IAN ORDINANCE OF THE CITY OF JF.'FFERSON, MISSOURI, VACATING AND
H DISCONTINUING AS A PUBLIC STREET AND A PUBLIC ALLEY CERTAIN PUBLIC
': RIGHT-OF-WAYS DESCRIBED HEREIN, RESERVING TO THE CITY AN EASEMENT
!: IN THE RIGHTS-OF-WAY VACATED FOR SANITARY SEWERS , SURFACE WATER
DRAINAGE, AND PUBLIC UTILITY PURPOSES, AND AUTHORIZING AND
DIRECTING THE MAYOR AND CLERK OF THE CITY TO EXECUTE ALL INSTRU-
MENTS REQUIRED.
WHEREAS, it has been shown to the City Council of the City
of Jefferson, Missouri, that owners of land adjacent to and
Iabutting the rights-of-way described herein have petitioned the
City Council to vacate said rights-of-way described herein as a
ipublic thoroughfare; and,
WHEREAS , it has further been shown that it would not incon-
Ivenience the public or the citizens of the City to discontinue

said rights-of-way as a public thoroughfare, subject to a reserva-
Ition in the City of an easement in that portion of said vacated
rights-of-way for the maintenance, repair, location, and reloca-
, tion of all sanitary sewer, surface water sewer or public utility
facilities now existing or hereafter to be constructed within
said rights-of-way;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
:CITY OF JEFFERSON, MISSOURI, AS FOLLOWS :
SECTION 1. The City Council of the City of Jefferson,
Missouri, hereby declares it necessary, reasonable and proper to
discontinue as a right-of-way for a public thoroughfare and
forever vacate the following described rights-of-way, subject to
the reservation in the City of the easement mentioned in Section
I2 of this Ordinance:

f+ The vacating and discontinuing as a public alley,
the portion of the alley right-of-way located in
Crandall's Addition and adjacent to Lot No. 4, in
Block No. 14 of Crandall' s Addition and Lot No. 5
in Block No. 14 of Wolff' s Subdivision. Said
portion of the north south 20 ' alley lying between

Hamlin and Berry Street right-of-ways and the South
right-of-way line of McCarty Street and the North
right-of-way line of an East-West 20 ' alley, between
McCarty and Miller Street right-of-ways.
AND
The vacating and discontinuing as a public street
a portion of the Mulberry Street right-of-way, located
adjacent to Inlot Nos. 439 , 443, 444, and 448. Said
I� portion of Mulberry Street lying between the South
right-of-way line of High Street and the North
right-of-way line of McCarty Street.
SECTION 2. The City of Jefferson, Missouri, does hereby ex-
1pressly reserve to itself, its successors, and licensees, and all
public utility companies within the City, an easement in, under,
over, and upon that portion of the rights-of-way as described in
Section 1 of this Ordinance for purposes of repairing, maintaining
servicing, locating, and relocating all sanitary sewer surface
water drainage and public utility facilities now existing or
hereafter to be constructed within said area.
SECTION 3. The statutory right of reversion in the owners
of the abutting property is hereby confirmed, subject to the
(j easement expressly reserved in Section 2 of this Ordinance, as
is provided by the laws of the State of Missouri and by operation
of this Ordinance said property shall revert to the adjoining
property owners.
1� SECTION 4. This Ordinance shall take effect and be in
' force from and after its passage and approval.
