AN ORDINANCE AMENDING ORDINANCE NO. 1362-18 WHICH
CALLED A SPECIAL ELECTION TO BE HELD IN THE CITY OF
RICHLAND HILLS, TEXAS ON TUESDAY, NOVEMBER 6, 2018 TO
SUBMIT TO THE VOTERS A PROPOSITION TO DETERMINE
WHETHER THE VOTERS DESIRE TO IMPOSE A SALES AND USE
TAX AT THE RATE OF THREE-EIGHTS OF ONE PERCENT (3/8%) TO
PROVIDE REVENUE FOR THE MAINTENANCE AND REPAIR OF
EXISTING MUNICIPAL STREETS AND A PROPOSITION TO
INCREASE THE SALES AND USE TAX FOR THE BENEFIT OF THE
TYPE B ECONOMIC DEVELOPMENT CORPORATION FROM THE
RATE OF ONE-EIGHTH PERCENT (1/8%) TO TWO-EIGHTHS
PERCENT (2/8%); BY CHANGING THE EARLY VOTING LOCATION;
RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH
ELECTION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by
the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local
Government Code; and
WHEREAS, on August 13, 2018 the City Council approved Ordinance No. 1362-18
calling a special election to allocate sales tax; and
WHEREAS, the Tarrant County Election Administrator cannot accommodate the
location for early voting designated in that ordinance; and
WHEREAS, the City Council finds it necessary to amend the ordinance to designate the
early voting location provided by Tarrant County.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1.
Section 5(a) of Ordinance No. 1362-18 is hereby revised to read as follows, with all other
verbiage in the ordinance to remain unchanged:
Section 5. Early Voting.
a. Early voting by personal appearance. Hieder Garcia, Tarrant County
Chief Elections Administrator, is hereby appointed as the Early Voting Clerk for
the election, as so indicated in the Contract. Early voting by personal appearance
shall commence Monday, October 22, 2018 and shall continue until Friday,
November 2, 2018. The main early voting site shall be as set forth on the list of
Early Voting Site attached as Exhibit A to this ordinance. Specific days, times

and locations shall be designated by the Elections Administrator and included in
the Contract and shall be in compliance with state law. On at least two weekdays
during the early voting period, the location for early voting shall be open for at
least twelve (12) hours as mandated by state law.
Section 2. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 3. Notice and Publication
This Ordinance shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the Special
Election. A copy of the Ordinance shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 4. Effective Date.
This order shall be effective upon its adoption.
PASSED AND APPROVED ON THIS 8TH DAY OF OCTOBER, 2018.

POR CUANTO, la Ciudad de Richland Hills es una cudad autonoma que actlia bajo su
estatuto adoptado por el electorado conforme al Articulo XI, Seccion 5, de la Constitucion de Texas, y
al Capitulo 9 del Codigo de Gobierno Local, y
POR CUANTO, el 13 de agosto de 2018, el Concejo Municipal aprobo la Ordenanza
N.° 1362-18 que convoca a una Eleccion Especial para asignar un impuesto a las yentas, y
POR CUANTO, el Administrador de las Elecciones del Condado de Tarrant no puede
alojar la ubicacion para la votacion anticipada designada en esa Ordenanza, y
POR CUANTO, el Concejo Municipal considers necesario modificar la Ordenanza para
designar una ubicacion para la votacion anticipada provista por el Condado de Tarrant.
POR TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE RICHLAND
HILLS, TEXAS, ORDENA:
Seccion 1.
Por la presente, se revisa la Seccion 5(a de la Ordenanza N.° 1362-18 para que su
contenido sea el detallado a continuaci6n, y el resto del texto incluido en la Ordenanza no se
modifica:
Seccion 5. Votacion anticipada.
a. Votacion anticipada en persona. Por la presente, se designs a Hieder
Garcia, Administrador Principal de las Elecciones en el Condado de Tarrant,
como Secretario de Votacion Anticipada para las elecciones, como indicado en el
Contrato. La votacion anticipada en persona comenzara el lunes 22 de octubre de
2018 y finalizara el viernes 2 de noviembre de 2018. El Centro electoral principal
de votacion anticipada sera el que se establecio en la lists de Centros de votacion
anticipada que se adjunta como Anexo A a esta Ordenanza. La Administracion

Electoral determinara las ubicaciones, los dias y los horarios especificos, que se
incluiran en el Contrato y que cumpliran con to dispuesto en la legislaci6n del
estado. Mientras dure el periodo de votaci6n anticipada, el Centro electoral de
votacion anticipada estara abierto, Como minimo, doce (12) horas durante al
menos dos dias de la semana, Begun to dispuesto por la legislacion del estado.
Seccion 2. Clausula de divisibilidad.
Por la presence, se declara que el Concejo Municipal tiene la intenci6n de que las
secciones, los parrafos, las oraciones, las clausulas y las frases de esta Orden Sean divisibles, y
que si alguna sentencia o decreto validos de un tribunal con jurisdicci6n competente declarara la
nulidad o inconstitucionalidad de alguna frase, clausula, oraci6n, parrafo o secci6n, dicha nulidad
o inconstitucionalidad no afectaran a ninguna de las frases, las clausulas, las oraciones, los
parrafos y las secciones restantes de esta Orden, dado que estos hubieran sido promulgados por
el Concejo Municipal sin la incorporaci6n en esta Orden de ninguna de dichas frases, clausulas,
oraciones, parrafos o secciones nulos o inconstitucionales.
Seccion 3. Aviso y publicacion.
Esta Ordenanza constituira la Orden de Elecci6n (segun to dispuesto por la Seccion 3.001
del C6digo) y el Aviso de Elecci6n (segun to dispuesto por la Seccion 4.001 del Codigo) para la
Elecci6n Especial. Al menos veintiun (21) dias antes de la elecci6n, se publicara una copia de la
Ordenanza en la tabla de anuncios que se utiliza para la publicaci6n de los avisos de las
reuniones del Ayuntamiento. El aviso se publicara en el peri6dico, de acuerdo con to dispuesto
por la legislaci6n del estado.
Seccion 4. Fecha de entrada en vigencia.
Esta Orden entrara en vigencia a partir del momento de su adopci6n.
