AN ORDINANCE LEVYING A TAX ON THE GROSS RECEIPTS OF PERSONS,
FIRMS OR CORPORATIONS ENGAGED IN THE BUSINESS OF SELLING
WATER TO THE PUBLIC FOR THE PRIVILEGE OF CONDUCTING SUCH
BUSINESS IN THE CITY OF JEFFERSON, MISSOURI , AND USING AND
OCCUPYING THE STREETS AND PUBLIC WAYS OF SAID CITY WITH
DISTRIBUTION FACILITIES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI , AS FOLLOWS :
Section 1, Every person, firm or corporation engaged in
the business of distributing and selling water for residential,
commercial, business or industrial purposes in the City of
Jefferson and installing its mains, pipes, hydrants, appurtenances
or other facilities in, upon, over, across and under the streets,
avenues, alleys, bridges and other public places of the City of
Jefferson, shall pay to the City of Jefferson a tax equal to
five per cent (5%) of the gross receipts derived from such
business in said City of Jefferson as a tax for the use or
occupation of the streets, avenues, alleys, bridges and other
public places in said City by such person, firm or corporation.
When any streets avenue, alley, bridge or other public
place in, upon, over, across or under which any main, pipe,
hydrant, appurtenance or other facility of such person, firm
or corporation has been placed shall be graded, curbed, paved
or otherwise changed so as to make relocation or any change
in the existing installation of such mains, pipes, hydrants,
appurtenances or other facilities necessary, such person, firm
or corporation, its successors and assigns, shall make such
necessary change, but the cost of such change shall be paid
one-half (1/2) by such person, firm or corporation and
one-half (1/2) by the City of Jefferson; provided, however,
that before such person, firm or corporation installs any
main.. pipe, hydrant, appurtenance or other facility hereunder,
application shall first be made to the City Council for the

establishment of permanent grades, curb lines and sidewalk
lines unless permanent grades, curb lines and sidewalk lines
have already been established, and then shall install such
mains, pipes, hydrants, appurtenances and other facilities
in accordance with such permanent grades and lines. The City
of Jefferson shall promptly establish such permanent grades
and lines upon such applications, and such mains, pipes,
hydrants, appurtenances and other facilities shall not be
installed until such grades and lines shall have been
established.
All funds received from this tax shall be used as follows:
(a) Two-fifths (2/5) of the funds derived from said
tax shall be placed in the Park Fund to be used exclusively
by the Park Board for the purchase, acquisition, development,
maintenance, supervision and direction of parks, play grounds
and recreational facilities.
(b) One-fifth (1/5) of the funds derived from said
tax shall be placed in the Municipal Airport Fund to be used
exclusively by the City Council for the acquisition, development,
extension, maintenance, supervision and direction of the city
airport and its facilities.
(c) Two-fifths (2/5) of the funds derived from said
tax shall be placed in the General Revenue Fund of the City
and used for such purposes as other monies in said fund.
Section 2. It is hereby made the duties of those persons$
firms or corporations mentioned in Section 1 hereof to file
with the City Clerk of the City of Jefferson on or before the
15th day of January, April, July and October of each year a
statement of the gross receipts of such person, firm or
corporation from such business for the three calendar months
immediately preceding the date of the statement, clearly

showing the gross receipts of such person, firm or corporation
from the operation of its business. Such statement shall be
verified by the affidavit of the person, firm or corporation,
by the principal officer thereof, and the first statement shall
be filed on the 15th day of October, 1961. At the time of
filing the initial statement required, the person, firm or
corporation shall pay to the City Treasurer of the city of
Jefferson, an amount equal to five (5%) per cent of the gross
receipts shown by the statement filed.
Section 3. The tax herein required to be paid shall be
a tax on and for the use and occupation of the streets,
alleys and other public highways of the City of Jefferson
for the pipe lines and wires of the distributing system of
the persons, firms or corporations mentioned in Section 1
hereof, and nothing herein contained shall be so construed as
to exempt any such person, firm or corporation from the
payment to the City of Jefferson of the tax which the City
of Jefferson levies upon any real or personal property,
including Ad Valorem taxes, belonging to any such persons,
firms or corporations.
Section 4. Should any person, firm or corporation
mentioned in Section 1 hereof fail to file the statement
or pay the tax as provided for in this ordinance by the date
due, the said person, firm or corporation shall be penalized
in an amount of ten (10%) per cent of the amount of the tax
then due for the failure to file the statement or pay the
tax when due, which penalty shall be payable to the City of
Jefferson.
Section 5. The first installment for the tax provided
for herein shall be due and payable on the 15th day of
October, 1961, for the calendar months of July, August and
September, 1961.

Section 6. Subparagraph 92 of Section 564 of the
ti Revised Ordinances of the City of Jefferson, Missouri,
levying a tax on pompanies furnishing water, in the amount
of $750.00 for the privilege of doing business in the City
of Jefferson is hereby repealed.
Section 7. This ordinance shall take effect and be in
force as of July 1, 1961) upon its passage and approval.
