HomeMy Public PortalAboutORD-CC-1995-02ORDINANCE NO. 95-02 AN ORDINANCE AMENDING THE MOAB CITY CODE TO PROVIDE FOR AN INCREASED LICENSE FEE ON ALL BUSINESS LICENSES ISSUED TO MOTELS, HOTELS, INNS, CAMPGROUNDS, RV PARRS, BED AND BREAKFASTS AND ANY OTHER BUSINESS PROVIDING OVERNIGHT ACCOMMODATIONS WITHIN MOAB CITY. WHEREAS the City has determined that businesses which provide overnight accommodations including, but not limited to, hotels, motels, inns, Bed and Breakfasts, RV parks, campgrounds and other businesses that provide overnight accommodations are a distinct business class from other businesses; and WHEREAS, the City has determined that the hotels, motels, inns, Bed and Breakfasts, RV Parks, campgrounds and other businesses that provide overnight accommodations place a greater burden on Moab City's infrastructure, police and fire services than other businesses; and WHEREAS, the City has determined that such businesses place a greater burden on the City's sewer and water services than other businesses; and WHEREAS, the City needs to expand its sewer system and wishes to finance some of the expansion from business license fees from those businesses which have the greatest impact on the sewer system; NOW, THEREFORE, BE IT ORDAINED BY MOAB CITY as follows: Chapter 5.08.110 E of the Moab Municipal Code is amended to read as follows: A fee equivalent to 2.51 percent of the gross revenue derived from the rent for each and every occupancy of a suite, room or rooms from every person, company, corporation, or other like and similar persons, groups, or organizations, doing business in the City as motor courts, motels, hotels, inns, trailer courts or like and similar public accommodations. For purposes of this section, gross revenue shall be computed upon the base room rental rate. There shall be excluded from the gross revenue by which this fee is measured: 1. The amount of any sales or use tax imposed by the State of Utah or by any other governmental agency upon a retailer or consumer: 2. The amount of any transient room tax levied under authority of Chapter 31 of Title 17, Utah Code Annotated, 1953, as amended, or its successor. THIS ORDINANCE SHALL TAKE EFFECT ON JULY 1, 1995.
