Roll Call: 2. Approval of Agenda: Minutes of April 10, 2013 Commissioner Smith moved, and Commissioner Soles seconded the motion to approve the Agenda. Motion carried: 6-0. 3. Open Forum: 4. Public Hearing/Action Items a. Subdivision Exemption —Amended Lot 32, EMF1 Commissioner Smith moved, and Commissioner Shapiro seconded the motion to open the public hearing regarding Subdivision Exemption —Amended Lot 32, EMF1. Motion carried: 6-0. This application is being processed as a Subdivision Exemption in accordance with Section 17-3-10 of the Fraser Municipal Code. The Code states that certain divisions of property may be exempted from the requirements of this Chapter if the activity meets the following condition(s): the division does not result in the creation of an additional lot and/or the division is for the purpose of revising lot lines, only if it creates no more than the prior recorded number of lots, and if such exemption is approved by the Board of Trustees. The applicant is Rainsford A. Brown III, represented by Kent Whitmer. Mr. Brown owns Lot 32, EMF1 and has Lot 30, EMF1 under contract. There is currently an existing single family dwelling on Lot 32. Mr. Brown is requesting approval of this subdivision exemption plat in order to vacate the lot line and combine both lots into one new lot. Please see Kent Whitmer's letter detailing this request. Page 2of2 We have received a letter from the Rendezvous Homeowners Association approving the combining of the two lots with a couple of conditions. We are working on some language to incorporate these conditions into plat notes. The applicant is agreeable to add such plat notes. Commissioner Sumrall moved, and Commissioner Shapiro seconded the motion to close the public hearing regarding Subdivision Exemption —Amended Lot 32, EMF1. Motion carried: 6-0. Commissioner Smith moved, and Commissioner Shapiro seconded the motion to approve Resolution 2013-05-01 approving the Subdivision Exemption —Amended Lot 32, EMF1. Motion carried: 6-0. 5. Discussion and Possible Action Regarding: a. Sign Code Article 10 of the Fraser Municipal Code entitled, Signs and Outdoor Advertising Devices. If you remember, we had a request from a Town Board member to revisit the Fraser Sign Code and prohibit off-premise signage. The reason is that it is his belief that such signage is ineffective and uncontrollable. I did send out a planner listsery on the topic and discovered that many Colorado communities do not allow off-premise signs. We are working on some proposed language that we will present at the PC meeting. See Section 16-10-170 (c), page 16-99 regulates off-premise signs: "Off-premise signs may be permitted if the business street frontage is not on U.S. 40. Property owner's permission is required and off-premises signs must be approved by the Board of Trustees on a case-by-case basis." The Planning Commission discussed allowing off premise sandwich boards for special events. Other off-premise signs still need to go before the Board for approval. b. Zoning Regulations During the Byers Peak Ranch annexation process, it was discussed with the Annexation Committee and the applicant that there appears to be some duplication in the Town's regulations relating to zoning requirements. We wanted to initiate a discussion regarding changes the Business Zone and Planned Development District regulations to provide for a more streamlined process without duplication. 6.
