The regular meeting of Council W e,Ihe1 _tb4day at 1-:30 P.M., in the Town office and was attended by Mayor Righton, who presided, and Councilmen May, Young, Logan and Haar and Town Attorney Dutton. KJ :letter was read from Councilman Cann tendering his resignation as Councilman to take effect immediately, Mayor Righton stated that the Town was losing a valueable officerwho at all times was intensely interested in the developement of the island and who gave a great deal of time to it for the past twenty years it had been a distinct pleasure to have worked with him and he regretted to see him sever his connection with the Board. Councilmae Haar moved-that a committee be appointed to call upon Couneirjian t' request him to reconsider, Councilman Young seconded and the motion passed. The Mayor appointed Councilmen Logan,Young, and Town Attorney Dutton. Mr. R.L.Cooper presented a moziac aerial map of Savannah Beach which way up to date and stated that he was offering it to the M Town for 40.00, Councilman Young moved that it be purchased, Councilman Haar seconded and the motion passed. Councilman Haar moved that 2 legnths of D,7J fire hose be purc- hased for the fire dept at not over 4p10O.0G, Courc11men 'Found seconded and the motion passed. The Estate of F.H.Haar againsL the CRR and the Town seeking to recover a strip of land that was part of the right of way of the CRR on the old Estill tract, wkich the Town purchased from the CRR. Town Attorney Dutton was of the opinion that the strip of land in uestion belongs to the estate of F.H.Haar. Councilman Logan moved that the Town Attorney be authorized to adjust the matter with the Haar Estate, Councilman Yound sec- onded and the motion passed. In the matter of Mrs Aline W.Campbell who was injured last sum- mer at the head of 15th street and who has institutdd a claim for damages. Councilman Young moved that the Town Attorney be authorized to settle the matter for not more than $100.00, Councilman Logan seconded and the motion passed. In the suit of Otto Schultz, thru E.Krondtadt, attorney, the Town Attorney informed Council that a 6ity Court judgment had been awarded to Mr. Schultz, Mrs. Sc #ultz'e ca -e had not been tried as yet, he had been instructed to take Otto Schultz's case to the Court of Appeals,where the chance of having the judgment of the City Court reversed was veryremote; he stated that he had discussed the matter with several attorneys and his opinion was that after having talked with Mr. Krondstadt, the Town settle for 4875.00 which would settle Mr. Otto Schultz's case and also the proposed suit of Mrs. Lillian Schultz, Coun- cilman Logan moved that the Town settle for $875.00 for sny claims that Otto and Lillian Schultz may have again -t the Town, Councilman Haar seconded and the motion passed. Mrs. B.F.Kendall, executor of the Est. I.M.Fischer,sr., request- ed that she be allowed the discount on taxes due, Councilman 1 2 Haar moved that 10% discount be allowed on all back taxes and and 20% be allowed on 1939 taxes provided that all taxes are paid in full and within thiry days, Councilman Logan seconded and the motion passed. Councilman Young moved that 20% discount be allowed on 1939 taxes of George J.Dieter, (Van Trump) provided they are paid within 30 days, Councilman Logan seconded and the motion passed. Councilman Haar moved tgat the Puritan Chemical Co., he paid $50.00 on account of the purchase of disenfectant in QQt. 1938, amounting to $123.75,Councilman Logan seconded and the motion passed. The Mayor appointed Councilmen Logan, Young, May and Haar as a Committee on the Town Hall. Councilman Young informed Council that he had handled the matter heating the Town Hall with the Howden Coal Co., and was given a price of $ 6.00 to complete the installation of the heating system, test it, make it ready to operate, the cost of operation would be between $50.00 and $60.00 per month if the entire build- ing was heated. Councilman Logan moved that the brown mule owned by the Town be sold for 175.00, Councilman May sec onded and the motion passed. HehryaMsBuckley, as a property owner, protested against the un- reasonable rates and regulations imposed oD water users by the Tybee Waterworks, he stating that recently desired to move into a cottage other than the one occupied by him, and which cottage had been closed since May let, 1939, no water being used, and he could no do so because the TWW trould -.not not permit him to do so unless he paid a full years charge for water service and then only to April 30th, 1940. Received as information. Councilman Young moved that the following resolution be adopted, Councilman Haar seconded and the motion passed; RESOLUTION. BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, in Council assembled; WHEREAS, on the 7th day of November, 1938, by a resol- ution adopted by the Mayor acid Councilmen of the Town of Savannah Beach, Tybee Island., the Mayor ofssaid municipality was authorized to convey to the United States of America the following described property, to -wit: All that certain lot, tract or parcel of land lying and being within the limits of Savannah Beach, Tybee Island, Georgia, in Chatham County, State of Georgia,oand more partic ularly described as follows: a strip of land. three hundred and twenty (320) feet wide between parallel