No. #21 -128 Dale of Adoption July 8, 2021 AWARDING BID FOR THE 2021 ROAD IMPROVEMENT PROGRAM WHEREAS, the Borough has publicly advertised for the receipt of bids for the 2021 Road Improvement Program; and WHEREAS, the Borough has solicited and received seven (7) bid proposals for the 2021 Road Improvement Program Project as follows: Base Bid 1. S. Brothers, Inc. $900,280.00 2. Meco, Inc. $949,000.00 3. D.L.S. Contracting, Inc. $969,904.00 4. P.M. Construction Corp. $1,016,300.00 5. Black Rock Enterprise, LLC $1,020,000.00 6. Lucas Brothers, Inc. $1,053,053.00 7. Lima Charlie Construction $1,084,084.00 WHEREAS, S. Brothers, Inc., of South River, NJ has submitted the lowest bid for said contract as evidenced by the response oil file with the Borough's Purchasing Department and with the Borough Engineer; and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to S. Brothers, Inc., in a total amount not to exceed $900,280.00, per attached award letter; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said propose. Acct. # NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: I. That the appropriate Borough Officials are hereby authorized to enter into a contract with S. Brothers, Inc., of South River, NJ for the Project for the sum of $900,280.00 in accordance in all respects with the request for proposals and bid on same. 2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing Department, the Borough's Consulting Engineers CME Associates and the Borough's Director of Engineering. 3. That the aforementioned award of bid is contingent upon formal approval front the New Jersey Department of Labor, Division of Wage and Hour Compliance. 4. That the aforementioned award of bid is contingent upon NJDEP authorization. Adopted this 8t' day of July, 2021 and certified as a true copy of the original on July 9, 2021. A total of seven (7) bids were submitted, ranging from an apparent low base bid of $900,280.00 by S. Brothers, Inc. to a high base bid of $1,084,084.00 by Lima Charlie Construction, The Engineer's Estimate for the base bid was $1,032,000.00. Lima Charlie Construction $1,084,084.00 It should be noted that there were irregularities present in the low bid submitted, S Brothers, Inc., whose bid included mathematical errors in three (3) bid items. We believe that these irregularities are minor in nature and not a mandatory cause for rejection; therefore, the outcome of the bid is unaffected. As a matter of procedure, our office has contacted S. Brothers, Inc. to discuss their bid. The representative we spoke to indicated they are comfortable with the bid as submitted and there is no objection to completing the project based on the bid prices submitted and the contract time. Brothers, Inc. of PO Box 317, South River, NJ 08882, within 60 calendar days, on a unit price basis in the total amount of $900,280.00 for base bid items 1 through 46 inclusive, as available funding permits. The award should be subject to review and approval by the Borough Attorney, including concurrence to waive the minor irregularities, the review of the bid bond and surety from the low bidder, and submission of the required bonds and insurance certificates for the project. 2. Bids and bid securities of the second and third low bidder, Meco, Inc. and D.L.S. Contracting, Inc., be retained and held open, pending execution of the contract agreement by S. Brothers, Inc. 3. Return the bid securities of the remaining bidders. By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded to this office for further execution. We trust this is the information you require at this time.
