An Ordinance amending Ordinance No. 5340 and
authorizing and directing the Mayor and the City Clerk
of the City of Jefferson , Missouri , to execute an amended
Lease on the part of the City of Jefferson , Missouri
relating to an agreement between the City of Jefferson,
Missouri and the Missouri Pacific Railroad Company
covering property on which the City Scales are located,
situated at the Northeast corner of Harrison Street and
West Main Street in the City of Jefferson, Missouri.
Section 1. The Mayor and City Clerk of
the City of Jefferson, Missouri , are hereby authorized
and directed to execute an amended lease on the part of
the City of Jefferson, Missouri , relating to an agreement
between the City of Jefferson, Missouri , and the Missouri
Pacific Railroad Company, covering property on which the
City Scales are located, situated at the Northeast corner
of Harrison Street and West Main Street in the City of
Jefferson, Missouri.
Section 2. Said amendment shall read

Gentlemen:
Reference is made to that certain written agreement of lease
dated May 24, 1949 (our number LA-18012), hereinafter called "Original
Agreement", now in effect between Missouri Pacific Railroad Company and
the City of Jefferson City, covering 600 square feet of the Railroad's
property at Jefferson City, Missouri as site for scale house.
Missouri Pacific Railroad Company proposes to assess a rental
of $60.00 per annum under Original Agreement, which is representative
of the present fair value of the premises, and amend Original Agreement
to permit the Railroad to redetermine the fair value of the premises at
the end of each five year period of the term of Original Agreement, to
which we understand the City of Jefferson City is agreeable.
Now, therefore, effective May 24, 1963, Paragraph 1 of Original
Agreement shall be, and hereby is, amended to read:
"l. Premises shall be used solely as site for
Lessee's existing scale house. Lessee sha11 pay, and
Carrier shall accept, in equal annual installments, each
in advance, rental computed at rate of six per centum per
annum on Premises' fair value ($1,000.00 on first day of
term hereof), as increased from time to time by addition
on each anniversary of said day of assessments (not
general taxes) paid by Carrier on Premises during last
preceding year. Fair value of Premises may be redetermined
by Carrier at the end of each five year period this lease
may be in effect, and rental shall be based on such rede-
termined fair value as increased from time to time there-
after as in this Paragraph 1 provided. Lessee shall pay
all taxes on Lessee's improvements, and all charges, levied
or assessed against Premises during term hereof, for water
and electricity used on Premises and all assessments for
street sprinkling, sweeping and oiling."
This letter is furnished in duplicate. Please indicate the
City of Jefferson City, Missouri's acceptance by having an appropriate
officer sign in the space provided and return the duplicate hereof to the
undersigned, following which this letter shall become a supplement to

Original Agreement, amending same solely to the extent herein provided.
Original Agreement, as hereby supplemented and amended, shall remain in
force and effect pursuant to the terms and conditions therein.
