ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING
, ORDINANCE NO. 9422, COMMONLY REFERRED TO AS THE LITTER ORDINANCE,
BY CHANGING THE PENALTY FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS :
Section 1. Amend Ordinance No. 9422 , Section 1 (a) , by
striking the last two sentences of said subsection and inserting
in lieu thereof the following:
" ***. Violation of this subsection is a misdemeanor, and
any person convicted thereof shall be fined not less than
fifty ($50. 00) dollars, or more than two hundred and fifty
($250. 00) dollars, or shall be sentenced to a term of con-
finement of not less than one (1) and not more than ninety
(90) days in jail , or shall be both so fined and sentenced.
Each day that the condition exists in violation of this
subsection constitutes a separate offense. "
Section 2. Amend Ordinance No. 9422 , Section 1 (d) , by
lstriking the last two sentences of said subsection and inserting
in lieu thereof the following:
"****. Violation of this subsection is a misdemeanor, and
any person convicted thereof shall be fined not less than
fifty ($50. 00) dollars, or more than five hundred ($500.00)
dollars, or shall be sentenced to a term of confinement of
not less than one ( 1) and not more than ninety (90) days in
jail , or shall be both so fined and sentenced. Notwith-
standing the foregoing, if any person is convicted of a
® violation of this subsection, and if the court finds that
the violation occurred while the person was the driver or
occupant of an automobile, truck or motor vehicle of any
other description, whether said vehicle was then moving
or at rest , then the minimum fine for the violation shall
be twenty-five ($25. 00) dollars, and the minimum sentence
of confinement shall be one (1) day, and the maximum fine
and sentence shall be as set forth in this subsection. "
Section 3. This ordinance shall be in full force and effect
from and after the date of its passage and approval.
