Roll Call Present: Commissioners O’Rourke, Kachel, Renzi McKay, Murawski, Sobkovi ak Absent: Commissioner Henry Minutes Commissioner O’Rourke said that the first sentence of the last paragraph on page 2 should read: “Commissioner O’Rourke sympathized but could not vote on this based on the ordinance.” The minutes from the September 5 , 2006 meeting w as accepted as amended . New Business CASE: 1269 -090506.V Plainfield Congregational United Church Of Christ Request: Variance (Public Hearing) Location: 24020 W. Fraser Road Applicant: Jan King Time: 7:0 5 pm Jonathan Proulx announced tha t this was a public hearing being held in accordance with all applicable rules and regulations of the Village of Plainfield and the State of Illinois. He read the staff report. Chairman Sobkoviak swore in Janis King (Director of Appletree Preschool) who had been in this building since the 1960’s. She said that the door on the south side was used due to the closeness to the classroom and the handicapped entrance. She was asking for a carport to be put in for weather protection and safety. Jeff Churchero lo was also available for construction questions. He said that the pillars would be used as a buffer, and he asked if this was adequate. Mr. Churcherolo said that these we re 30 inches tall and 4 feet in diameter across. The space between the pillars was not wide enough for a car to fit through. He said that the pillars were also anchored into the ground with solid concrete. Chairman Sobkoviak opened up the floor for publ ic comment. There was no response. Commissioner O’Rourke asked if this was the main entrance to the preschool and church. Ms. King said that this was the main entrance for the preschool ; the church had another entrance, but this wa s used for handicapped . Commissioner O’Rourke asked if, during those times, traffic back ed up onto Fraser Road . Ms. King said that the cars zigzag through the lot instead of backing onto Fraser , and Commissioner O’Rourke confirmed access was from the west instead of the east . Commissioner Renzi said that, looking at this, Staff felt that of the four findings , two findings were met (b and d). His concern was that he wanted to get to three. He did not think A was a mark against the case but neutral. He compared Point C to th e cement planters by Central School. He felt that B, C, and D were met. If the first portion had been attached to the building, Commissioner Kachel said that it would be in harmony . Mr. Proulx said that the corner side yard regulated against this . Ch airman Sobkoviak said that Staff pointed out that unique conditions exist ed. T he V il l a g e had needed right -of -way , and this caused the building to encroach on the right -of -way . The unique condition was not self -imposed, and he said that t he safety conside rations were also important as it was being enhanced. Also, with the surroundi ng properties being commercial, he said that it was difficult not to be in harmony . Commissioner O’Rourke asked if there were any conflicts with the right -of -way. Mr. Proulx s aid that this was an 80 -foot right -of -way (larger than normal ) with anticipation of a signal, and a discussion ensued regarding this. Commissioner O’Rourke confirmed that the realignment had taken place. At 7:21pm, Commissioner Kachel moved to accept the Findings of Fact as outlined in the staff report and recommend approval of a variance to allow construction of an accessory building to be located in the corner side yard with a zero foot setback to the property line for the property commonly known as 240 20 W. Fraser Road . Commissioner Murawski seconded the motion. Chairman Sobkoviak called for a vote by roll call. Aye: Renzi, McKay, Kachel, O’Rourke, Murawski, Sobkoviak Nay: None Village of Plainfield Zoning Board of Appeals Minutes October 17, 2006 Page 3 of 3 The motion is carried 6 :0 :0. This would go forward on November 7. Ch airman Sobkoviak confirmed that there was no other business for the Zoning Board of Appeals.
