ORDINANCE NO. 96,79
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT ON BE-
HALF OF THE CITY WITH EARL CONLEY, FOR THE PURCHASE OF REAL
ESTATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and the City Clerk of the City of
Jefferson, Missouri, are authorized and directed to execute a
Contract for the Sale of Real Estate on behalf of the City with
Earl Conley for the purchase of the following described real
estate located in the County of Cole, State of Missouri, to-wit:
The Northerly part of Inlot 760 in the City of
Jefferson, Missouri, beginning at the North
Westerly corner of said Inlot, thence Easterly
along Miller Street 104 feet 4 1/2 inches to
the Northeasterly corner of said Inlot, thence
Southerly along Easterly line 88 feet and 9
inches, thence Westerly parallel with Miller
Street 104 feet 4 1/2 inches to Cherry Street,
thence Northerly along Cherry Street 88 feet
and 9 inches to the place of beginning.
SECTION 2. The total amount expended for such purchase
shall not exceed Thirty Nine Thousand Two Hundred Eighty Four
and No/100 Dollars ($39,284.00) which shall include purchase of
property and all relocation expenses incurred therewith.
SECTION 3. This Ordinance shall take effect and be in .
force from and after its passage and approval.

Re: Earl Conley Property

® Gentlemen:
We have been attempting to purchase the Earl Conley property to provide
space for the bus garage. Throughout the negotiations there have been
the underlying questions of historic value, the age of the owner and, as
an added feature, the Ross law suit in the general area. All of these
things have made negotiation difficult and have led us to believe that
serious delay could occur because condemnation might be required.
Bob Cureton has reported to me on the present status of negotiation as
follows: All is agreed to except the owner has a garage now and has
selected a house with no garage. The owner wants a $3.,000 garage built
at the new location. This acquisition-relocation would not exceed
regulatory limitations even though the relocation (housing replacement
cost) were increased by $3,000. Cost would be $28,000 acquisition plus
$11,284 relocation totalling $39,284.
We could argue over Conley's selection of location but he stayed in
his general neighborhood as is his right. The house he is buying is
fairly priced and is appropriate in size. It is located at 1012 Marshall
Street.
The Conley property was appraised at $29,500 and $27,000 by two different
appraisers. A third appraiser, independent of the Housing Authority set
the value at $28,000. In a situation like this the Authority Board, on
Authority projects, may go to the highest appraisal without receiving
additional appraisals. In this case the Authority, considering the problems
enumerated in paragraph one above, would probably have gone to $29,500.

The question is then should the City•Council approve this purchase, relocation
and housing replacement cost at $39,284. The Housing Authority staff
recommends that this be done. The differential is $1,500 or, 5% of the
high appraisal.
We would ask that the Council act promptly in order to assure that 1012
Marshall remains available.
