Residence Requirements. No license authorizing the retail sale of intoxicating liquor for consumption on the premises where sold, shall be issued unless the person or managing officer of a corporation applying for such license shall have been a person of good moral character and a qualified • legal voter and a taxpaying citizen of the city. Section 3. The Code of the City of Jefferson is hereby amended by repealing Section 5-15 and enacting a new Section 5-15 in lieu thereof to read as follows: Section 5-15, Board of liquor control to approve appli- cation; appeal from board's decision to City Council: All applications for license provided for in this divi- sion and all petitions so filed with such applications shall be referred by the License Inspector to a board to be known as the Board of Liquor Control, which board shall be composed of the persons holding the office of City Attorney, Chief of Police, and Director of Planning, respectively. The License Inspector shall issue no license without the written approval of a majority of such Board of Liquor Control. It shall be the duty of such Board of Liquor Control to determine whether or not the application for license complies with the provisions of this article. Until such application is approved in writing by such Board of Liquor Control, the License Inspector shall have no :authorit to issue such licenses; provided, that any applicant for a license whose application may be acted upon ad- versely by the Board of Liquor Control, or any other citizen who may deem the board's finding improper may, within ten days after such action by the Board of Liquor Control, file a petition with the City Council appealing from the action of the Board of Liquor Control. The council shall have final authority in such matter, and shall have the right to reverse as it deems proper the action of the Board of Liquor Control. Section 4.
