ORDINANCE 140.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING
AND DISCONTINUING AS A PUBLIC STREET A PORTION OF THE RIGHT
OF WAY OF' COLE DRIVE AND A PORTION OF THE RIGHT OF WAY OF
ALLEN DRIVE, AS THE RIGHT OF WAY OF COLE DRIVE AND ALLEN
DRIVE APPEARS IN THE PIAT OF SUNSET PLACE ADDITION, AND
AUTHORIZING AND DIRECTING THE V1AYOR AND THE CITY CLERK OF
SAID CITY TO EXECUTE ANY INSTRUMENTS REQUIRED TO CONFIRM IN
THE ABUTTING PROPERTY THEIR REVERSIONARY RIGHTS TO THE
VACATED RIGHT OF WAY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. It is hereby declared that the City of
Jefferson, Missouri, deems it necessary and expedient to
vacate and discontinue as a public street a portion of
the existing street right of way of Cole Drive and Allen
Avenue and the portions of the right of way of the aforenamed
streets hereby vacated are described as follows:
(a) "Cole Drive. - Part of the right of way of
Cole Drive in Sunset Place Addition, as
appears of record in Plat Book 2 at Page 47,
Cole County Recorder's Office; in the City
of Jefferson, Missouri, more particularly
described as:
Beginning at a point on the Easterly right of
way line of Cole Drive, said point being
1062 feet West of and 103 feet North of the
Southeast corner of said Sunset Place; thence
Northwesterly along and with the Easterly
right of way line of Cole Drive to a point
being 1163 feet West of and 143 feet North
of the Southeast corner of said Sunset Place;
thence in a direct line to a point being 1137
feet west of and 82 feet North of the Southeast
corner of said Sunset Place; thence Easterly,
15 feet from and parallel with the North curb
of Hayselton Drive, to the point of beginning.
Subject however, to the reservation and retention
by the City of Jefferson, Missouri, of an
existing surface water drainage eELsement
conveyed by Charles Howard and Patricia Howard,
his wife, to the City of Jefferson, Missouri, by
deed executed December 18, 1959, and of record
in Book 165, Page 5431 Cole County Recorder's
Office."
(b) "Allen Avenue. - Part of the right of way of
Allen Avenue in Sunset Place Addition, as
appears of record in Plat Book 2, at Page 47,
Cole County Recorder's Officer in the City of
Jefferson, Missouri, more particularly
described as:
Beginning at a point on the Westerly right
of way line of Allen Drive, said point being
1000 feet West of and 111.5 feet North of
the Southeast corner of said Sunset Place;
thence Easterly, 15 feet from and parallel,
with the North curb of Hayselton Drive, to
a point being 15 feet Westerly of the West
curb of Allen Drivel to the present right of
way line of Allen Drive; thence Southerly along
and with the present right of way line of Allen
Drive to the point of beginning."
Section 2. The owners of the property abutting the
above-described portion of the right of way of Cole Drive
and Allen Avenue having petitioned the City Council to
vacate said right of way and discontinue the use of same
for public street purposes, and said petition having been
referred to the City Street Committee for study and re-
commendation, and the City Street Committee having
recommended that the petition be granted and that the right
of way described in Section 1 be vacated, it is hereby
declared that the right of way specifically described in
Section 1 above be, and it is hereby, forever vacated and
discontinued as right of way for public street purposes.
Section 3. The statutory right of reversion in the
owners of the property adjacent said vacated areas of right
of way, as provided by the laws of Missouri, is hereby
confirmed, and the Mayor and the City Clerk of the City are
hereby authorized and directed to execute any instrument
required by law to confirm in the abutting property owners
their right of reversion in the right of way hereinabove
vacated.
