HomeMy Public PortalAbout01-13-1998PLANNING COMMISSION MINUTES - JANUARY 13, 1998 PRESENT: KATHY COOK, JERRY BROST, CAROLYN SMITH, ANNE HEIDEMAN, LENNY LEUER, ELIZABETH WEIR, SUSIE MACKAY, FRANK MIGNONE AND BRUCE WORKMAN. ALSO PRESENT, PLANNING & ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING & ZONING ASSISTANT SANDIE LARSON. Chairperson Anne Heideman called the meeting to order at 7:38 p.m. 1. MINUTES OF DECEMBER 9, 1997 Susie Mackay questioned on page 4, remark by Jerry Brost, that it did not sound quite right. The sentence was changed to read - -"could use a percentage to put a ceiling on the amount of a variance" Susie also said that in Bruce Workman's remark, than should be "and". MOVED BY CAROLYN SMITH AND SECONDED BY ELIZABETH WEIR TO APPROVE THE MINUTES AS CORRECTED. MOTION PASSED WITH LENNY LEUER ABSTAINING Commissioners Kathy Cook and Bruce Workman arrived at 7:46 p.m. 2. HENNEPIN PARKS - 2935 PARKVIEW DRIVE - CONDITIONAL USE PERMIT TO REPLACE BARN AT BAKER NATIONAL GOLF COURSE - PUBLIC HEARING - 7:43 P.M. Loren Kohnen read his memo to the planning commission and put up overheads of the site and the barn plans. Frank Mignone said that Loren had said in his memo that as much of the old foundation would be used as possible. Did that mean the new building would be a different size or was the footprint the same. L. Kohnen said that the new barn would be exactly the same size as the old one. Carolyn Smith asked about the milk house. Alex Meyer, Hennepin Parks, said that would come down. It will give the golfers more clearance. Jerry Brost asked about condition #3 in Loren's memo - no heating equipment to be installed. He wondered if there was a need to note that portable heat could be used. 1 A. Meyer said that was not necessary. There was no intention for use other than storage. He said that at the end of the golf season equipment would be put in the building and out again in the spring. He said there would be minimal electricity. J. Brost asked what fire codes would have to be met with such minimal use. L. Kohnen said fire extinguishers and proper exits. F. Mignone asked if the new building would be painted red. A. Meyer said yes, the intent was to replace it as is. This is a `signature' of the golf course. C. Smith asked about the footprint on the upper level and about a door. A. Meyer pointed out the door placements on the plan for Carolyn. The north door being on the upper level and the south door being on the lower level. C. Smith then asked about the speaker on the side of the barn and also wanted to know if the chimney was coming down. A. Meyer said the speaker must just be hanging there from a former use when this was a maintenance shop and yes the chimney would be coming down. Lenny Leuer said it looks like there are remnants of a cistern for underground water storage and what is the status of it. A. Meyer asked if this was on the north side. L. Leuer said by the milk house. He said that it looks like water draining from the building would go to this cistern. A. Meyer said it could be taken out and plugged. He said there would be drain tile on the north side of the building. J. Brost asked about the "no special lighting" that Alex mentioned in his letter. A. Meyer said there would be no exterior lighting on the building. Elizabeth Weir asked about the longevity of plywood for the siding. L. Kohnen said it is exterior grade plywood siding and is as good as any other wood siding, has to be kept painted, etc. C. Smith mentioned the wood and steel piled outside by the building and Alex said it was debris from the storm last summer and would be taken care of. 2 MOVED BY ANNE HEIDEMAN AND SECONDED BY LENNY LEUER TO RECOMMEND APPROVAL OF A CONDITIONAL USE PERMIT FOR 2935 PARKVIEW DRIVE TO REPLACE A BARN WITH THE FOLLOWING CONDITIONS: 1. Building is two stories with 1 800 square foot footprint. 2. Any exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is casts directly on any other property or right of way. 3. Because of limited accessibility no heating equipment to be used or installed in building. 4. Building must have shingled roof and be wood sided. 5. Building not to be used for any function other than cold storage. 6. Building to meet building and fire codes. 7. No outside bells or loudspeakers. 8. If there is an old cistern on the east side of the building, it must be abandoned and filled. 9. The milk house is to be removed. 10.The old chimney must be removed. 11. No outside storage allowed. The debris that is there must be cleaned up. MOTION CARRIED. 3. MICHAEL S. KELLY - 1195 HACKAMORE RD. - RE -ZONING - VARIANCE - SUBDIVISION - PUBLIC HEARING - 7:58 P.M. Loren Kohnen read his memo to the planning commission and put up overheads of the area and explained that the road would be an extension of the road from Foxberry Farms. Jerry Brost asked if all the parcels in the subdivision would have driveways onto the road with no shared driveways. Richard Sathre, Sathre Bergquist for Michael Kelly, said that is correct. He said that the Lundgren Brothers is to the east and the City probably will be seeing a final plat for the 5th Addition this spring. He said that the Kelly piece is basically the last piece in the comprehensive plan that the City had projected sewer for. Susie Mackay asked to have explained the numbers on the plat, which were lot and which were blocks. Where a fire hydrant would be placed was discussed. R. Sathre explained the need for the `flag' lot - stating that the hardship was the placement of the existing house. 