HomeMy Public PortalAboutORD07315 1 I 1 w w � ORDINANCE N0. 7315 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING i SECTIONS 8, 14, 15 and 16 OF ORDINANCE NUMBER 3745 (SECTIONS 718 724, 725 and 726 OF THE REVISED ORDINANCES OF THE CITY OF JEFFERSON 1956) RELATING TO THE ISSUANCE OF INTOXICATING LIQUOR LI6ENSES, AND ENACTING A NEW SECTION 8, 14, 15 and 16 OF ORDINANCE NUMBER 3745 (ALSO TO BE KNOWN AS SECTIONS 718, 724 725 and 726 OF THE REVISED ORDINANCES OF THE CITY OF JEFFERSON, 1956) RELATING "TO THE SAME SUBJECT BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Sections 8, 14, 15 and 16 of Ordinance Number 3745 (also known as Sections 718, 724, 725 and 726 of the Revised Ordinances of the City of Jefferson, Missouri, 1956), be, and the same are hereby repealed. Section 2. There are hereby enacted four new provisions to be known as Sections 8, 14, 15 and 16 of Ordinance Number 3745, and also Sections 718, 724, 725 and 726 of the Revised Ordinances of the City of Jefferson, 1956, regulating the issuance of intoxicating liquor licenses, which shall read in words and figures as follows: "ORDINANCE NO. 3745 Section 8. Bond required. - - Before any license shall be issued, the applicant therefor shall apply in writing to the city collector, giving the location of the place of business, the names of all parties interested in the business to be operated under said license, except in the case of a corporation, the name of the president, secretary and manager only need be given, and shall execute and file with the cit collector a bond in the sum of Two Thousand Dollars ($2,000T with good and sufficient sureties, such bond to be approved by the board of liquor control, conditioned that the person or persons obtaining such license shall keep at all times an orderly house in conformity with this ordinance, and that he or they will not sell, give away, or otherwise dispose of or suffer the same to be done, about his or their premises, any intoxicatin liquor in any quantity to any minor, or on Sunday to anyone, or to an habitual drunkard, and conditioned that he or they will not violate any of the provisions of this ordinance, and that he or they will pay all taxes and license fees provided for herein, together with all fines and penalties which may be adjudged against him or them under the provisions of this ordinance. Section 14. Adjoining property owners must give consent. No license* as'required by this ordinance for the sale of in- toxicating liquor for consumption on the premises where sold shall be issued until the applicant or applicants therefor shall file with the city collector a statement signed by a majority of the resident property owners owning real property in the block in which said liquor business is to be located. waiving any objection to the establishment of the business for which such license is sought. For the purpose of this ordinance, � . the word 'block' shall be construed to mean a square block as l ��. platted in the plat of Jefferson City. I I All applications for licenses provided for in this ordinance and all petitions so filed with said applications shall be by the City Collector referred to a board to be known as the board of liquor control, which board shall be composed of the pemons holding the office of mayor, city attorney and city engineer, respectively, and the collector shall issue no such license without the written approval of a majority of said board of liquor control. It shall be the duty of said board of liquor control to determine whether or not the application for license complies with the provisions of this ordinance relative to licenses to be paid, distance from churches, school houses, play grounds, public parks, and until said application is approve in writing by said board, of liquor control, the collector shall have no authority to issue such licenses: Provided, however, that any application for a license whose application may be acted upon adversely by the board of liquor control, or any other citizen who may deem the board's finding improper, may, within ten days after such action by the board of liquor control, file a petition with the city council appealing from the action of the said board of liquor control, and the council shall have final authority in said matter, and shall have the right to reverse as it deems proper, the action of the board of liquor control. On matters appealed to the council from the board of liquor control the mayor shall have no right to vote. ANk Section 15. Licenses to contain what. - - All licenses shall be issued by the city collector of the City of Jefferson, upon the proper forms and each license shall state specifically whether the license is for a distiller, brewer, wholesaler, distributor, and in the case of a retailer's license, shall state the alcoholic content of the intoxicating liquor to be sold under said license, and whether said license is issued authorizing the sale of intoxicating liquor or consumption on the premises, or authorizing the sale, only in the original package, not for consumption on the premises, or whether said license issued is for both, the sale in the original package and for consumption on the premises where sold. Section 16. City collector shall keep records. - - The city collector shall keep a complete record of all licenses issued, the date when issued, and of all license fees collected by reason of the issuance of said licenses , shall transmit all license taxes collected by reason of this ordinance to the city treasurer within twenty-four (24) hours after the same have been collected, and report to the council at the first regular meeting of each month all license fees collected, by whom paid and to whom said licenses have been issued, and the city collector shall also report monthly to the city council a list of all persons, firms and corporations who have been licensed under the provisions of this ordinance, and who have failed or neglected to renew such license at its expiration, and shall deliver a copy of such report to the marshal of the City of Jefferson; and it is hereby made the duty of the marshal of the City of Jefferson to investigate such person, firm or corporation whose license has not been renewed, or any other person, firm or corporation who has been reported to him asiselling intoxicating liquor as defined in the provisions of this ordinance without first obtainin a license as provided herein, and if such person, firm or corporation is selling intoxicating liquor as defined herein, it shall be the duty of said marshal to arrest such person, firm or official of any such corporation and report such arrest to the city attorney for proper disposition." Section 3.
