HomeMy Public PortalAboutORD09642 f� 1 BILL NO. 81-17 INTRODUCED BY COUNCILMAN "tea ORDINANCE NO. 1ZsV _ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, 1978, BY REPEALING SECTIONS 4-6 AND 4-7 DEALING WITH AIRPORT LANDING FEES AND BUILDINGS, AND ENACTING NEW SECTIONS 4-6 AND 4-7. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Sections 4-6 and 4-7 of the Code of the City of Jefferson, 1978, are hereby repealed and new sections 4-6 and 4-7 are enacted in lieu thereof as follows: 1 Section 4-6. Landing Fees and Other Charges Any person authorized by the City Council to provide scheduled commerical .airline service at the airport shall pay to the City, seventy-five cents (75¢) for each landing on the airport of an aircraft used in performing scheduled airline service. Each scheduled commercial airline operator shall file a statement on or before the 10th day of each month, with the Director of Transportation disclos- ing the total number of landings of the commercial carrier's aircraft on the airport for the preceding month, the total number of passengers and the total amount in pounds of air freight transported by the carrier in the preceding month, and the Director of Transpor- tation shall then bill the commerical airline operator for the landing fees due the City, which shall be paid to the City prior to the first day of the next succeeding month at the rate mentioned above, together with any other charges and fees prescribed by the City Council and as provided in any agreement or contract between any scheduled commercial airline operator and the City Council. All other fees and charges for commercial or other use of the airport, for the occupancy of buildings owned by the City on the airport and for all services that are rendered at the airport, by the airport commission, the Director of Transportation, or the fixed base operator, shall be determined and fixed by the City Council, either by express contract between the City Council and any commercial operator or business at the airport or by a schedule of fees and charges determined by the City Council. Section 4-7. Hangers and Buildings All hangers, buildings, and structures shall be built in conformity with the City Building Code for buildings in commercial areas. Plans for proposed construction shall be submitted to the Director of Transportation who shall secure the approval of the Director of Public Works and the Director of Planning and Code Enforcement of such plans prior to any construction. All hangars and buildings shall be of permanent type construction. Any person desiring to erect a building on the airport will be permitted to do so under a contract or lease negotiated with the Director of Transportation for the necessary land space, at rates to be subject to the approval of the City Council and the Mayor of the City. The City shall reserve the right to buy all buildings erected on the airport on the following schedule: depreciation of buildings and hangars at the rate of three percent per annum for the time the building has been erected, based on the actual cost for the erection of the building, such cost to be substantiated by actual invoices covering labor and materials at the time the building or hangar was erected. The City, in the event it desires to buy a building, shall pay to the owner for the buiding the amount so determined under the ® above schedule for such building. In the event the City desires to purchase such building, it shall give to the lessee, in writing, notice of its intention to purchase such improvements six months prior to the purchase thereof. If the City gives notice as aforesaid, of its intent to purchase •such building, the lessee may elect to retain and remove such improvements from the airport at its own cost and at no cost to the . City, and the lessee shall, at its own cost, restore the premises to their condition prior to placing of the improvements on the airport. Section 2. Repealer. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. -2- i Section 3. This ordinance shall take effect and be in force from and after its passage and approval.
