HomeMy Public PortalAboutORD07059 AN ORDINANCE DIRECTING THE MAYOR OF THE CITY OF JEFFERSON CITY, MISSOURI, TO EXECUTE ON ITS BEHALF A TWENTY (20) YEAR CONTRACT WITH MISSOURI POWER & LIGHT COMPANY FOR FURNISHING STREET LIGHTING IN SAID CITY OF JEFFERSON CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON CITY, MISSOURI, AS FOLLOWS: SECTION 1. The Mayor of the City of Jefferson City is hereby authorized and directed to execute for and on behalf of the City of Jefferson City, Missouri, the following contract, to wit: STREET LIGHTING CONTRACT THIS AGREEMENT, made and entered into this 20th day of March, 1961, between MISSOURI POWER & LIGHT COMPANY, a Missouri corporation, hereinafter called "Utility" , and the CITY OF JEFFERSON CITY, ISSOURI, a municipal corporation hereinafter called "Municipality" . [WHEREAS, Utility has agreed to furnish, maintain and operate a series street lighting system for the lighting of the public street in the City of Jefferson City, Cole County, Missouri. ITNE5SETH, that in consideration of the premises and of the mutual agreements hereinafter contained, Utility and Municipality do agree as follows: 1. Series Street Lighting System A. That Utility hereby agrees to provide and operat a street lighting system for the lighting of the streets, avenues and other public places in said Municipality. The location, number and sizes of the lamps to be installed and operated shall be as determined by Municipality within limits and subject to conditions as hereinafter set forth. B. Municipality agrees to pay Utility for street lighting service the amount due for lamps install d and operated under the following schedule of prices. EE IT THEREFORE RESOLVED that the Mayor of the City of Jefferson City, Missouri, be empowered to execute on behalf of said City. of Jefferson City, Missouri, an amendment to the above mentioned contract a copy of which muendment is attached hereto and made a part hereof. WITNESSETH, that in consideration of the premises and of the mutual agreements contained in the above mentioned street lighting contract and in this amendment, the parties hereto agree as follows: 1. That paragraph 1 B. of the said street lighting contract of March 20, 1961, is further amended to include the following statement. B. Municipality agrees to pay Utility •for street lighting service the amount due for lamps installed and operated under the following schedule of prices. *Rate Per Laing Per Year on Size,- Light Source Type Luminaire 18' Aluminum Poles 175 Watts/6,800 Lumen Mercury Vapor Closed Refractor $ 57.75 *Rate Per Lamp Per Year on 30' Steel Breakaway Poles 400 Watts/21,000 Lumen Mercury Vapor Closed Refractor $126.75 *Rate Per Lamp Per Year on 45' Steel Breakaway Poles 700 Watts/42,000 Lumen Mercury Vapor Closed Refractor $174.00 * .Price includes all night, every night service, cleaning of glassware and lamp renewals. Also, subject to the 20% discount as called for in paragraph 1 D. of the above mentioned contract dated March 20, 1961. 2. The parties hereto agree that all other paragraphs, namely 1, 1 A., 1 C. , 1 D., 1 E., 1 F., 1 G., 2, 3 and 4 shall remain as originally written or as previously amended and in full force and effect for the period set forth in the original street lighting contract. C. Any maintenance, other than cleaning glassware, and lamp renewals of Municipality' s owned or controlled street lighting system will be provided by Utility at Municipality' written request, at charges which the Utility normally I makes for such work. D. That Utility shall render a bill each month for one-twelfth (1/12) of the annual charge for the character of service furnished on all lamps installed, less a discounty of twenty (20) percent in accordance with Section 6 of Utility' s Franchise Agreement with Municipality. E. That Municipality may, be resolution duly adopted, order additional lamps installed in the street lighting system at any time of size and character as above provided for o as may be mutually agreed upon and Utility will furnish a d install such lamps at locations designated by Municipalit . When so ordered and installed, said lamps shall thereafte be paid for at the rates above provided and will become 'I subject to this contract. However, it any such additional lamp or lamps shall be required to be installed in the street lighting system at a greater distance than four hundred (400) feet from a then existing circuit, the Municipality shall reimburse t Utility for the additional cost of the installation thereof over and above the cost of installing a similar i� lamp or lamps at a distance of four hundred (400) feet �? from any existing lamp. �k
