Roll Call Present: Commissioners Kachel, McKay, Sobkoviak , David Murawski, and Ed O'Rouke Absent: Commissioners Henry and Renzi Mayor Waldorf swore in Ed O’Rourke and David Murawski as two new commissioners. Minutes The minutes from the May 16 , 2006 meeting was accepted as presented. New Business CASE: 1249 -051006.V 25234 ROUND BA RN COURT Request: Variance (Public Hearing) Location: 25234 Round Barn Court Applicant: Alvydas and Gitana Nakas Time: 7:13 pm Jonathan Proulx announced that this was a public hearing being held in accordance with all applicable rules and regulations of the Village of Plainfield and the State of Illinois. He read the staff report. Chairman Sobkoviak swore in Gitana Nakas who said she had wanted to build a ranch home. She had thought that the room would be enough, and now the architecture plans were alr eady made. Chairman Sobkoviak said that this looked to be a minor deviation from the ordinance and seemed reasonable. Commissioner Kachel asked if any of the adjacent owners had any comments, and Mr. Proulx said that one owner called for clarification bu t no concerns were vocalized. Commissioner O’Rourke confirmed that the applicant did not speak with the Walkers Grove Homeowners Association . Ms. Nakas also confirmed that she was aware that the lot was within the W alkers Grove subdivision. Keith Schuster was concerned that the 16 -feet would look like tunnel vision , and because of fires, he thought that there had to be a 20 -foot separation no matter what . Chairman Sobkoviak said that in some subdivisi ons there were different rules; in this particular subdivision, the original guideline was 20 -feet in various manners. He noted that other subdivisions had gone as low as 10 feet, but typically the standard was 20 feet. Mr. Schuster was also worried abou t selling his house . Ms. Nakas said that the plan was slightly adjusted so the wedge encroaching would be smaller . Mr. Proulx confirmed that the new plans were submitted, but the new sketch was not indicative of the change. Terri Wiborg addressed this c ommission and said that she b ought in because of the standards in the subdivision, but there were 445 homes in Walkers Grove and t his was not adhering to their standards. Janice Donnally addressed the commission and said that her concern was with the ranc h being set too far back . She felt that the applicant was t rying to put a larger property on a lot not accommodating for this. Mr. Proulx said that Staff requested that this be revised to m ove the building forward about five feet . Mr. Donnally asked wha t wa s going to be the separation from the edge of the house to the property line . Chairman Sobkoviak said that it would be three feet from setback and eight feet from the property line. Dena Furlow addressed the commission and wanted to say that, being i n real estate , she wanted the integrity of the home to match the neighboring homes. Commissioner O’Rourke asked if this would be compromised, and Ms. Furlow said that it could be . It was confirmed that the Staff had the architectural plans, and Mr. Proul x said that this he could share this with the homeowners. Commissioner Kachel asked how many houses were ranch in this subdivision , and it was determined that there were about four houses out of 445 that were ranch. Chairman Sobkoviak asked if there was a ny other public comment. There was no response. Commissioner McKay said that ranches generally require d wider lots to begin with, and sometimes when positioned next to a standard two -story, it could appear to crowd the lot li nes. Commission Kachel aske d about the pitch of the roof, and Mr. Proulx said that this was one of Staff’s consideration s. He said that a two -story home would create more shade/shadow; as well as the fact that there we re no windows on that side of the home. Commissioner McKay aske d about the possibility of a tandem two -car garage, and Mr. Proulx said that some options were looked at internally but no changes were requested . A discussion also ensued regarding fences. 2 ZONING BOARD OF APPEALS MINUTES JUNE 20, 2006 PAGE 3 Chairman Sobkoviak asked if the applicant was planning to remove any trees, and Ms. Nakas said that she was not sure . She said that she would have to look at the measurements, but if the trees could stay, she would keep them. Chairman Sobkoviak asked if there was any additional discussion or questions. Commissioner O’Rourke asked if the architect had done work in the Village before, and Mr. Proulx said that he had not been in contact with the architect, only the petitioner . Chairman Sobkoviak said that this did not amount to a lot. Commissioner Murawski asked about the architecture being reviewed , and a discussion ensued regarding this. Chairman Sobkoviak asked if the Homeowners Association had a uthority or control over this, and Mr. Proulx said that the Association could be m ore stringent but not less stringent. Chairman Sobkoviak confirmed that if this moved on, it would h ave to go before the Homeowners Association. Commissioner O’Rourke asked if the commission could approve this based on it going to the Homeowners Association before the Village Board . This was a possibility, and the other commissioners supported it. At 7:42, Commissioner O’Rourke moved to recommend approval of the requested variance from Section 9 -55(1) of the Zoning Code to permit an interior side -yard setback building separation of 16 feet i n lieu of 20 feet on the west property line of 25234 Round Barn Court subject to the stipulation that approval be received from the Walkers Grove Homeowners Association prior to going forward to the Village Board. Commissioner Murawski seconded the motion . Chairman Sobkoviak called for a vote by roll call. Aye: Kachel, O’Rourke, Murawski, Sobkoviak Nay: McKay The motion is carried 4:1:0. The n ext Village Board meeting wa s July 10, and Chairman Sobkoviak said that this needed to go in front of the Homeow ners A ssociation first. He also said that Staff would assist in this regard so to be in contact.
