I } AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING CHAPTER 23 OF THE CITY CODE BY DELETING SECTIONS 23-93(d) (1) ' AND 23-93(d) (2) , AND BY ENACTING FIVE NEW SECTIONS PERTAINING TO PARKING FOR THE HANDICAPPED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, i MISSOURI, AS FOLLOWS : Section 1. Chapter 23 of the City Code is hereby amended i; by deleting Sections 23-93(d) (1) and 23-93(d) (2) . �j Section 2. Chapter 23 of the City Code is hereby amended ii {� by enacting five new sections , which shall read as follows : i Section 23-107. 1 "Physically Handicapped" Defined. �i "Physically handicapped" as used in Sections - 07. 1 �j through 23-107. 5 shall include any person who has IIi permanently lost the use of one or both legs or one or I� both arms or any combination thereof, or any person �i who is so severely disabled as to be unable to move freely without the aid of crutches or a wheelchair. r Section 23-107. 2. "Unauthorized Use of Parking Space Desi nate or Handicapped". t shall be unlawful. to park a motor vehicle in a parking space which has been properly designated as a parking space for the handi- capped on private or public property unless the person operating or using the motor vehicle is physically 1 handicapped, or is transporting a person who is physically i handicapped. Section 23-107. 3. "Presumption of Compliance or Violation" . A person operating or using a motor vehicle which aC7 s attached to it a Missouri motor vehicle license plate for { the physically disabled, or which displays any other card or sign issued by the Director of Revenue for such ff purposes, shall be presumed to be utilizing such space i� in accordance with the terms of Sections 23-107. 1 through 23-107. 5 . A person operating or using a motor vehicle which does not display a Missouri motor vehicle license plate for the physically disabled, or which does not display any other card or sign issued by the Director of Revenue for such purposes , shall be presumed to be in violation of Sections 23-107 . 1 through 23-107. 5 . These presumptions shall be rebuttable and may be overcome by the individual charged or other parties submitting evi- dence to the contrary. i Section 23-107. 4. "Signs to Designate Parkin for Han ica a For the purpose o en orcement o Sections 23-107. 1 trough 23-107.5 , a parking space shall be con- sidered to be properly designated as a parking space for the handicapped if it is identified by a reasonably visible sign with green lettering and border on a white background upon which is inscribed the blue international wheelchair accessibility symbol and the words "Reserved Parking" { or words having a similar meaning.
