Roll Call Present: Commissioners Henry, Kachel, Manning, Schinderle, Sobkov iak Absent: Commissioners Anderson, Gehrke Minutes The minutes from the July 16, 2002 meeting were accepted as presented. New Business CASE NO.: 998 -083002.V 1631 N. VAN DYKE ROAD (CHOBAR TOWING) Request: Zoning Variance (Public Hearing) Location: 1631 N. Van Dyke Road Applicant: Dave Chobar Commenced: 7:03pm Planner Sheetz gave the staff report. Commissioner Henry said that he understands that the railroad tracks behind the Towing complex provide a buffer, but, he asked Mr. Chobar, wou ldn’t the absence of a fence allow kids from the adjacent community to enter the site, thereby creating a safety hazard? Jim Chobar responded that there has never been a safety concern. There has never been a problem with children coming onto the propert y. Indeed, the area between his site and the residential area makes it very difficult to enter his site from that direction. Commissioner Schinderle asked Mr. Chobar if the cars sitting on his lot are locked, to which Mr. Chobar responded in the affirmat ive. Commissioner Kachel said that kids can get into trouble no matter what – whether a fence exists or not. If they really want to get into the area, they will. Commissioner Manning inquired about a citation that Mr. Chobar received from the Village on August 20 th . He asked what sort of action the Village took. Mr. Chobar explained that the reason for the citation was that at the time, not all of the fence surrounding the property had been constructed (it has since been completed) and that the gated e ntrance to the site did not prevent entry by foot onto the property. That has also been rectified. Chairman Sobkoviak asked if there were any other concerns that needed to be addressed. Commissioner Kachel moved to recommend approval of the variance wai ving the requirement of fencing along the eastern edge of the outdoor storage… for the property commonly known as 1631 N. Van Dyke Road (PIN 06 -03 -03 -408 -008), subject to the condition that “Should the elevated railroad be removed, fencing on the east prop ertry line shall be required” Chairman Sobkoviak called for a vote by roll call. Aye: Henry, Kachel, Manning, Schinderele, Sobkoviak Nay: None The motion is carried 5:0.