lines extending from Bay Street in said Savannah Beach northward to the Savannah River. The westward boundary line of said strip to be an extension of the westaward line of lot number Six (6) in block number Two (2). The eastward boundary line of said strip to )e a line parallel with and twenty(20) feet eastward from the eastward line of Stone Street. AND WHEREAS, on the 6th day of February, 1939, the Honor able J.E.McMillan, then Mayor of the Town of Savannah Beach, Tybee Island, conveyed to the United States of America the fol- lowing property to -wit, to -wit: 1. All the certain lots, tracts or parcels of land ly- ing arid-:,being in the State of Georgia, Ccutty..:of Chatham, on Tybee Island, known and designated on the map orpplan of the Town of Tybee (now Savannah Beach) made by Percy Sugden, C.E., "Juoy 20th, 1928, as lots numbered Eight A (8 -a) and Eight B (8 -b) of block Two; Bay Ward, said lotd lying contiguous and hating a combined frontage of one hundred eighty (180) feet, more or less, on the west side of Stone Street, a frontage of eighty (80) feet, more or ]less, on the north side of Estill Avenue, and being bo,Jnded on the north by Bay Street, on the east by Stone Street, on the south by Estill Avenue, and on the west by lot numbered Seven (7) of block Two (2), Bay Ward; als8 2. All that certain lot, tract or parcel of land lying and being in the State of Georgia, County Of Chatham, on Tybee Island,opposite to lots numbers Six (6), Seven (7), and Eight (8) in block Two (2), Bay ward, to lot number One (1), in block Three (3),•Bay Ward, and to a street sixty (60) feet in width known as Stone Street, said lots and street being known and designated on ammap or plan of the Town of Tybee ( now Savannah Beach) made by Percy Sugden, C.E., Juoy 20th, 1928, the southerly side of sa&d lot or parcel of land being three hundred fifty (350) feet, more or less, in width, bounded by a street known as Bay Street, seventy -five (?5) feet in width said Bay Street separating said lot or parcel of land from the lots aforesaid; and the western and eastern sides of said lot or parcel of land being projections of the western side of said lot number Six(6) and Offthe eastern side of lot number One (1) aforesaid, each beginning at said street seventy -five (75) feet in width, and extending northwardf.y to the low water mark of Savannah River. AND, WHEREAS, the following property was by inadvertence not included in the aforementioried resolution: L. All that certain lot, tract or parcel of land lying and being within the limits of Savannah Beach, Tybee Island, Georgia, in Chatham County, Georgia, and more particularly described as follows: a strip of land thirty (30) feet wide between parallel lines extending from Bay Street in Savannah Beach northward to the Savannah River, the eastern boundary line of said strip be- ing a projection of the eastern line of lot No. One (1) of block Three (3), By Ward, and the wbstern boundary line of said strip to be a line parallel with and twenty(20) feet east- ward from the eastern line of Stone Street. AND WHEREAS, the Mayor and Councilmen are desfrous of rat- ifying and approving „ by resolution, the conveyance made b$ Mayor J.E.McMillan on February 6, 1939. NOW THEREFORE BE IT RESOLVED by the authority aforesaid t at the conveyance made by Mayor J.E.McMillan on the 6th day of February, 1939,to the United States of America be and the same is hereby approved and his actions are ratified as though the followingproperty was included in the resolution of Council passed on the 7th day of November, 1938: 1. All that certain lot, tract or parcel of land ;ying and being in the State of Georgia, County of Chatham, on Tybee Island known and designated on the map or plan of the Town of Tybee (now Savannah Beach) made by Percy Sugden, C.E., July 20th, 1928,as lot numbered One (1) of block Three (3) Bay Ward, said lot having a frontage of nienty (90) feet, more or less, on the east side of Stone Street, and a frontage of fifty (50) feet, more or less, on the south side of Bay Street, and being bounded Om follows: on the north by Bay Street, on the east by lot numbered Two (2) of block Three (3), Bay Ward, on the south by lot numbered Ten (10) of block Three (3), Bay Ward, and on the west by Stone Street; also 3. A special.meeting of Council was held to -day at 4:30 p.m., in the Council Chamber, at Butler Avenue:, and 15th Str,eet., and was attended by Mayor Righton, who presided, and°Councilmen Logan, Vay, Young, and Haar and Town Attorney Dutton. Mayor Righton asked for a report Deem the Committee appointed to call off Councilman Cann, Councilman Logan speaking for the Committee stated that Councilman Cann informed the Committee that he had. given very thoughtful consideration to the request that he reconsider withdrawing his resignation as Councilman, but es was getting along in life and had to .carry on the burden of the firm, he felt that the resignation would have to stand, he was always interested in the welfare of Tybee and would be glad to help whenever called upon. Councilw..n Young moved that Councilman Cann's resignation be accepted and that a Committee be appointed to draw up a proper resolution covering his long term of office as Councilman; Councilman Haar seconded and the motion passed unanamously: RESOLUTION.
