S. Highway No. 54; thence south along said quarter section line and along the east line of the Northwest quarter of said Section 24, to the point of intersection with the southerly right-of-way line of Ellis Boulevard at Station 1886, per plat of record in Plat Book 6, pages 50, 51 , 52 and 53, Cole County Recorder's Office; thence westerly along the southerly right- of-way line of said Ellis Boulevard, to Station 15 46 per the said plat; thence southwesterly, 350 feet from and parallel with the easterly right-of-way line of said Highway No. 54, to the south line of the North half of the Northwest quarter of said Section 24; thence west along the said half quarter section line , 69. 06 feet, more or less, to the most easterly corner of a tract conveyed to F. Joe DeLong, et al, by Warranty Deed of record in Book 174, page 126, Cole County Recorder's Office; thence South 39 degrees 07 minutes west, along the easterly line of said tract, 688. 95 feet, to the most southerly corner thereof; thence North 50 degrees 53 minutes west, along the westerly line of said tract, 300 feet, to the southeasterly right-of-way line of U. S. Highway No. 54; thence northeasterly along the southeasterly right-of-way line of said Highway, to the point of beginning. AND WHEREAS, the City Council of the City of Jefferson, Cole County, 14issouri, did adopt a resolution on the 4th day of February, 1963, proposing the annexation of the following- described area of land to the present corporate limits of the city: Part of the northeast quarter of the southwest quarter of Section 13, Township 44, Range 12, particularly described as follows: Beginning at the southwest corner of the northeast quarter of the southwest quarter of said Section 13, Township 44, Range 12, thence north 20. 81 chains to the northwest corner thereof; thence east 9. 89 chains; thence south 15 degrees 45 minutes east 7.46 chains; thence south 39 degrees east 10. 94 chains; thence south 46 ji degrees east 2. 72 chains; thence north 49 degrees 30 minutes east 0.08 chains to the westerly line of U. S. Highway No. 54; thence south 28 degrees west 2.65 chains to the south line of said quarter quarter section; thence west along the said south line to the southeast corner of a tract of land conveyed to Joe A. Vaughan and wife by Warranty Deed of record in Book 114, page 5271 Cole County Recorder's Office; thence north 38 degrees west 251 feet; thence north 56 degrees west 1.5 chains; thence north 71 degrees west 1.3 chains; thence south 60 degrees 30 minutes est 1.3 chains; thence south 45 degrees west 6.56 chains, more or less, to the south line of the quarter quarter section; thence west along the quarter quarter section line 221 feet to the point of beginning. AND WHEREAS, the City of Jefferson, Missouri did cause to be filed and the Circuit Court of Cole County, Missouri, two separate suits in each of which the city petitioned said court to authorize the city to annex areas of land hereinabove described, and WHEREAS, on the 2nd day of March, 1963, said court did enter its judgment in each of said suits for a declaratory judg- ment authorizing the city to proceed with the annexation of each of the tracts of land sought to be annexed, as hereinabove Ah described, in the manner provided by law, and WHEREAS, the Mayor and the City Council of the City of efferson, Missouri, with the consent of a majority of the legal voters of said city voting at an election thereof, by the ssage and approval of a city ordinance, has power to extend the imits of the city over territory adjacent thereto, and WHEREAS, the Mayor and the City Council of said city of Jefferson, Missouri, and believe that an election of the people of said city should be held to determine if a majority of the legal voters thereof are in favor of extending the limits of the city over territory adjacent thereto: OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY F JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. That at the general city election to be held in the City of Jefferson, County of Cole, Missouri, on Tuesday, the 2nd day of April, 1963, the following propositions shall be submitted to the qualified voters of said city, to-wit: PROPOSITION NO. 1 (U.S. Highway 54 South Area) That the present city limits of the City of Jefferson, Cole County, Missouri, shall be extended to include the following-described area of land adjacent to the present incorporated area of the city: Part of the Southeast quarter of the Southwest quarter of Section 13, Township 44 North, Range 12 West, and part of the Northwest quarter of Section 241 Township 44 North, Range 12 West, more particularly described as follows: Beginning at a point on the west line of the Southeast quarter of said Section 13, where said quarter section line intersects the easterly right-of-way line of U. S. Highway No. 54; thence south along said quarter section line and along the east line of the northwest quarter of said Section 24, to the point of intersection with the southerly right-of-way line of Ellis Boulevard • at Station 18486, per plat of record in Plat Book 61 pages 50, 51, 52 and 53, Cole County Recorder's Office; thence westerly along the southerly right- of-way line of said Ellis Boulevard,to Stateion 15446 per the said plat; thence southwesterly, 350 feet -2_ from and parallel with the easterly right -of-way line of said Highway No. 54, to the south line of the North half of the northwest quarter of said Section 24; thence west along the said half quarter section line, 69. 06 feet, more or less, to the most easterly corner of a tract conveyed to F. Section 2. That the said election shall be held in all the wards and precincts of said city and at the same poling places designated for the election of city officials. Polls of said election shall be open at the hour of six A.M. , and continue open until the hour of seven P.M. , on said date. Said election shall be hald and conducted and the results thereof shall be certified, canvassed, and declared in all respects in conformity with the Constitution and Laws of the State of Missouri governing elections in said City of Jefferson and in accordance with the ordinances of said city. • Section 3. That the City Clerk be and she is hereby authorized and directed to give notice of said election by publication in the Jefferson City Post-Tribune, a daily newspaper printed and published in the City of Jefferson and of general circulation therein. Said notice shall be published in said newspaper once a week for four consecutive weeks, and on the same day in each week. The first publication of said notice -3- shall be made at least twenty-one (21) days before the date of said election and the last publication shall be made within two (2) weeks of the date of said election. The notice to be so published shall be in substantially in the following form, to-wit: NOTICE OF ELECTION CITY OF JEFFERSON, MISSOURI Notice is hereby given that at the general city election to be held in the City of Jefferson, Cole County, Missouri, on Tuesday, April 2, 1963, there will be submitted to the qualified voters of said city the following propositions: PROPOSITION NO. 1 if (U, S. S. Highway No. 54 ( now Cole County Highway "C" ) ; thence south 28 degrees west 2.65 chains to the south line of said quarter-quarter section; thence west along the said south line to the southeast corner of a tract of land conveyed to Joe A. The polls at said election shall be open at the hour of six o'clock A.M. and will continue open until the hour of seven o'clock P.M. on said date. All persons who are legal voters in said city will be entitled to vote at said election.
