j AN ORDINANCE RELINQUISHING A CERTAIN EASEMENT FOR UTILITY!
PURPOSES OVER LAND LOCATED IN DIX ACRES SUBDIVISION IN JEFFERSONi
CITY, MISSOURI. j
l�! WHEREAS, by an easement dated September 24, 1982, and recorded

++ in Book 2'71 , Page 133, of the Records of Cole County, Missouri, a
! utility easement was granted to the City of Jefferson, a Municipal Corpor-i
ation, to excavate within, install, construct, maintain and repair strut
tures for the routing and conveyance of utilities in, under and through!
the lots, tracts or parcels of land described in Section 1 ;

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement
is surplus property of the City and is no longer needed for any public�
purpose:
A strip of land 10.0 feet of even width across the northeast frac-�
i tional quarter of Section 4 Township 44 North, Range 12 West, Cole
County, Missouri, the centerline of said 10.0 foot strip being more
particularly described as follows:
From the northwest corner of Lot #5, Dix Acres Subdivision, per
Plat of Record in Book 9, Page 31, Cole County Recorder's Office;(
thence S 50 55' E for a distance of 34.0 feet, to the point of begin-
ning of this description; thence deflecting 930 00' right for aI
distance of 20.0 feet, to the point of termination of this descrip
tion. ,
Also, an easement of an even width of 15.0 feet upon the landi
II located immediately adjacent to each side and extending the full
length of the 10 foot strip(s) of land described above, for th
initial construction and installation of the aforementioned sanitary
sewer facilities; provided that this additional easement shall,
expire and terminate upon completion of said sewer.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon whateve
interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to exe

cute any necessary legal document relinquishing all of the City's
interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect from
and after passage and approval.
