AN ORDINANCE OF THE CITY OF JEFFERSON MISSOURI VACATING
AND DISCONTINUING AS A PUBLIC STREET k PORTION 6F THE RIGHT
OF WAY OF BERRY STREET, AS THE RIGHT OF WAY OF BERRY ,STREET
APPEARS IN THE PLAT OF CRANDALL'S ADDITION IN THE CITY OF
JEFFERSON MISSOURI, RESERVING TO THE CITY A CONSTRUCTION
EASEMENT fil PART OF THE RIGHT OF WAY VACATED, AND AUTHORIZING
AND DIRECTING THE MAYOR AND THE CITY CLERK TO EXECUTE SUCH
INSTRUMENT AS MAY BE NECESSARY TO CONFIRM IN THE ABUTTING
PROPERTY OWNERS THEIR REVERSIONARY RIGHTS IN THE AREA VACATED
SUBJECT TO A CONSTRUCTION EASEMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
® Section 1. The City of Jefferson, Missouri, hereby
declares that it is expedient and necessary to vacate and
discontinue as a public street the following-described portion
of the existing street right of way of Berry Street:
Beginning at the northwesterly corner of Lot 5,
Block 13, of Crandall's Addition in the City of
Jefferson, Missouri, as of record in Plat Book 1,
Page 74, Cole County Recorder's Office, thence
westerly along the extension of the northerly
line of said Lot 5, Block 13, 20 feet; thence
southerly 20 feet from and parallel to the
westerly line of Lot 5 Block 13, 75 feet; thence
turning an angle of 196 16' to the left,
60:7 feet, more or less, to the westerly line of
Lot 5, Block 13; thence northerly along and with
the westerly line of said Lot 5, Block 13,
132.4 feet, more or less, to the point of
beginning.
Subject, however, to the reservation and retention
by the City of Jefferson, Missouri, of an easement for the
purpose of constructing, repairing and maintaining a street
within that portion of the right of way of Betty Street
remaining after the vacation of that portion of the right
of way of Berry Street hereinabove described, over the
following-described land located in the City of Jefferson,
Cole County, Missouri, to-wit:
From the northwesterly corner of Lot 5, Block 13
of Crandallfs Addition in the City of Jefferson,
Missouri, as of record in Plat Book 1, .Page 74,
Cole County Recorder's Office; thence westerly
along the extension of the northerly line of
said Lot 5, Block 13, 20 feet to the point of
beginning of this description; thence southerly
20 feet from and parallel to the westerly line of

Lot 5, Block 13, 75 feet• thence turning an
angle of 190 16' to the eft 30.3 feet more
or less, to a point that is f0 feet westerly of
the westerly line of Lot 5, Block 13, of
Crandall's Addition; thence northerly 10 feet
from and parallel to the westerly line of said
Lot 5, Block 13 103.7 feet, more or less, to
the southerly line of McCarty Street.
Section 2. The owners of the property abutting the
above-described portion of the right of way of Berry Street
having petitioned the City Council to vacate said right
of way and discontinue the use of same for public street
purposes, and said petition having been referred to the City
Street Committee for study and recommendation, and the City
Street Committee having recommended that the petition be
granted and that the right of way described in Section 1 be
vacated, it is hereby declared that the right of way speci-
fically described in Section 1 above be, and it is hereby,
forever vacated and discontinued as right of may for public
street purposes, subject to the reservation and retention
by the City of Jefferson, Missouri, of the construction
easement hereinabove mentioned.
Section 3. The statutory right of reversion in the
owners of the property adjacent said vacated area of sigh
of way, as provided by laws of Missouri, is hereby confirmed,
and the Mayor and the City Clerk of the City are hereby
authorized and directed to execute any instrument required
by law to confirm in the abutting property owners their right
of reversion in the right of way hereinabove vacated.
Section 4. This ordinance shall take effect and be in
force from and after its passage and approval.
