AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING
ORDINANCE NUMBER 6461 OF SAID CITY AND ORDINANCE NUMBER 6000
(BEING SECTIONS 413-429 OF THE REVISED ORDINANCES OF THE CITY
OF JEFFERSON, 1956) OF SAID CITY RELATING TO THE POLICE
DEPART141ENT, AND ENACTING A NEW ORDINANCE PERTAINING TO THE
SAME SUBJECT, PROVIDING FOR THE NUMBER OF PERSONNEL IN THE
POLICE DEPART14ENT, VARIOUS GRADES IN RANK AMONG THE PERSONNEL,
THE QUALIFICATIONS, DIETHOD OF SELECTION, APPOINTMENT, TERM OF
OFFICE, REMOVAL AND DUTIES OF THE PERSONNEL
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. Ordinance Number 6461 and 6000 (being Sections
413-429 of the Revised Ordinances of the City of Jefferson,
Missouri, 1956) relating to the police department be, and the
same are hereby repealed.
Section 2. Police Department. Personnel. The police
department of the city shall consist of e Mief of Police,
two Police Captains, one Lieutenant-Detective, four Police
Sergeants, two Police Corporals, fourteen policemen, one
police soman stenographer, one police woman clerk, and one
parking meter attendant checker.
Section 3. Qualifications term removal and oath. No
person shall be appointed to any position in the police
department who is not able-bodied, industrious and sober, and
who is not a qualified voter of the city and a resident thereof
for at least one year prior to said appointment. Each member
of the police department shall hold his office for a period of
one year, provided that the mayor, with the consent of a
majority of the members of the city council, may remove any
member of the department, with the exception of the Chief of
Police, at will, and that the city council by a two-thirds vote
of all members elected to that body, may remove any member of
the department, with the exception of the Chief of Police, at
will, without the mayor's recommendation or approval; and
provided further that before entering upon the discharge of
their duties, each member of the department shall take and
subscribe to an oath or affirmation as is required by the charter
of the city for city officers and employees.
Section 4. foolice Board to rass upon qualifications. The
police board of f e city shall pass upon the eligibility and
qualifications all applicants for the positions in the police
department, except the Chief of Police. At least five (5)
days before the second regular meeting of the city council after
each city election, the Chief of Police shall submit to the
police board a list of the names of applicants for positions in
the police department, In no event shall the list contain
fewer names than the number of policemen currently authorized.
From the 1st of applicants submitted to it, the police board
shall return to the Chief of Police a list of the names of
applicants whose qualifications are approved by it.
Should the Chief of Police submit a list
containing more names than the number of personnel currently
authorized, and should the board find that there are a greater
number of applicants whose qualifications are satisfactory,
for positions in the department than the number of currently
authorized positions in the department, the Board, in its
discretion, may return to the Chief of Police a list of names
of applicants exceeding the number of positions currently
authorized in the department, and the Chief of Police shall select
therefrom a sufficient number of the applicants to fill tie
positions currently authorized in the department.
In the event the board fails to approve a
sufficient number of names from the list submitted to fill all
�� positions currently authorized in the department, the Board shall

return to the Chief of Police the names of such persons whose
qualifications have been approved, and the Chief of Police
shall immediately send to the board sufficient additional names
to equal the remaining number of positions to be filled in the
department.
The Police Board shall confer with the Chief
of Police from time to time to determine if the department is
being properly conducted, and the Board shall make such reports
and recommendations, touching upon the needs and operation of
the department, as the Board deems proper.
Section 5. Al2pointment of Personnel. It shall be the duty
of the Chief of Police, at or before the second regular meeting
of the city council after each regular city election, to appoint
all personnel authorized by ordinance to their position in the
department for a term of one year. All personnel appointed
shall have been approved by the Police Board, and the appointments
of all personnel shall be subject to confirmation by a majority
of the members of the city council.
Section 6. Desi nation of Rank in the De artment. The
Chief of Police shall designate the names of the two police
captains, the lieutenant-detecattre4, the four police sergeants,
the two police corporals, the police woman stenographer, the
police clerk typist, and the parking meter attendant checker.
