AN ORDINANCE RELINQUISHING A CERTAIN EASEMENT FOR UTILITY
(( PURPOSES OVER LAND LOCATED IN DIX ACRES SUBDIVISION IN JEFFERSON'
'I CITY, MISSOURI.

WHEREAS, by an easement dated September 24, 1982, and recordeds
t in Book 271 , Page 134, of the Records of Cole County, Missouri, a!
utility easement was granted to the City of Jefferson, a Municipal Corpor-j

ation, to excavate within, install, construct, maintain and repair struc-1
tures for the routing and conveyance of utilities in, under and through
the lots, tracts or parcels of land described in Section 1 ;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
1 JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement
is surplus property of the City and is no longer needed for any public)
purpose:

A strip of land 10.0 feet of even width across a part of Lot No.
i 5, Dix Acres Subdivision, per Plat of Record in Book 9 Page 31,
iCole County Recorder's Office; the centerline of said 10.0 foot strip
i being more particularly described as follows:
i
From the northeast corner of Lot No. 5, Dix Acres Subdivision;
thence South 50 55' East 106.0 feet, to the point of beginning ofl
this description; thence deflecti%$ 1500 00' right for a distance of
20.0 feet; thence deflecting 57 00' left for a distance of 90.0
feet, more or less, to a point on the westerly line of said Lot #51
and the point of termination of this description.
Also an easement of an even width of 15 feet upon the land)
located immediately adjacent to each side and extending the full
length of the 10 foot strip of land described above, for the initial
construction and installation of the aforementioned sanitary sewer
facilities; provided that this additional easement shall expire and
terminate upon completion of construction of said sewer.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon whatever
interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to exe-
cute any necessary legal document relinquishing all of the City's
i interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect from
and after passage and approval.
