AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT
WITH ROBERT H.LIVINGISTON AND DOROTHY L. LIVINGiSTON
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and the City Clerk of the City of Jefferson, Missouri,
are hereby authorized and directed to execute for and in the name of the City an
Agreement with Robert H. Livingston and Dorothy L. Livingston, his wife.
Section 2. Said agreement shall read in words and figures as follows:

AGREEMENT
This agreement is hereby made and entered into by and between the City of
Jefferson, Missouri, a municipal corporation, hereinafterwards referred to as
the "City", and Robert H. Livingston and Dorothy L. Livingston, husband and
wife, WITNESSETH:
1. The City does hereby agree to release, convey and quit-claim unto
Robert H. Livingston and Dorothy L. Livingston, his wife, all right, title and
interest in and to the following easements:
(1) All of that portion of a ten foot sanitary sewer and surface
water drainage easement lying north.and west of the southeasterly
line of Lot 8 of Block 6 of West Hills Subdivision as said easement
appears in a plat of West Hills Subdivision of record in Plat Book 5,
at Page 53, of the Cole County Recorder's Office.
(2) All that portion of a 30 foot sanitary sewer and surface
water drainage easement lying northwesterly of Livingston Street,
as said easement appears in a replat of part of Lot 7, part of Lot'4,
Lot 5, Lot 6, of Block 3 of West Hills Subdivision, said replat
appearing of record in Plat Book 6, at Page 57, Cole County
Recorder's Office.
(3) All sewer right-of-way and surface water drainage easements
heretofore conveyed by Robert H. Livingston and Dorothy L. Livingston,
his wife, as recorded in Book 173, Page 457, and Book 173, Page 455,
in the Cole County Recorder's Office over the following described land:
A part of Lots 3, 4, 5, 11, 12 and 13, Block 4 West Hills
Subdivision as of record in Plat Book 5, Page 53 Cole County
Recorder's Office; being a strip of land 20 feet of even width the
centerline of which is more particularly described as: Beginning
at the southwest corner of Lot 4, Block 4, West Hills Subdivision,
thence northerly along the westerly line of said Lot 4, Block 4, 109
feet; thence turning an angle to the right of 74 degrees 30 minutes,
98 feet; thence in a direct line to a point on the southerly right-of-way
line of Livingston Street, said point being 37.5 feet westerly of the
northeasterly corner of Lot 13, Block 4, West Hills Subdivision.
2. Robert H. Livingston and Dorothy L. Livingston do hereby agree to sell,
convey and quit-claim the following described easements for sanitary sewer and
surface water drainage purposes to the City of Jefferson, Missouri:
(1) A part of Block 6, Block 4, and Block 3 of West Hills
® Subdivision as per plat of record in Plat Book 5, Page 53, Cole County
Recorder's Office, being a strip of land 35 feet wide and lying 20 feet
on the northeasterly side and 15 feet on the southwesterly side and
parallel to a line more particularly described as follows:

From the southwest corner of Lot No. 8, Block 6, of West Hills
Subdivision; thence northeasterly along the southerly line of said Lot
No. 8, 15 feet, to the point of beginning; thence northwesterly parallel
with the southwesterly line of Lot No. 8 of Block 6 and the southwesterly
line of Lots 4 and 12 of Block 4, and the extension of said line, to the
northwesterly line of West Hills Subdivision.
(2) A part of Block 6 of West Hills Subdivision and part of Livingston
Heights Subdivision to the City of Jefferson, County of Cole, Missouri:
A strip of land 30 feet wide and lying 15 feet on either side of
and parallel to a line more particularly described as follows:
From the southwest corner of Lot 1, Block 6, of West Hills
Subdivision, northerly along the westerly line of said Lot No. 1, 18.8
feet to the point of beginning; thence south 670 10' East 188.89 feet;
thence south 500 10' east 229.4 feet to a point on the northerly line
of Marilyn Street, as perplat of record in Plat Book 5, Page is, in
the Cole County Recorder's Office.
3. The City agrees to back fill the drainage ditch excavated by Robert H.
® Livingston within the second and third easements mentioned above, which the City
herbinabove has agreed to release--all within thirty days from the date of this
instrument, weather permitting.
4. The City agrees to pay Robert H. Livingston and Dorothy L. Livingston,
his wife, in consideration of the foregoing the sum of Five Thousand Six Hundred

Forty-serMght and-M/100 Dollars ($5,649:1246).
5. The Mayor and other officers of the City are hereby directed to sign and
execute quit-claim deeds conveying the above easements to Robert H. Livingston
and Dorothy L. Livingston, his wife, and to deliver the same to them; and Robert
® H. Livingston and Dorothy L. Livingston, his wife, agree to convey the above-named
easements to the City by quit-claim deed and deliver such deed to the City.
IN WITNESS WHEREOF, the parties do hereby set their hands and seals this
23rd day of May, 1962.

Section 3. The Mayor and the City Clerk of the City of Jefferson are hereby
authorized and directed to sign legal instruments conveying the above-described
easements to Robert H. Livingston and Dorothy L. Livingston and to deliver said
instruments to them upon receipt of legal instruments conveying the easements above
mentioned which said parties have agreed to convey to the City.
Section 4. This ordinance shall take effect and be in force from and after its
passage and approval.
