City of Jefferson, Missouri, and the Contractor, Prost Builders, Inc. , for the construction of the addition to the Municipal Garage, Capitol Avenue and Madison Street in the City of Jefferson. The Architect in the project is R. F. Verslues & Associates, Inc. The Owner and Contractor agree as set forth below. ARTICLE I THE CONTRACT DOCUMENTS. The Contract Documents consist of this Agreement, the Conditions of the Contract (General, Supplementary and other Conditions) , the Drawings, the Specifications, all Addenda issued prior to and all Modifications issued after execution of this Agreement, the Invitation to Bid, and the Instruction to Bidders. These form the Contract, and are all as fully a part of the Contract as if attached to this Agreement or repeated herein. An enumeration of the Contract Documents appears in Article 7. ARTICLE II THE WORK. The Contractor shall perform all the work required by the Contract Documents for the construction of the addition to the Municipal Garage, Capitol Avenue and Madison Street, including site preparation. ARTICLE III ® TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION. The work to be performed under this Contract shall be commenced within ten (10) days of receipt of notice to proceed and, subject to authorized adjustments, substantial completion shall be achieved not later than one hundred eighty (180) calendar days thereafter. ARTICLE IV CONTRACT SUM. The Owner shall pay the Contractor in current funds for the performance of the Work, subject to additions and deductions by Change Order as provided in the Contract Documents, the Contract Sum of Four Hundred Forty-Six Thousand Six Hundred Dollars ($446,600.00) . a � , ARTICLE V PROGRESS PAYMENTS. Progress Payments shall be made as provided in the Contract Documents. ARTICLE V1 FINAL PAYMENT. Final Payment, constituting the entire unpaid balance of the Contract Sum, shall be paid by the Owner to the Contractor when the work has been completed, the Contract fully performed, and a final Certificate for Payment has been issued by the Architect and approved by the Owner. ARTICLE VII MISCELLANEOUS PROVISIONS. 7.1. Terms used in this Agreement which are defined in the Conditions of the Contract shall have the meanings designated in those Conditions. 7.2. The Contract Documents, which constitute the entire agree- ment between the Owner and the Contractor, are listed in Article I and, except for Modifications issued after execution of this Agreement, are enumerated as follows: ADDITION TO THE MUNICIPAL GARAGE, CAPITOL AVENUE AND MADISON STREET (by R.F. Brose, P.E. , Director of T a t' tion DATE: August 13, 1982 RE: Change Order #1 - Addition to the Municipal Parking Garage While excavating for the ground floor of the new facility, the contractor found a section of existing footing on the News Tribune building which extended above the floor line of the new garage. This requires modification to the Tribune footing by removing approximately 1 k Cubic Yards of material off the existing footing. Based on our rock excavation figures, the enclosed recommended change order is reasonable. I recommend we give approval to this change order. Brose, P.E. , Director of Trans ortation DATE: August 26, 1982 RE: Change Order ##2 - Municipal Parking Garage, Riley Lot As per our conversation, I have reviewed the attached change order and recommend its approval. Fifty percent of the cost for this change order can be attributed to redesign of piers Al , B1 and B2. The piers were redesigned due to excessive ground water. The design change consisted of drilling into the rock approximately eight feet and placing expansive concrete in the rock socket to increase the allowable bearing pressure. The actual pier depth versus plan depths were very close. The additional pier work excavations were due to removal of old foundation concrete and variation of the rock table to the bottom of the pier. Roger has detailed information as to pier work removal at his office. Item #4 is an increase in cost of the two (2) inch copper water line due to an error in the scale shown on the plans. If you have any additional. questions please let me know, otherwise, forward the change order back to me and I will send the approved order to Roger. DEPT.