Section 7. Duties of Personnel. All personnel in the
department shall perform sucFi duties as may be designated to
them by the Chief of Police. Each member of the department
shall be prompt and alert in the discharge of their duties,
hold themselves in readiness to obey and execute all lawful
orders, rules and regulations of the department, the mayor
and the city council. All members of the department shall
report any known violations of the city ordinances and take such
steps as may be necessary to enforce all ordinances of the city.
Section 8. Uniform and badQe, ,21 inclothesmen. Every
member of the department, while on duty, shall wear a uniform
and badge to indicate his or her official position, and the
kind of uniform and badge shall be prescribed by the Chief of
Police and the Police Board. The city shall furnish such badge
but each member of the department shall furnish their own
uniform out of the .--blothing allowance authorized by ordinance.
The Chief of Plice and the Police Board may designate one or more
® of the members of the department as plainclothesman during such
period of time as they may deem necessary.
Section 9. Eight hour day. All of the members of the
department shall work only eight (8) hours a day unless in case
of an emergency. Three eight (8) hour shifts each day shall
be arranged by the Chief of Police in such manner as will best
promote efficient working conditions in the department.
Section 10. Reports. The Police Department shall keep
a record of all routine calls received in the department and
all records of the personnel of the department. Every member
of the department assigned to a beat or to police car patrol
shall report to the Department once each hour while on duty.
In the assignment of personnel to beats or police car patrol duty,
the Chief of Police shall attempt to provide the greatest measure
of protection to the business sections of the city.
Section 11. Powers of arrest. All personnel in the
department shall have t e power to arrest all persons observed
violating the laws of the United States of America, the State of
Missouri and the ordinances of the city in the same manner as
the Chief of Police could perform such arrest, and thereafter
keep any person arrested in Jail or under detention, subject
to the ordinances of the city relating to bond, to prevent their
escape until such person can be brought before the police court

for trial or other disposition of the offense for which the
arrest was made.
Section 12. Persons Arrested; search of.--RroneXty held how
Whenever any person shall e arrested for a felony, or in an
attempt to perpetrate a felony, the regular police officer making
such arrest shall immediately cause such person to be searched,
and all money, notes, letters, checks, or property of whatever
description, found upon his or her person, shall be taken
possession of by the officer and thereupon reported to the Chief
of Police, who shall make and preserve a correct memorandum of
the same, and be responsible for its safekeeping until otherwise
disposed of by the police judge, or other proper authority.
When any person shall be arrested for drunkenness, disturbing
the peace, or other violation of any ordinance of this city, it
shall be lawful for any regular police officer making such arrest
to dispossess such person of any knife, pistol or other dangerous
weapon he may find on or about his person, and the property so
taken shall be reported to the Chief of Police and accounted
for as provided in case of an arrest for felony.
Section 13. Misconduct in office. Any member of the
department who shal ecome intoxicated or in any wise improperly
conduct himself or herself while on duty, or who shall accept
from any person arrested any present or gratuity of any descriptio ,
or who shall refuse or neglect to discharge the duties imposed
by the ordinances of this city, shall be deemed guilty of a
misdemeanor and upon conviction shall be fined not more than
$100.00 and upon the entry of a final judgment shall be discharge ;
provided that, any member of the department may be temporarily
suspended by the Chief of Police, with the consent of the Police
Board, pending any investigation of a complaint of misconduct
in office.
Section 14. Sr>ecial police, a intment oath wers
duties discharge. The Chief of Police shall have the power and
authority to appoint special policemen, subject to the
confirmation of the mayor and the city council, in case of
extraordinary emergencies, such as public celebrations, exhibitions
or gatherings within the city, or, when for other causes the
public safety may require it.
Before entering upon the discharge of their
duties, such special policemen shall take and subscribe to the
oath of office required of other members of the department.
While acting as policemen, said special
policemen shall have the same powers and duties as all other
personnal in the police department, and upon the termination of
the emergency or other cause for their appointment, they shall
be discharged by the Chief of Police.
Section 15. All other ordinances in conflict with this
ordinance creating grades in rand of personnel within the
police department are repealed insofar as they conflict with
this ordinance.
Section 16. This ordinance shall take effect and be in
force from and after its passage and approval.
