J-94Z AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , VACATING AND , DISCONTINUING AS PUBLIC THOROUGHFARES A PORTION OF FULKERSON jSTREET BETWEEN WEST McCARTY AND WEST MILLER STREETS AND A '(; PORTION OF WEST MILLER STREET BETWEEN FULKERSON AND U.S. 50-63, ,,, WHICH ARE BOTH MORE PARTICULARLY DESCRIBED BELOW, RESERVING TO THE CITY AN EASEMENT IN THE RIGHT-OF-WAY VACATED FOR SANITARY SEWER, SURFACE WATER DRAINAGE, AND PUBLIC UTILITY PURPOSES, AND ;: AUTHORIZING THE MAYOR AND CLERK OF THE CITY TO EXECUTE ALL NECESSARY INSTRUMENTS REQUIRED TO CONFIRM IN THE ABUTTING ' PROPERTY OWNERS THEIR RIGHT OF REVERSION IN THE VACATED AREA. I, WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri, that the owner of land adjacent to and abutting is upon a portion of Fulkerson Street between West McCarty and West z` Miller Streets in the City, has petitioned the City Council to vacate right-of-way as a public thoroughfare; and ! WHEREAS it has been shown to the City Council of the City of 1 iJefferson, Missouri, that the owner of land adjacent to and abutting is upon a portion of West Miller Street between Fulkerson and U.S. 50-63 �i in the City, has petitioned the City Council to vacate right-of-way as la public thoroughfare; and � j WHEREAS, it has further been shown that it would not incon- venience the public or the citizens of the City to discontinue as a �! right-of-way for a public thoroughfare such portions of the streets as jdescribed in Section 1 of this ordinance, subject to a reservation in �1 the City of an easement in that portion vacated for the maintenance, f i ` repair, location and relocation of all sanitary sewer, surface water sewer or public utility facilities now existing or hereafter to be constructed within said right-of-way, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: i i1' Section 1. The City Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as ±� p i a right-of-way for a public thoroughfare and forever vacate the If I'I following portions of Fulkerson Street between West McCarty and West Miller Streets and West Miller Street between Fulkerson and U.S. 50-63, subject to the reservation in the City of the easement mentioned in Section 2 of this ordinance: f � i �j I I f 1 i Part of the Northeast Quarter of the Northeast Quarter of Section 12, Township 44 North, Range 12 W, in the City of Jefferson, County of Cole, Missouri, more particularly de- scribed as follows: From the northeast corner of McCarty Street and Fulkerson Street; thence S 350 00' W, 156.3 feet to the southerly line of the existing Railroad Right-of-Way and the point of I beginning for this description; thence westerly along the southerly line of the Railroad Right-of-Way 25 feet, more or less, to a point 50 feet easterly of the centerline of i Industrial Drive; thence southwesterly 50 feet easterly of and parallel to the centerline of Industrial Drive on a curve to the left having a radius of 623.69 feet, to a point perpendicular to a right-of-way marker at a point 173 feet northerly of Station 760+00 U.S. Route 50; thence southerly in a direct line to a said point 173 feet northerly of said Station 760+00; thence easterly along the northerly line of said U.S. Route 50 Right-of-Way, to a point 150 feet northerly of Station 762+74; thence N 30° 08' 00" E, along the southerly extension of and along the easterly line of a i tract of land as described in Book 250, Page 499, Cole II County Recorder's Office, 80 feet, more or less, to a corner on the easterly line of said tract; thence N 130 10' 00" W along the easterly line of said tract and the northerly I� j; extension thereof, 132 feet to the point of beginning. Section 2. All of that portion of the above vacated property is li hereby retained as a perpetual easement or right-of-way for the construction, maintenance, repair, relocation and operation of sanitary !;sewers, surface water drainage, and all public utility facilities, and I;no permanent buildings or structures shall be located within or upon � i said easement without prior written consent of the City. Section 3. The statutory right of reversion in the owners of the II +i abutting property is hereby confirmed, subject to the easement express- 1ly reserved in Section 2 of this ordinance, as is provided by the laws i j.of the State of Missouri, and the Mayor and the Clerk of the City are 1hereby q authorized to execute all necessary instruments required to 1 confirm the reversionary rights of the owners of property abutting on i Ithe area vacated, as described in Section 1 of this Ordinance, in the right-of-way vacated. Section 4.
