HomeMy Public PortalAboutORD07128 y i ORDINANCE NO. 7128 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF JEFFERSON, MISSOURI, TO EXECUTE A CONTRACT WITH THE STATE HIGHWAY COMMISSION OF MISSOURI RELATING TO THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A SCHOOL CROSSING SIGNAL AT THE INTERSECTION OF ROUTE SO AND BROADWAY STREET IN JEFFERSON CITY, MISSOURI. BE IT ORRAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI$ AS FOLLOWS: Section, I# The Mayor and the City Clerk of the City of Jefferson, Missouri, are hereby authorized and directed for and on behalf of said city to execute a contract with the State Highway Commission of Missouri relating to the t construction$ maintenance and operation of a school crossing signal at the intersection of Route # 50 and Broadway Street in Jefferson City, Missouri. Section 2. Said contract shall be in words and figures . as follows: CONTRACT FOR SCriOOL CROSSING SIVAL This Agreement entered into, in quadruplicate, this First day of September , ly 61 -, by and between the State Highway Commission of Missouri, hereinafter known as the party of the first part, and the City of Jefferson City , Cole Countyp Missouri, hereinafter known as the party of the second part., WITNESSETH; 1. The party of the first part, does hereby authorize the installation of a school crossing signal on Route 50 , near the St. Peter's School at the intersection of Name of School Route 50 , and Broadway Street or Avenue, in the City of . Jefferson City , Cole County, Missouri 2e The Signal shall be of Standard Construction meeting State Highway Department Standards, and shall consist of a Pedestal. Signal type of Signal with Four (4) Two-wa five-section adjustable Signal Heads (Type of Head) Four (4) Neon type Pedestrian Signal Heads and Manual Control Type of Control And Manual Control Switch Type of Switch • 3. The cost of signal, appurtenances, materials, installation, maintenance and electric current, shall unless otherwise specifically stated, be borne by said first and second parties as herein set out. -2- 4. 100 per cent of the cost of the signal., appurtenances, materials., ® installation together with the total cost of maintenance shall be borne by said party of the first part, the furnishing of electric current shall be borne by said party of the second part, 5. In consideration of the authorization of the installation of the signal by said party of the first part, said party of the second part agrees to operate the signal in accordance with the schedule herein set out, subject to any changes or amendments, said party of the first part may deem advisable from time to time. 6. The operation of the signal shall be under the direct supervision of the Police Department of Jefferson City Cole City County, Missouri, and/or the Principal of the School concerned with this installation. 7. Schedule of Operation Morning - On 7:15 A.M. - Off 8:15 A.M. Noon - On Not needed A.M. - Off Not needed p.M. Afternoon - On 3:00 P.M. - Off 3:15 P.M. 8. The operation of the signal shall be performed at all times in accordance with the schedule herein set out, by an adult person or persons so designated by the Police Department and/or the School Principal. At the end of each off period as shown in "Schedule of operation", the signal shall be lockdd in "Off" position, and the key to the control box shall be placed in the custody of the -3- individual so authorized to possess same. In the "Off" position, the signal shall revert to the sequence in operation, being controlled by the Master Controller for the traffic adjusted signal system which is in place on the Rex M. Whitton Expressway. 9. Notice of the crossing schedule shall be sent to parents of all school children using this crossing with the request that they instruct their children to comply fully with the directions given by the person or persons designated to supervise the scheduled crossings. 10. Every possible effort shall be made by the person or persons operating the signal to avoid inconveniencing vehicular traffic any more than necessary, but to exercise every precaution to avoid endangering the pupils while crossing the highway. 11, The State Highway Commission can in no way guarantee safe roadway crossing for any pedestrian, adult or child and this contract is written for the purpose of giving children the maximum protection for crossing busy travelways. Unnecessary stopping of vehicular traffic increases the traffic hazard and schools the drivers to disregard school signals when they are not properly used. The schedule set out is based on a survey of this school crossing to meet reasonable needs and it is the responsibility of the parents and School Officials to see that the children use the crossing in accordance with the instructions of the person designated to operate signal. 12. It is expressly understood than, if said party of the second part shall fail to fully comply with the regulations as set forth or the instructions issued by said party of the first part, or its authorized representative, said party of the first part shall have the right r r • r�r to remove the school crossing signal.
