MISSOURI, AS FOLLOWS:
SECTION 1. That the Mayor and Clerk are hereby authorized
to execute on behalf of the City of Jefferson a written
supplemental agreement with the State Highway and Transporta-
tion Commission .of Missouri and the Missouri Pacific Railroad
Company providing for Railroad Crossing Surface Improvements.
SECTION 2. A copy of said agreements are attached

Dear Mr. Bates:
Attached for your records is a fully executed copy, of the Supplemental Agreement
for each of the above-noted railroad crossings on West Main Street covering instal-
lation of rubber pad surfaces.
By, letter of September 17, 1981, the Railroad Company was authorized to proceed
with this work. They have also been advised to coordinate and work out vehicular
traffic handling procedures with you. Inasmuch as this street does not carry a
State route, it will not be necessary to have our concurrence on the traffic
handling plan and procedures worked out between you and the Railroad.

® SUPPLEMENTAL AGREEMENT FOR
RAILROAD CROSSING SURFACE IMPROVEMENT
This Agreement, made and entered into by and between the Missouri Highway and
Transportation Commission, hereinafter called "Commission," and the Missouri Pacific Railroad
Company, hereinafter called "Railroad," and the City of Jefferson City, hereinafter called "City,"
pursuant to the terms of a Master Agreement between Commission and Railroad dated February
27, 1980.
WITNESSETH:
WHEREAS, rehabilitation of grade crossing surface appears to be warranted at an existing
grade crossing of West Main in Jefferson City, Missouri, and Railroad's tracks at a point where
said West Main intersects Railroad's tracks at a point known as Railroad Milepost - None;
WHEREAS, the parties hereto agree that said rehabilitation will enhance safety to both
® highway and railroad traffic at said grade crossing.
NOW, THEREFORE, in consideration of the premises and of the mutual covenants herein
contained, be it agreed as follows:
I. Railroad shall prepare and submit to Commission plans and estimate of costs for the
above crossing in accordance with the provisions of the Master Agreement.
2. Railroad, upon. receipt of notification from Commission shall furnish all labor and
material and complete the rehabilitation in accordance with the Master Agreement and in
accordance with the specifications attached hereto, marked Exhibit A, and incorporated herein,
and the rules and regulations contained in FHPM 1-4-3, and any revisions thereto which by
reference are made a part, of this agreement.
3. If any substantial change is made in the original plan and extent of the work, Railroad
agrees that reimbursement therefor shall be limited to costs covered by a change order having
approval of the Commission and Federal Highway Administration PRIOR to the performance
of the work.

4. City hereby agrees to cooperate in the handling of traffic during construction.
S. It is mutually agreed by the parties hereto that this project consists of rehabilitation
® of an existing grade crossing. Under the provisions of FHPM 6-6-2-1, Railroad has no liability
in connection with the cost of the rehabilitation of the crossing surface; however, for this project,
Railroad.agrees to assume 10% of the total cost. Commission agrees to reimburse Railroad for
9017o of the total cost of the work. It is further agreed that City has no liability in connection
with the cost of the rehabilitation of the crossing surface.
6. Commission shall, upon receipt of Railroad's final statement of costs and after a review
of the statement in relation to the work performed, reimburse Railroad for 95% of the amount
of Commission's obligation subject to final audit by Commission and/or Federal Highway
Administration. Upon completion of final audit, the Commission will reimburse Railroad for
the retained percentage of costs less any amount found through audit to be ineligible for
reimbursement. If audit reveals that Railroad has been overpaid, Railroad will immediately refund
to Commission such overpayment.
7. City,hereby agrees that Commission may accept the portion of the affected street or
® road as part of the State Highway System for purposes of administering the federal funds
committed to this project. Upon completion of the project, the portion of the affected road
or street shall revert to and become a part of the City road or street system.

General Specification
Construction of Highway-Railway Grade Crossings
1. The crossing material shall be either rubber or concrete of a type
meeting the approval of the railroad and the Highway Department.
The type and manufacturer of the crossing material shall be specified
In railroad's estimate.
20 New or high quality used rail and tie plates may be used, however,
all other material shall be new.
3. Track ballast, sub-ballast, and drainage pipes, if necessary, shall
be installed through the crossing to a point not less 'than 10 feet nor
more than 25 feet beyond the edge of pavement.
4. Filter fabric shall be placed where drainage problems are evident.
• 5. The crossing surface shall extend from edge to edge of highway
shoulder. The crossing material shall extend a minimum of one foot
outside the edge of pavement and the balance through the shoulders
constructed of asphalt or timber crossing material.
6. Rail less than 115 pounds shall not be used without approval of the
highway department.
7. Rail ends shall be welded to form continuous rail through the crossing
location. Rail joints shall be no closer than 30 feet outside the edge
of pavement.
S. The same type of crossing material shall be used for all tracks in a
multiple track crossing, unless circumstances justify an alternate
surface material.
9. Special track work may be granted if deemed justifiable by. the railroad
can ny and approved by the Highway Department.
10. The surface of the crossing shall meet the grade and elevation of the
roadbed surface. The elevation of tracks shall be adjusted if necessary
to meet and conform with .the established grade or the roadbed.