3 B. Workman asked about the placement of the house on the proposed `flag' lot and stated that it appeared that it would be a very long driveway. F. Mignone said that the house would not be able to have any further variances. R. Sathre said that there was a wetland to the west so it would not make sense to have a permanent road there. S. Mackay asked if all the other lots met the road frontage requirement and she was told yes. E. Weir wanted to know if this was normal language - variance - for this type of thing. L. Kohnen asked if there would be covenants on the parcels as to type of construction, setbacks, etc. M. Kelly said it would be similar to Foxberry. B. Workman asked about the side setback and was told that it was 15'. S. Mackay wanted to know what the difference was between a technical variance and a regular variance. R. Sathre said this was about achieving reasonable use of the property if it is zoned Suburban Residential. He said that if we built more street for the same number of parcels, to me that creates hardship on the land. It is more environmentally friendly, less run-off, etc. B. Workman wondered if we could grant a hardship because it would accommodate the best use of the land. J. Brost asked if the applicants could have designed more lots on this land with a different design. R. Sathre said there could probably have been some more, that there is some wasted space on a few of the lots. C. Smith wanted to know what watershed district this was in and she was told Elm Creek. She also questioned the wetlands that had been filled on this property and Loren said it had all been approved by the DNR. R. Sathre said that Lake Medina has been all grass. He gave some background on the property and Wally Doerr, the dredging of Lake Medina, etc. C. Smith wanted to know if the watershed needed to look at this. 4 L. Kohnen wanted to know if the old dredge and floats had been removed. R. Sathre said no and Loren said this will have to be looked at before the next approval for Foxberry 5t" R. Sathre said that Elm Creek Watershed will review this looking at the water impacts, storm water issues, etc. Lenny Leuer talked of the house on the proposed `flag' lot - it looks like the fill goes right up to the lot line - is there fill going into the existing swamp. R. Sathre said that the wetland edge is just over the west line. We will not fill in the wetland, it is close. He said that the house design will dictate the extent of the fill. He also said that there is a lot of detail on the preliminary plat that will not be on the final plat. L. Leuer said that with his own recent dealings with the watershed, that now soil conservation is involved. L. Kohnen said that the entire wetland is protected by the DNR and he is sure that they watched Wally Doerr very closely. He also said that the fill should be pulled back a little. He also reiterated that the DNR is in control and not the watershed district on this wetland. R. Sathre said that the DNR approved the ordinary high water mark (elevation) and if we keep above that, no further permits are required by the DNR. He further explained some of the DNR rules, high water marks, etc. E. Weir wanted to know if the NURP pond would require maintenance. R. Sathre said that in 10-15 years it probably should be cleaned out and it is a public function to do so. C. Smith wanted to know what happens to the water that drains to the west. R. Sathre said that it goes to the bigger wetland to the west. S. Mackay asked if the City could regulate the use of phosphorus free fertilizers and limit chemical use in order to protect the ground water and wetlands. E. Weir said make it suitable for cattails. R. Sathre said that there is a 1:10 slope in the first 10 feet, then it goes to 3:1. He said the fringe would grow cattails and in the very middle there is open water. 5 Kathy Cook asked if we as a city could look at introducing properly filtering plants at the edge of the wetland. A. Heideman said it would be part of the landscaping. E. Weir asked if we could require a certain amount of vegetation next to the wetland. L. Leuer said that Loren suggested no fill within certain distance of the lot line. L. Kohnen said that there will be an easement around it and Lenny said that no fill can be within the drainage and utility easement. R. Sathre said that they could move the contours back and re -locate the silt fence. B. Workman asked why you would speculate on the location of the houses. R. Sathre said that when we are doing the grading for the subdivision we do need to decide the area of the house pad. Jerry & Beth Peterson, 1295 Hackamore Road, stated they owned the 9 acres to the west of this proposal and they are concerned with the water run-off onto their property. R. Sathre said that they are not bringing any fill in, they are just re -shaping what is there. F. Mignone said but there will be additional run-off with the houses, streets, etc. R. Sathre said there will most likely be diminished run-off to the west because they are changing the pattern somewhat. C. Smith asked about the tree ordinance that was being talked about and if it became an ordinance would it apply to this subdivision. She was told no, that it was not an ordinance when the application came in. MOVED BY FRANK MIGNONE AND SECONDED BY CAROLYN SMITH TO RECOMMEND APPROVAL OF THE RE -ZONING OF THE 10+ ACRES AT 1195 HACKAMORE FROM RURAL RESIDENTIAL TO SUBURBAN RESIDENTIAL BASED ON FITTING IN WITH MEDINA'S COMPREHENSIVE PLAN. MOTION PASSED. MOVED BY JERRY BROST AND SECONDED BY BRUCE WORKMAN TO RECOMMEND APPROVAL OF A VARIANCE FOR LOT 3, BLOCK 2 FOR A `FLAG' LOT WITH HARDSHIP BEING THE PLACEMENT OF THE EXISTING HOUSE AND IS ALSO CONSISTENT WITH OTHER PLATS IN THE AREA. 6 MOTION PASSED. MOVED BY CAROLYN SMITH AND SECONDED BY KATHY COOK TO RECOMMEND APPROVAL OF THE PRELIMINARY PLAT FOR THE KELLY ADDITION WITH THE FOLLOWING CONDITIONS: 1. To be reviewed by the DNR and Elm Creek Watershed District 2. Proper drainage and utility easements 3. No filling within the drainage and utility easements on the western border 4. Ten (10') foot drainage and utility easements on the west lot lines 5. Encourage that adequate plantings are done for filtration and stabilization of soils 6. Silt fence moved as shown on the preliminary plat 7. Tree preservation is encouraged Lenny Leuer wanted to know that after being reviewed by the DNR, etc. and the City determines that a lot needs to be eliminated would this come back to the Planning Commission and Loren said yes. MOTION PASSED The Planning Commission wants to encourage the developer and the applicant to have in their covenants to encourage property owners to use non -phosphorus fertilizer. Rick Sathre said maybe information could be given to new homeowners with their packet of other city information. There was some discussion of the Saturday meetings with property owners in the City on the comprehensive plan review. MOVED BY BRUCE WORKMAN AND SECONDED BY ELIZABETH WEIR TO ADJOURN. MOTION PASSED.
