AN ORDINANCE OF THE CITY OF JEFFERSON, AMENDING THE CODE OF THE
CITY OF JEFFERSON, MISSOURI , 1978, BY REPEALING SECTIONS 4-1, 4-2,
AND 4-3, RELATING TO THE AIRPORT COMMISSION, AND ENACTING NEW
SECTIONS 4-1 THROUGH 4-1. 5 AND SECTION 4.2.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. Sections 4-1, 4-2, and 4-3 of the Code of the
City of Jefferson, Missouri, 1978, are hereby repealed and new
Sections 4-1 through 4-1. 5 and 4-2 are enacted in lieu thereof
to read as follows:
Section 4-1. Created. There is hereby created an Airport
Commission for the City of Jefferson.
Section 4-1. 1. Composition , Term of Office, Appointment ,
Removal , and Vacancies.
A. The Airport Commission shall consist of eleven members
Of the eleven members :
1. Four shall be ex officio members without a vote.
These shall be:
a. Director of Transportation.
b. Director of Public Works or his delegate.
C. Representative from appropriate State Agency.
d. One City Councilman and one alternate; al-
ternate shall attend at will and replace
primary member in his absence.
2. Seven shall be residents of the City, and a mini-
mum of one of these appointments shall be an FAA
qualified and duly licensed pilot .
B. The term of office shall be three years with one-
third of the positions being available for appointment each
year. Upon creation of this Commission, the Mayor shall name
three members for three year appointments , two members for
two year appointments , and two members for one year appoint-
ments. Thereafter, all Commission members shall serve full

three year terms.
C. The Mayor shall nominate persons to serve on the
Airport Commission, and the appointments shall be confirmed by
the City Council. The Mayor shall name the Chairman of the
Commission from those persons confirmed as members by the City
Council. The appointment of Chairman is for a one year term,
and the Chairman shall be a voting member, although he is not
permitted to make motions.
D. The Mayor, with a majority vote of the City Council ,
may remove any member of the Commission for failure or in-
ability to attend meetings or for other good cause shown.
E. The appointed members of the Commission shall receive
no compensation but shall receive reimbursement for costs in-
curred with their service.
F. A vacancy on the Commission shall be filled by appoint-
ment and approval in like manner for the unexpired portion of
the term. All members shall continue to serve until their
successors shall have been appointed and qualified.
Section 4-1.2. Meetings , Quorums , Rules, and Procedures.
A. The Commission shall hold a regular business meeting
at least once each month at such time and place as shall be
established by the rules of the Commission. The Commission
® may hold additional business meetings from time to time as it
feels necessary.
B. A majority of the Commission's voting members shall
constitute a quorum for the transaction of its business.
C. The Commission may establish such rules and procedures
as it believes are reasonably necessary for expeditious trans-
action of its business affairs and which are in conformance
with City Council policy.
D. All meetings shall be open and public, and the date,
time, and location of same shall be posted and be public in-
formation at least twenty-four hours prior to the meeting.

Section 4-1. 3. Duties Generally. The duties of the
Airport Commission shall generally include, but not be limited
® to, the following:
A. To assist the Transportation Director in the prepara-
tion of, and to make recommendations on the Airport Division
budget proposals.
B. To call upon and receive the cooperation and assis-
tance of all departments, officers , and employees of the City,
and to promote cooperation and coordination with other govern-
mental agencies.
C. To provide for the attendance of one of its members,
where appropriate, at airport forums, seminars, or institutio s
where special instruction courses in the field of airport
operations may be offered.
D. To recommend the employment of a qualified consultant ,
or seek internal assistance, when the need for trained techni-
cal assistance on airport matters arise.
E. To review all proposed contracts and leases in ac-
cordance with the applicable provisions of the Code and the
General Purchasing Ordinances of the City and to recommend
City Council action thereon.
F. To review and recommend a five year capital improve-
ment plan for the Jefferson City Memorial Airport .
® G. To provide the City Council with minutes of all its
meetings and reports of specific recommendations.
H. To monitor the financial status of the Airport
Division and Airport Division Fund.
I . To make recommendations pertaining to the operation,
management , use, and maintenance of Jefferson City Memorial
Airport .
J. To review and make recommendations concerning appli-
cations to offer commercial scheduled airline service at the
Airport , or any other service to be provided by a private
vendor.

K. To make recommendations concerning fees charged at
the airport.
Section 4-1 . 4. Commission Member Liability. The City
Council shall purchase and keep in force a public official
liability insurance policy that shall cover all Commission
members in regards to any liability incurred because of their
duties or positions as Commission members. An exception to
the coverage is misconduct or negligence excluded by the in-
surance policy.
Section 4-1. 5. Officers. In addition to the Chairperson
appointed by the Mayor, the Commission may pick a Vice-Chair-
person and any other officers they deem necessary. The
Secretary to the Director of Transportation shall serve as
the recording Secretary for the Commission and record the
minutes.
Section 4.2. Commercial Services at Airport . Any person
desiring to enter into any business or provide any commercial
services at the airport shall make an application in writing
to the Director of Transportation for permission to provide
such commercial service, or to lease any property, or conduct
any business on the airport, agreeing that if he is authorized
by the City to provide commercial scheduled or non-scheduled
® airline service, to provide fixed base operation, to lease
any property on the Airport , or to conduct any business on
the airport , he will meet the following qualifications :
1. That such person, firm, or corporation is insured,
and will continue to be insured, and will provide the
City, through the Director of Transportation, with evi-
dence of such insurance against public liability and
property damage in the following amounts : for injury or
death to one person Two Hundred Fifty Thousand Dollars
($250,000.00) ; for injury or death to two or more persons

in one accident Five Hundred Thousand Dollars ($500,000) ;
for aggregate damage to property Five Hundred Thousand
Dollars ($500,000. 00) .
2. That in the case of those persons, firms, or
corporations offering commercial scheduled airline ser-
vice, such persons, firms, or corporations must be
authorized by a certificate of convenience and necessity
issued by the Civil Aeronautics Board of the United States
or by an appropriate certificate of authority from a
governmental agency to provide such scheduled commercial
airline service to the Municipal Airport . The Commission
and Director of Transportation are authorized to review
and recommend such terms and conditions as they may feel
necessary. The Director of Transportation may negotiate
such proposals on behalf of the City Council with review
by the City Administrator. , City Counselor, and Airport
Commission, but only the City Council shall enter into
and execute legal contracts.
SECTION 2. Repealer. All ordinances or parts of ordinances
in conflict with this ordinance are hereby repealed.
SECTION 3. This ordinance shall take effect and be in force
from and after its passage and approval.
